Abstract
Pada skripsi ini penulis mengangkat tentang Implementasi Pasal 80 huruf e UU. 22 Tahun 2009 tentang Lalu Lintas dan Angkutan Jalan dalam hal Pemberian Surat Izin Mengemudi Golongan D kepada Penyandang Disabilitas. Bahwa setiap orang yang mengemudikan kendaraan bermotor wajib memiliki surat izin mengemudi. Apabila tidak memiliki SIM maka hal itu melanggar ketentuan dalam pasal 77 UU LLAJ.. Berdasarkan latar belakang tersebut, maka rumusan masalah pada penelitian ini adalah (1). Bagaimana Implementasi Pasal 80 huruf e UU. 22 Tahun 2009 tentang Lalu Lintas dan Angkutan Jalan dalam hal Pemberian Surat Izin Mengemudi Golongan D kepada Penyandang Disabilitas Fisik? (2). Apa Kendala yang dihadapi Penyandang Disabilitas Fisik untuk Memperoleh Surat Izin Mengemudi golongan D? (3). Bagaimana Solusi yang diberikan oleh Satpas Polresta Malang Terhadap Penyandang Disabilitas Fisik untuk memperoleh Surat Izin Mengemudi golongan D? Kemudian jenis penelitian ini menggunakan metode yuridis empiris dengan metode pendekatan yuridis sosiologis. Lokasi penelitian di Satuan Pelayanan SIM Polres Kota Malang. Jenis dan Sumber Data adalah data primer, data sekunder dan data tersier. Data primer diperoleh dengan melakukan wawancara langsung dengan responden. Data sekunder diperoleh dari studi kepustakaan, studi dokumentasi dan studi penelusuran. Teknik analisa data adalah deskriptif analisis. Dari hasil penelitian dapat diketahui bahwa Implementasi Pasal 80 huruf e UU. 22 Tahun 2009 tentang Lalu Lintas dan Angkutan Jalan dalam hal Pemberian Surat Izin Mengemudi Golongan D kepada Penyandang Disabilitas Fisik adalah mengikuti serangkaian prosedur seperti masyarakat umum. Adapun Kendala yang dihadapi Penyandang Disabilitas Fisik untuk Memperoleh Surat Izin Mengemudi golongan D adalah Integritas aparat penegak hukum, produk hukum dan tidak dapat terlaksananya peraturan perundang-undangan ole aparat penegak hukum. Solusi yang diberikan oleh Satpas Polresta Malang Terhadap Penyandang Disabilitas Fisik untuk memperoleh Surat Izin Mengemudi golongan D adalah Mengadakan penyuluhan dan pembinaan atau latihan untuk mengikuti serangkaian test pembuatan SIM D.
English Abstract
In this research, the author raised about the Implementation of Article 80 letter e of the Act. 22 of 2009 concerning Road Traffic and Transportation in the case of Giving Group D Driving License to Persons with Disabilities. That everyone who drives a motorized vehicle must have a driver's license. If you do not have a SIM, it violates the provisions of article 77 of the RTT Law Based on this background, the formulation of the problem in this study is (1). How to implement Article 80 letter e of the Act. 22 of 2009 concerning Road Traffic and Transportation in the case of Giving Group D Driving Permits to Persons with Disabilities? (2). What are the obstacles faced by persons with disabilities to obtain teaching permits for class D? (3). What is the solution given by the Malang Police Satpas to Persons with Disabilities to obtain a Class D Driving License? Then this type of research uses an empirical juridical method with a sociological juridical approach method. The location of the study was in the Malang City Police. Types and Sources of Data are primary data, secondary data and tertiary data. Primary data is obtained by conducting interviews directly with respondents. Secondary data was obtained from library studies, documentation studies and search studies. The data analysis technique is descriptive analysis. From the results of the study it can be seen that the implementation of Article 80 letter e of the Act. 22 of 2009 concerning Road Traffic and Transportation in the event that the provision of Driving License for Group D to Persons with Disabilities is to follow a series of procedures such as the general public. The constraints faced by Persons with Disabilities to Obtain Group Dissabilities Driving License are the integrity of law enforcement officers, legal products and cannot be implemented by law enforcement by law enforcement officials. The solution given by the Malang Police to Disabled Persons to obtain a Class D Driving License is to hold counseling and coaching or training to take part in a series making tests of Driving License for Dissabilities.
