Abstract
Latar belakang penulisan ini, karena berdasarkan ketentuan Undang-undang Nomor 1Ttahun 1974 Pasal 2 ayat (2) dan Pasal 5 Kompilasi Hukum Islam terdapat pertentangan dengan hukum islam yang menyatakan Tiap-tiap perkawinan dicatat menurut peraturan perundang-undangan yang berlaku, agar terjamin ketertiban perkawinan bagi masyarakat Islam setiap perkawinan harus dicatat oleh Pegawai Pencatat Nikah. Hal ini berdampak pada anak yang dilahirkan dari pernikahan siri, hal ini merugikan anak yang seharusnya sah menurut hukum islam karena rukum perkawinan sudah dipenuhi. Berdasarkan hasil penelitian, penulis memperoleh jawaban atas permasalahan yang ada, berdasarkan teori fautes personalles yaitu teori yang menyatakan bahwa perlindungan hukum preventif dan represif, yang dikemukakan oleh Philipus M.Hadjon, dari segi preventif tindakan penelantaran anak dapat dikenakan sanksi pidana sesuai dengan Undang-undang Pasal 77 Undang-undang No 23 Tahun 2002 tentang Perlindungan Anak, dan sebagai tindakan preventif sebaiknya agar terdapat hubungan integrasi dengan perdatanya ditambahkan klausl memungkinkan untuk digugat secara perdata. Sebagai tindakan represifnya Kantor catatan sipil harus membuat akta kelahiran anak sebagai anak sah yang seolah-olah memang benar anak yang dilahirkan berdasarkan perkawinan siri ini dilahirkan dari perkawinan sah oleh kedua orang tuanya. Mengatur kembali mengenai peraturan-peraturan terkait perlindungan Anak, dengan mempertimbangkan sepanjang anak yang dilahirkan dalam perkawinan sah sesuai dengan rukun islam dapat dibuktikan dengan perjanjian kawin bermaterai, maka anak tersebut harus dianggap sebagai anak sah dan Kantor catatan sipil harus membuat akta kelahiran anak sebagai anak sah yang seolah-olah dilahirkan dari perkawinan sah.
English Abstract
In writing this paper the author discusses how legal protection for children outside of marriage is not recognized and are not endorsed evaluated from the perspective of Islamic law. It is the background of this paper, because it is based on the provisions of Law No. 1 of 1974 and article 2, paragraph 2 of Article 5 of Islamic Law Compilation of a conflict with Islamic law stating Each marriage is recorded in accordance with the legislation in force, to guarantee order marriage for Muslims every marriage must be recorded by the Registrar of Marriage employees. This has an impact on the children born of the marriage siri, it is detrimental to the child who was supposed legal under Islamic law because marriage rukum been met. Based on the results of the study, the authors obtained answers to the problems, based on the theory fautes personalles the theory that preventive and repressive legal protection, put forward by Philip M.Hadjon, in terms of child neglect preventive actions can be sanctioned in accordance with the Law Article 77 of Law No. 23 of 2002 on Child Protection, and as a precautionary measure should be that there is a relationship with the civil integration allows for added klausl sued civilly. As the repressive actions of civil registration office must make childs birth certificate as the legal child as if it is true that children born by siri marriage is born of legitimate marriage by her parents. Set back on regulations regarding the protection of children, taking into account all the children born in valid marriage according to the pillars of Islam can be proved by the agreement sealed mating, then the child should be considered a legitimate child and civil records office should make a childs birth certificate as the childs legal that seems born of legitimate marriage.
