Abstract
Keberadaan Undang-Undang Nomor 23 Tahun 2014 tentang Pemerintahan Daerah membawa perubahan mendasar terhadap klasifikasi urusan pemerintahan. Perubahan tersebut berpengaruh terhadap pengalihan kewenangan sejumlah bidang yang semula dikelola oleh pemerintah kabupaten/kota, kini dikelola oleh pemerintah provinsi.Salah satunya ialah kewenangan pengelolaan pendidikan menengah.Pasca penetapan tersebut menimbulkan sejumlah dampak dan memicu munculnya gugatan judicial review oleh Walikota Blitar yang diajukan ke Mahkamah Konstitusi. Pengalihan tersebut pun dianggap memberikan kerugian konstitusional warga masyarakat. Melalui hal tersebut perlu dikaji terkait penyelenggaraan pengelolaan pendidikan menengah pasca dialihkan ke pemerintah provinsi. Peneliti berfokus pada analisis alih kelola pendidikan menengah dari Pemerintah Kabupaten/Kota ke Pemerintah Provinsi, dengan studi di Kota Blitar, yang juga meliputi kendala dan solusinya. Metode penelitian yang digunakan dalam penelitian ini yakni kualitatif deskriptif. Kajian teori yang digunakan dalam penelitian ini adalah teori rational choice institusionalism dan konsep hubungan pemerintah pusat dan daerah. Hasil penelitian menunjukkan dengan alih kelola pendidikan menengah maka pengelolaan berada ditangan Dinas Pendidikan Provinsi Jawa Timur dan Cabang Dinas Pendidikan Wilayah Kabupaten/Kota Blitar. Pemerintah Kota Blitar masih dapat terlibat meskipun keterlibatannya terbatas. Pemerintah Provinsi Jawa Timur sendiri memiliki upaya atau tindakan yang dilaksanakan sesuai instrument yang ada sehingga kepentingannya hanya bersifat normatif. Sedangkan Pemerintah Kota Blitar kurang maksimal dalam melaksanakan keterlibatannya. Pendidikan menengah di Kota Blitar pun belum dapat dikatakan berjalan efektif dan efisien. Terdapat kendala pada pengelolaan yang dilaksanakan oleh dinas pendidikan provinsi dan cabang dinas pendidikan. Begitu juga oleh Pemerintah Kota Blitar dimana terdapat sejumlah persoalan dalam merumuskan kebijakan bantuan. Namun beberapa kendala tersebut pun telah ditindaklanjuti dengan melaksanakan pelayanan berbasis online, penguatan komitmen dan pemerataan SDM.
English Abstract
The existence of Law No. 23 of 2014 concerning Regional Government brought a fundamental change to the classification of government affairs. These changes have an effect on the transfer of authority from a number of fields which were originally managed by the district / city government, now managed by the provincial government. One of them is the management authority of secondary education. One of them is the management authority of secondary education. Post-determination caused a number of impacts and triggered the emergence of a lawsuit for judicial review by the Mayor of Blitar which was submitted to the Constitutional Court. The transfer was also considered to provide a constitutional loss to the citizens of the community. Through this, it’s necessary to examine the implementation of secondary education management after being transferred to the provincial government. The researcher focused on analyzing secondary education management from the Regency / City Government to the Provincial Government, with a study in Blitar City, which also included constraints and solutions. Metode penelitian yang digunakan dalam penelitian ini yakni kualitatif deskriptif. The theoretical study used in this study is the theory of rational choice institutionalism and the concept of relations between the central and regional governments. The results of the study showed that with the management of secondary education the management was in the hands of the East Java Provincial Education Office and the Blitar District / City Education Office Branch. Blitar City Government can still be involved even though its involvement is limited. The East Java Provincial Government itself has efforts or actions that are implemented according to existing instruments so that their interests are only normative. While the Blitar City Government is not maximal in carrying out its involvement. Secondary education in Blitar City cannot be said to be effective and efficient. There are obstacles to management carried out by the provincial education office and the education office branch. Likewise, the Government of Blitar City has a number of problems in formulating aid policies. However, some of these obstacles have been followed up by implementing online-based services, strengthening commitment and equitable distribution of human resources
