Abstract
Pada skripsi ini penulis mengangkat permasalahan Implementasi Pasal 9 Ayat (1) Huruf E Peraturan Daerah Kota Kediri Nomor 4 Tahun 2010 Tentang Perubahan Atas Peraturan Daerah Kota Kediri Nomor 2 Tahun 2009 Tentang Perusahaan Daerah Pasar Kota Kediri Di Perusahaan Daerah Pasar Kota Kediri. Pemilihan tema ini dilatarbelakangi oleh adanya beberapa keluhan para pedagang salah satu pasar yang dikelola oleh pihak PD. Pasar Kota kediri yaitu mengenai kondisi pasar yang kurang layak, kotor, kumuh dan kondisi bangunan pasar. Berdasarkan hal tersebut diatas, skripsi ini mengangkat rumusan masalah : (1) Bagaimana implementasi Pasal 9 Ayat (1) Huruf E Peraturan Daerah Kota Kediri Nomor 4 Tahun 2010 Tentang Perubahan Atas Peraturan Daerah Kota Kediri Nomor 2 Tahun 2009 Tentang Perusahaan Daerah Pasar Kota Kediri? (2) Apa yang menjadi kendala dalam implementasi Pasal 9 Ayat (1) Huruf E Peraturan Daerah Kota Kediri Nomor 4 Tahun 2010 Tentang Perubahan Atas Peraturan Daerah Kota Kediri Nomor 2 Tahun 2009 Tentang Perusahaan Daerah Pasar Kota Kediri? (3) Apa solusi yang dilakukan untuk mengatasi kendala dalam implementasi Pasal 9 Ayat (1) Huruf E Peraturan Daerah Kota Kediri Nomor 4 Tahun 2010 Tentang Perubahan Atas Peraturan Daerah Kota Kediri Nomor 2 Tahun 2009 Tentang Perusahaan Daerah Pasar Kota Kediri? Penulisan skripsi ini menggunakan metode penelitian yuridis empiris dengan metode pendekatan yuridis sosiologis, yang mendasarkan penelitian pada peraturan yang berlaku dan juga dikaitkan dengan keadaan nyata dilapangan. Data yang digunakan adalah data primer dan data sekunder yang diperoleh dari hasil wawancara di Perusahaan Daerah Pasar Kota Kediri. Hasil penelitian ini penulis memperoleh jawaban yaitu: dalam pengimplementasikan pasal mengenai tugas Direksi dalam mengelola aset/kekayaan PD. Pasar, pihaknya telah melakukan pengelolaan semaksimal mungkin, meskipun hasil akhirnya belum bisa 100% maksimal. Karena permasalahannya menyangkut para pengguna yaitu pedagang dan pembeli. Kendala diantaranya: kurangnya pemahaman para pedagang, melanggar aturan, kurangnya kesadaran mengenai kebersihan pasar, kondisi gedung pasar yang cukup tua, serta lemahnya sanksi dan kurang tegasnya pihak Perusahan Daerah dalam menertibkan aturan Perusahaan. Upaya yang dilakukannya yaitu pembaharuan hak pakai dengan memberikan pengarahan terlebih dahulu, peneguran secara lisan, menyediakan petugas kebersihan, perawatan rutin dan revitalisasi pada salah satu pasar yaitu Pasar Setonobetek di tahun 2017.
English Abstract
In this thesis the author raised the problem Implementation Of Article 9 Paragraph (1) Letter E Of Kediri Regional Regulation Number 4 Year 2010 On The Amandement Of Kediri Regional Regulation Number 2 Year 2009 On The Regional Company Of Kediri Traditional Market In The Company Of The City Market Area Kediri. The selection of this theme is motivated by there are several complaints of seller one of the market managed by the PD. Kediri City Market is about market conditions that are less feasible, dirty, slums and market building conditions. Based on the above, this thesis raised the problem formulation:(1) How to The Implementation Of Article 9 Paragraph (1) Letter E Of Kediri Regional Regulation Number 4 Year 2010 On The Amandement Of Kediri Regional Regulation Number 2 Year 2009 On The Regional Company Of Kediri Traditional Market ? (2) What are the constraints in implementation Of Article 9 Paragraph (1) Letter E Of Kediri Regional Regulation Number 4 Year 2010 On The Amandement Of Kediri Regional Regulation Number 2 Year 2009 On The Regional Company Of Kediri Traditional Market ? (3) What is the solution done to overcome the obstacles in the implementation of Article 9 Paragraph (1) Letter E Of Kediri Regional Regulation Number 4 Year 2010 On The Amandement Of Kediri Regional Regulation Number 2 Year 2009 On The Regional Company Of Kediri Traditional Market ? Writing this thesis employs empirical juridical research method with sociological juridical approach, based on research on the applicable regulation and also related to real situation in field. The data used are primary data and secondary data obtained from interviews in Kediri City Market Company. The results of this study the authors obtain answers are: in implementing the article on the task of the Board of Directors in managing assets / wealth PD. Market, it has done the management as much as possible, although the end result can not be 100% maximum. Because the problem concerns the users ie traders and buyers. Constraints include: lack of understanding of traders, breaking the rules, lack of awareness about market hygiene, the condition of the old market building, as well as the lack of sanctions and lack of strictness of the local company in disciplining the rules of the Company. Efforts are made by renewing the use rights by providing guidance in advance, oral reassurance, providing janitor, routine maintenance and revitalization in one of the market that is Setonobetek Market in 2017.
