Abstract
Salah satu urusan Pemerintah Kabupaten Malinau adalah dari segi perizinan. Sehingga untuk membantu dan mempermudah masyarakat, Pemerintah Kabupaten Malinau menerbitkan Peraturan Bupati Malinau Nomor 14 Tahun 2011 Tentang Pendelegasian Sebagian Wewenang Bupati Kepada Camat. Namun, dalam pelaksanaannya tidak sesuai berjalan secara efektif. Ketidakefektifnya penerbitan Izin Mendirikan Bangunan (IMB) itu berkenaan dengan kurangnya kesadaran masyarakat dalam mengurus Izin Mendirikan Bangunan (IMB) dan aparatur Pemerintah Kecamatan Malinau Barat juga belum memahami dengan sepenuhnya mengenai pelaksanaan penerbitan Izin Mendirikan Bangunan (IMB) oleh Camat setelah diberlakukannya Peraturan Bupati Malinau Nomor 14 Tahun 2011. Oleh karena itu perlu dikaji mengenai efektivitas penerbitan Izin Mendirikan Bangunan (IMB) dan faktor atau unsure dominan yang paling berpengaruh terhadap tingkat efektivitas penerbitan Izin Mendirikan Bangunan (IMB) yang dilakukan oleh Camat setelah diberlakukannya Peraturan Bupati Malinau Nomor 14 Tahun 2011. Hasil dari penelitian ini bahwa efektivitas penerbitan Izin Mendirikan Bangunan (IMB) oleh Camat Malinau Barat berdasarkan Peraturan Bupati Malinau Nomor 14 Tahun 2011 belum berjalan secara efektif karena dari factor struktur; Kantor Pelayanan Terpadu (KPT) dan Pemerintah Kecamatan Malinau Barat hanya melakukan sosialisasi, Pemerintah Kecamatan Malinau Barat juga belum memahami dengan benar isi dari Peraturan Bupati Malinau Nomor 14 Tahun 2011, serta tidak ada penentuan waktu yang tepat dalam menerbitkan Izin Mendirikan Bangunan (IMB). Substansi; Peraturan Bupati Malinau Nomor 14 Tahun 2011 belum jelas karena tidak mencantumkan mengenai ukuran yang tepat dan terperinci Izin Mendirikan Bangunan (IMB) skala kecil. Kultur; Sikap masyarakat yang tidak mau mematuhi Peraturan Bupati Malinau Nomor 14 Tahun 2011. Faktor atau unsur dominan yang paling berpengaruh terhadap tingkat efektivitas penerbitan Izin Mendirikan Bangunan (IMB) oleh Camat Malinau Barat setelah diberlakukannya Peraturan Bupati Malinau Nomor 14 Tahun 2011 yaitu Faktor Hukum; Adanya ketidakjelasan mengenai ukuran Izin Mendirikan Bangunan (IMB) skala kecil. Faktor Penegak Hukum; Dinas Tata Kota Kabupaten Malinau dan Satuan Polisi Pamong Praja tidak pernah dilibatkan dalam pengawasan dan penertiban. Faktor Sarana atau Fasilitas; Sarana transportasi bagi Pemerintah Kecamatan Malinau Barat belum memadai. Faktor Masyarakat; Adanya masyarakat yang tidak mengetahui bahkan dengan segaja tidak mengindahkan Peraturan Bupati Malinau Nomor 14 Tahun 2011. Faktor Kebudayaan; Adanya kebiasaan masyarakat yang membangun rumah tanpa adanya Izin Mendirikan Bangunan (IMB) dan menganggap bahwa Izin Mendirikan Bangunan (IMB) bukan sesuatu yang dianggap penting.
English Abstract
One of the Malinau District Government affairs is in terms of licensing. So as to assist and facilitate the public, Malinau District Government issued Regulation of Regent Malinau Number 14 of 2011 About Delegation of Authority Some Regent To Subdistrict Head. However, in practice does not conform run effectively. Ineffective publishing Building Permit (BP) was concerned with the lack of public awareness in the care of the building permit (BP) and West Malinau District Government officials also do not understand fully about the implementation of the issuance of building ermit (BP) by subdistrict head after the enactment of the decree Malinau Number 14 of 2011. Therefore, it is necessary to study on the effectiveness of the publication of Building Permit (BP) and the dominant factors or elements that most influence on the level of effectiveness of the issuance of building permit (BP) conducted by the district head after the enactment of the decree Number 14 of 2011 Malinau. Results from this study that the effectiveness of the publication Building Permit (BP) by subdistrict head of West Malinau Malinau Regent Regulation Number 14 of 2011 is not effective because of the factor structure; Integrated Services Office (OPT) and West Malinau District Government just to socialize, West Malinau District Government has not properly understood the contents of the decree Number 14 of 2011 Malinau, and no determination of the appropriate time to issue a building permit (BP). Substance; Malinau Regent Regulation Number 14 of 2011 is unclear because no list of the right size and detailed building permit (IMB) small scale. Culture; The attitude of people who are not willing to comply with the decree Number 14 of 2011 Malinau. The dominant factors or elements that most influence on the level of effectiveness of the publication Building Permit (IMB) by Malinau District Head West after the enactment of the decree Number 14 of 2011 Malinau ie Legal Factors; Lack of clarity regarding the size of the building permit (BP) small scale. Factors Law Enforcement; Department of City Planning Malinau District and Municipal Police Units were never involved in the supervision and control. Factors Facility ; Means of transport for the West Malinau District Government has not been adequate. Factors Society; The existence of people who do not know even by intentionally ignoring the decree Number 14 of 2011. Malinau Cultural Factors; The existence of habits of the people who build a house without a building permit (IMB) and assume that the building permit (IMB) is not something that is considered important.
