Abstract

Melonjaknya produk impor di Indonesia seolah-olah menguntungan konsumen domestik karena banyak alternatif yang bisa diperoleh konsumen, namun kurang disadari bahwa tidak semua produk impor memenuhi stardar kualitas keamanan. Permasalahan dalam penelitian ini yaitu: Mengapa peraturan pengawasan impor produk pangan olahan tidak efektif, sehingga pangan olahan impor yang tidak memenuhi ketentuan dapat beredar di Indonesia; Bagaimanan konstruksi penyelesaian untuk mengatasi peredaran produk pangan olahan impor yang tidak memenuhi ketentuan guna melindungi konsumen. Hasill penelitian menunjukkan bahwa penyebab tidak efektifnya pengawasan impor pangan olahan yaitu: kebijakan impor pangan olahan masih tumpang tindih, terbatasnya staf/petugas lapangan, pola pengawasan yang tidak menyeluruh, banyaknya jalur lalu lintas barang tidak resmi di wilayah perbatasan, lemahnya peranan Badan Sandardisasi Nasional, meningkatnya kebutuhan konsumen tanpa perduli kualitas produk, rendahnya tanggung jawab produsen, lemahnya kesadaran konsumen, kurangnya dukungan pemerintah daerah, lemahnya penegakan hukum, dan kurangnya vasilitas dan biaya. Konstruksi penyelesaian mengatasi permasalahan tersebut adalah melalui perlindungan hukum preventif seperti: pengaturan impor, pengawasan impor, dan pembinaan (pelaku usaha, konsumen, dan pengawas lapangan). Perlindungan hukum represif meliputi: penerapan Sanksi Administratif berupa teguran tertulis, pembatalan surat pendaftaran, penghentian kegiatan, re-ekspor produk impor ke negara asal, penarikan dan pemusnahan produk, penghentian kegiatan impor; Penerapan Sanksi Perdata (ganti kerugian); dan penerapan Sanksi Pidana. Dengan diterapkan prinsip tanggung produk dalam UUPK yang mengacu pada prinsip tanggung jawab mutlak, di harapkan konsumen akan lebih memahami hak-haknya, termasuk hak memperoleh ganti kerugian.

English Abstract

Increasing of imports product as if would be favorable the domestic consumers because many alternative products that can be obtained by the consumer, but less recognized that not all the imported products have met quality stardar of safety and health. The legal issues in the research namely: Why the supervision on importation of processed food products are not effective, so the processed food imports that do not comply can be distributed in Indonesia; How the solution construction to overcome the circulation of imported processed food products that do not comply for protection the consumers. The results showed that the factors causing circulation of imported processed food products that do not meet the requirements, namely: the policy of imported processed food products is still overlap; the limited staff/field officers; pattern of supervision are not thorough; there are many traffic lanes of unofficial goods in the border region, weak role of the National Certification Body (BSN); the increasing needs of consumers; regardless of the quality of product; low roducer responsibility; weak legal awareness of consumers; weak law enforcement; and lack of vacilities and budgets. The solution construction to overcome the circulation of imported processed food product is still not effective, it is because there is no coordination and good cooperation among government institutions involved; weak law enforcement against the importer and distri-butor of illegal processed food products, and weak legal awareness to report the release of a product that is not in accordance with the provisions or illegal to authorized institutions. Legal protection of consumers who are disadvantaged, including administrative action, returns the product to its home country, destruction of products which do not comply (illegal), and adjudication action (court proceedings). The efforts to consumers to submit a lawsuit against enterpreneurs is still relative small. This is due to lack of knowledge of consumers to receive advocacy. With applied product liability principle in Consumen Protection Acts (UUPK) which refers to the principle of strict liability, in the hope that consumers will understand their rights, including the right to apply for the compensation.
