Abstract
Dalam skripsi ini, penulis mengangkan bagaimana Implementasi kerjasama sister city yang dilakukan oleh Pemerintah Daerah khususnya Pemerintah Kota Surabaya dan Pemerintah Kota Varna. Pemilihan tema tersebut dilatar belakangi karena jumlah sister city yang dimiliki oleh Kota Surabaya sudah cukup banyak dari benua eropa, amerika dan asia. Kota Varna menjadi kota pertama dari Eropa yang telah menjalin kerjasama sister city.. Pada tahun 2010 Kedua Pemerintah Kota sudah menandatangani Memorandum of Understanding untuk membentuk kerjasama sistercity yang hak dan kewajibannya sudah tercantum dalam perjanjian tersebut, namun pada kenyataannya kerjasama tersebut tidak berjalan sesuai dengan apa yang diharapkan dan dapat dikatakan kerjasama tersebut belum efektif. Berdasarkan latar belakang tersebut, karya tulis ini mengangkan rumusan masalah yaitu Bagaimana kedudukan dan kekuatan hukum perjanjian kerjasama Sister City yang dilakukan oleh Pemerintah Kota Surabaya dengan Pemerintah Kota Varna dalam perspektif Hukum Perjanjian Internasional dan Bagaimana Implementasi kerjasama Sister City yang dilakukan oleh Pemerintah Kota Surabaya dan Pemerintah Kota Varna. Untuk menjawab permasalahan di atas, penelitian hukum empiris ini menggunakan metode pendekatan yuridis sosiologis. Sumber data diperoleh berupa data primer melalui wawancara dan observasi serta data sekunder melalui studi kepustakaan yang relevan dengan permasalahan yang diteliti. Data primer dan data sekunder yang diperoleh penulis akan dianalisis menggunakan teknik analisis menggunakan metode deskriptif kualitatif. Berdasarkan uraian pembahasan dapat disimpulkan (1) Perjanjian kerjasama Sister City antara Pemerintah Kota Surabaya dan Pemerintah Kota Varna merupakan implementasi dari Perjanjian Diplomatik antara Indonesia dan Bulgaria pada tanggal 21 Desember 1956. Perjanjian tersebut mengikat para pihak karena sudah adanya kesepakatan para pihak di Pasal satu (1) namun dilihat dari segi kekuatan hukumnya perjanjian tersebut tidak memberikan keharusan para pihak agar menjalankan kerjasama tersebut secara maksimal, sehingga dari penerapannya masih belum terlihat hingga ke Masyarakat. (2) Impelementasi dari Kerjasama tersebut masih jauh dari kata sempurna, dikarenakan hambatan struktural, substansi dan kultur hukum. Hambatan Struktural terdiri atas Tidak adanya kewenangan memaksa, minimnya dana, skala prioritas, dan perbedaan kepentingan. Hambatan Substansi, tidak adanya peraturan teknis untuk melaksanakannya perjanjian hanya bergantung pada Good Faith. Hambatan Kultur hukum, tidak semua masyarakat mengetahui Sister City, ada atau tidaknya sister city tidak memberikan pengaruh kepada mereka Upaya yang selama ini dilakukan oleh pemerintah Kota Surabaya berupa Evaluasi Internal Pemerintah Kota Surabaya, Menindaklanjuti kerjasama ke Pemerintah Kota Varna, melakukan perundingan mengenai teknis kerjasama, menunggu araha Pemerintah Pusat, serta transparasi kegiatan sistercity baik secara online maupun offline
English Abstract
in this thesis, the authors explain how Implementation of sister city cooperation conducted by the Regional Government, especially the Government of Surabaya City and the City Government of Varna. The selection of the theme in the background because the number of sister city owned by the city of Surabaya is quite a lot from the continent of europe, america and asia. The city of Varna became the first city of Europe that has established sister city cooperation .. In 2010 both the City Government has signed a Memorandum of Understanding to form a sistercity cooperation whose rights and obligations are contained in the agreement, but in reality the cooperation does not go according to what which is expected and can be said the cooperation has not been effective. Based on the background, this paper intrigues the formulation of the problem that is How the position and the legal power of Sister City cooperation agreement conducted by the Government of Surabaya City with the City Government of Varna in perspective of International Treaty Law and How Implementation of Sister City cooperation conducted by Surabaya City Government and Government City of Varna. To answer the above problem, this empiris legal research using sociological juridical approach method. Sources of data obtained in the form of primary data through interviews and observations and secondary data through library studies relevant to the problems studied. Primary data and secondary data obtained by the authors will be analyzed using analytical techniques using qualitative descriptive method. Based on the description of the discussion can be concluded (1) Sister City cooperation agreement between the Government of Surabaya and the City of Varna is the implementation of the Diplomatic Agreement between Indonesia and Bulgaria on December 21, 1956. The agreement binds the parties because of the agreement of the parties in Article one 1) but in terms of its legal power, the agreement does not oblige the parties to run the cooperation maximally, so that its implementation is still not visible to the Community. (2) Impelementation of the Cooperation is far from perfect, due to structural obstacles, substance and legal culture. Structural barriers consist of lack of coercive authority, lack of funds, priority scale, and different interests. Obstacles Substance, the absence of technical regulations to implement the agreement only depends on Good Faith. Obstacles Legal culture, not all people know Sister City, whether or not sister city does not give effect to them Efforts that have been done by the government of Surabaya in the form of Internal Evaluation of Surabaya City Government, Following the cooperation to the City Government of Varna, to negotiate on technical cooperation, waiting for the direction of the Central Government, as well as transparency of sistercity activities both online and offline
