Abstract
a mengupas perihal yang menjadi dasar pertimbangan hukum bagi hakim, yang menyebabkan terjadinya disparitas pemidanaan dalam putusan tindak pidana illegal loging, khususnya yang terjadi di Pengadilan Negeri Palangkaraya, Kalimantan Tengah, serta mencoba merumuskan solusi untuk mengatasi disparitas pemidanaan yang berpotensi menimbulkan ketidakpastian hukum tersebut.
English Abstract
The disparity in sentencing for a criminal case has the same type and weight, can not be avoided. Therefore, in addition to the Civil Law system, adopted in the Indonesian legal system does not recognize the principle of precedent, also due to the lack of guidelines for sentencing which could be a reference for judges to convict. Only there are provisions in the Criminal Code that is a minimum imprisonment of one day and a maximum of 15 years imprisonment and life imprisonment for 20 years. Similarly, in the Forestry Act is leq specialis, only set maximum terms of imprisonment, including the crime of illegal logging. This paper attempts to explore the subject on which the legal reasoning of judges, which led to the decision of disparity in crime of illegal logging, particularly in the District Court of Palangkaraya, Central Kalimantan, as well as trying to formulate a solution to overcome the disparity, which could potentially lead to legal uncertainty.
