Abstract
Pada skripsi ini, penulis mengangkat permasalahan mengenai pedoman pemberian perizinan dalam bidang usaha mikro dan kecil terhadap Badan Pelayanan Perizinan Terpadu Kota Malang. Permasalahan yang terjadi saat ini adalah kurangnya pemahaman masyarakat akan prosedur dalam mengajukan permohonan perizinan usaha mikro dan kecil sehingga mengakibatkan kurang efektifnya pelaksanaan pasal 7 Permendag RI Nomor 83 Tahun 2014. Berdasarkan latar belakang tersebut, maka rumusan masalah pada penelitian ini adalah (1) Bagaimana efektifitas pasal 7 Peraturan Menteri Dalam Negeri nomor 83 Tahun 2014 terkait pedoman pemberian izin usaha mikro dan kecil? (2) Apa hambatan pelaku usaha mikro dan kecil dalam proses pengajuan izin usaha berdasarkan Permendagri Nomor 83 Tahun 2014 tentang pedoman pemberian izin usaha mikro dan kecil, dan bagaimana solusinya? Kemudian jenis penelitian ini menggunakan metode yuridis empiris dengan metode pendekatan penelitian yuridis sosiologis. Lokasi penelitian dalam penelitian ini di Badan Pelayanan Perizinan Terpadu Kota Malang. Jenis dan Sumber data adalah data primer dan data sekunder. Data primer diperoleh dengan melakukan langsung dengan responden. Data sekunder diperoleh dari studi kepustakaan, dokumentasi, studi penelusuran dan media elektronik (internet). Teknik analisis data adalah deskriptif analisis. Dari hasil penelitian dapat diketahui bahwa dalam penerapan pasal 7 Permendag RI Nomor 83 Tahun 2014 belum efektif. Hambatannya adalah peranan masyarakat sebagai pelaku usaha mikro dan kecil yang tidak mematuhi aturan dan budaya hukum yang sudah ada. Solusi untuk menghadapi hambatan itu adalah dengan cara terus melakukan pembinaan dalam perbaikan dan inovasi oleh Dinas Koperasi dan UMKM Kota Malang, terkait pembinaan kepada masyarakat yang akan membuka usaha baru khususnya UMK agar, dalam proses pelaksanaannya lancar dan sesuai dengan peraturan hukum yang berjalan. Selain itu, Badan Pelayanan Perizinan Terpadu Kota Malang juga terus melakukan perbaikan terhadap faktor-faktor yang menghambat4 xii dalam penerapan Pasal 7 Peraturan Menteri Dalam Negeri Nomor 83 Tahun 2014 Tentang Pedoman Pemberian Izin Usaha Mikro dan Kecil dengan memberikan kemudahan dalam hal pelayanan dan juga diperlukan sebagai alternative untuk meningkatkan kesadaran masyarakat dalam penerapan Pasal 7 Peraturan Menteri Dalam Negeri Nomor 83 Tahun 2014 Tentang Pedoman Pemberian Izin Usaha Mikro dan Kecil sehingga, menjadi masyarakat yang tertib hukum.
English Abstract
In this thesis, the authors raised the issue of licensing guidelines in the field of micro and small business to Integrated Licensing Services Office of Malang. Problems that occur at this time is the lack of public understanding of the procedure in applying for licensing of micro and small enterprises resulting in less effective implementation of article 7 of the Minister of Trade Regulation No. 83 of 2014. Based on this background, the problem formulation in this research is (1) How is the effectiveness of article 7 of Regulation of Minister of Home Affairs number 83 year 2014 related to guidance of granting of micro and small business license? (2) What are the constraints of micro and small entrepreneurs in the process of applying for a business license based on Permendagri Number 83 of 2014 on guidelines for granting micro and small business licenses, and how is the solution? Then this type of research employs empirical juridical method with sociological juridical research approach. Location of research in this research in Integrated Licensing Service Office of Malang. Types and Sources of data are primary and secondary data. Primary data was obtained by conducting directly with the respondents. Secondary data were obtained from literature study, documentation, search study and electronic media (internet). Data analysis technique is descriptive analysis. From the research results can be seen that in the implementation of Article 7 of the Minister of Trade Regulation No. 83 of 2014 has not been effective. The challenge is in the role of society as micro and small business actors who do not adhere to existing rules and legal culture. The solution to face the obstacles is by continuing to provide guidance in the improvement and innovation by the Office of Cooperatives and SMEs Malang, related to the formation of the community that will open a new business, especially the MSE, in the implementation process smoothly and in accordance with the current law. In addition, the Integrated Licensing Services Agency of Malang City also6 xiv continues to make improvements to the factors that hamper the implementation of Article 7 of the Minister of Home Affairs Regulation No. 83 of 2014 About Guidelines for Granting Micro and Small Business Licenses by providing convenience in terms of service and is also required as an alternative to raise public awareness in the application of Article 7 of Regulation of the Minister of Home Affairs Number 83 of 2014 concerning Guidelines for the Granting of Micro and Small Business Licenses so that it becomes a legal society
