Abstract
Dalam penyelenggaraan kehidupan berbangsa, pemerintah dituntut untuk memajukan kesejahteraan umum yang berkeadilan sosial bagi seluruh rakyat Indonesia. Untuk mewujudkan hal tersebut, pemerintah berkewajiban menyediakan kebutuhan rakyat dalam berbagai bentuk berupa barang, jasa, maupun pembangunan infrastruktur. Di sisi lain, pemerintah juga memerlukan barang dan jasa itu dalam melaksanakan kegiatan pemerintahan. Pemenuhan kebutuhan barang dan jasa merupakan bagian yang penting dalam penyelenggaraan pemerintahan. Peraturan Presiden Nomor 54 Tahun 2010 tentang Pengadaan Barang dan Jasa yang telah diubah sebanyak empat kali dan perubahan terakhir yaitu Peraturan Presiden Nomor 4 Tahun 2015 menjadi dasar pelaksanaan pengadaan barang dan jasa di Indonesia. Peraturan mengenai pengadaan barang dan jasa pemerintah ini terus mengalami penyempurnaan hingga tahun 2018 ini, diberlakukanya aturan Pengadaan Barang/Jasa Pemerintah yang baru yaitu Peraturan Presiden Nomor 16 Tahun 2018 tentang Pengadaan Barang/Jasa Pemerintah, sebagai pengganti dari Peraturan Presiden Nomor 54 Tahun 2010 beserta segala Perubahannya. Pengadaan Barang dan Jasa (PBJ) Pemerintah merupakan mekanisme belanja pemerintah yang memegang peranan penting dalam pemanfaatan anggaran negara. PBJ melibatkan jumlah uang yang sangat besar, sehingga pemerintah disebut sebagai pembeli yang terbesar (the largest buyer) di suatu negara. Anggaran PBJ setiap tahunnya menurut LKPP sekitar 40% dari APBN dan APBD, sehingga pada tahun 2018 ini anggaran PBJ adalah sebesar 1.200 Triliun dari total belanja APBN dan APBD. Sepanjang tahun 2017, Indonesia Corruption Watch (ICW) mencatat sudah ada 84 kasus terkait pengadaan barang dan jasa pemerintah, dengan ini kasus korupsi pengadaan barang dan jasa yang ditangani KPK tetap menunjukkan angka yang tertinggi (30.4% kasus yang ditangani KPK sejak tahun 2004). Dari hasil analisis diketahui terdapat permasalahan pokok pada pengadaan Barang dan Jasa Pemerintah yaitu terdapat kelemahan pengaturan hukum atau dari sisi regulasi. Kelemahan dari sisi tersebut adalah: 1)Aturan tentang pelaksanaan PBJ hanya setingkat Perpres, dimana tidak dapat mengatur sanksi, jika berbenturan dengan PBJ pada sektor lain yang diatur dalam UU sektor tersebut, maka Perpres tersebut dapat tidak berlaku karena tingkatnya lebih rendah dibandingkan UU, selain itu, Perpres juga dapat menjadi alat diskresi pihak tertentu. 2)Perpres belum dapat mendeteksi adanya afiliasi yang terjadi dalam proses pengadaan Barang dan Jasa. Adapun lembaga yang terlibat dalam pengawasan dalam pengadaan barang dan jasa adalah; Lembaga Kebijakan Pengadaan Barang/Jasa Pemerintah (LKPP), Badan Pemeriksa Keuangan (BPK), Komisi Pengawas Persaingan Usaha (KPPU), dan Komisi Pemberantasan Korupsi (KPK)
English Abstract
In organizing the life of the nation, the government is required to promote the general welfare of social justice for all Indonesian people. To achieve this, the government is obliged to provide for the people in various forms of goods, services, and infrastructure development. On the other hand, the government also needs the goods and services in carrying out government activities. Fulfilling the needs of goods and services is an important part of governance. Presidential Regulation No. 54/2010 concerning Procurement of Goods and Services has been amended four times and the last amendment is Presidential Regulation No. 4/1955 as the basis for the procurement of goods and services in Indonesia. The regulation on procurement of government goods and services continues to be refined until 2018, the enactment of the new Government Goods / Services procurement rule namely Presidential Regulation No. 16 of 2018 on Government Procurement of Goods / Services, in lieu of Presidential Regulation No. 54 of 2010 and all The changes. Procurement of Goods and Services (PBJ) The Government is a government spending mechanism that plays an important role in the utilization of state budget. The PBJ involves an enormous amount of money, so the government is called the largest buyer of a country. The annual budget of PBJ according to LKPP is about 40% of the APBN and APBD, so that by 2018 the budget of PBJ is 1,200 trillion of total APBN and APBD expenditure. Throughout the year 2017, Indonesia Corruption Watch (ICW) recorded 84 cases related to procurement of government goods and services, with corruption cases procurement of goods and services handled by KPK still shows the highest number (30.4% cases handled by KPK since 2004). From the analysis, it is known that there is a major problem in the procurement of Government Goods and Services, namely there is a weakness of legal arrangement or regulation. The disadvantages of this aspect are: 1) The rules on the execution of the PBJ are only at the level of the Presidential Regulation, which can not regulate sanctions, if they conflict with the PBJ in other sectors regulated in the sector law, the Perpres may be invalid because the rate is lower than the law, it, Perpres also can be a tool of discretion of certain parties. 2) The Presidential Regulation has not been able to detect any affiliation occurring in the procurement process of Goods and Services. The institutions involved in supervising the procurement of goods and services are; Lembaga Kebijakan Pengadaan Barang/Jasa Pemerintah (LKPP), Badan Pemeriksa Keuangan (BPK), Komisi Pengawas Persaingan Usaha (KPPU), dan Komisi Pemberantasan Korupsi (KPK)
