Abstract
Pada skripsi ini dilatar belakangi bahwa berdasarkan pasal 285 Undangundang Republik Indonesia Nomor 22 tahun 2009 tentang Lalu Lintas dan Angkutan Jalan. Dalam pelaksanannya oleh Kepolisian Resor Kota Besar Surabaya Bagian Satuan Lalu Lintas belum ditegakkan sebagaimana mestinya terhadap kendaraan Vespa produksi sebelum tahun 1980. Kendaraan Vespa produksi sebelum tahun 1980 tidak sesuai dengan kelengkapan kendaraan seperti dalam Undang-undang Republik Indonesia Nomor 22 tahun 2009 tentang Lalu Lintas dan Angkutan Jalan. Penelitian ini menggunakan metode yuridis empiris, pendekatan yang digunakan adalah yuridis sosiologis. Teknik pengambilan data, Wawancara, Angket (kuesioner), Observasi. Hasil dari penelitian menunjukkan bahwa pihak Kepolisian Satuan Lalu Lintas Kota Surabaya belum menerapkan pasal 285 Undang-undang Republik Indonesia Nomor 22 tahun 2009 tentang Lalu Lintas dan Angkutan Jalan terhadap kendaraan Vespa produksi sebelum tahun 1980.
English Abstract
This research is based on the study on Article 285 of Law of the Republic of Indonesia Number 22 of 2009 on Road Traffic and Transport. It was found that the law has not been appropriately implemented by the Traffic Unit of Sub-regional Police Department of Surabaya Metropolitan City regarding the Vespa motor scooters that are manufactured earlier than 1980. This type of two-wheeled vehicle has not met the requirement as regulated in the Law of the Republic of Indonesia Number 22 of 2009 on Road Traffic and Transport. Empirical juridical research method along with socio-juridical approach was employed, while the data was obtained from interviews, observation, and questionnaire. The research result reveals that the Traffic Unit has not appropriately implemented Article 285 of Law of the Republic of Indonesia Number 22 of 2009 on Road Traffic and Transport related to the Vespa scooters manufactured before 1980.
