Abstract
Tindak pidana pencemaran nama baik oleh pers seringkali terjadi. Mereka yang merasa nama baiknya dicemarkan lantaran pemberitaan pers cenderung melakukan upaya hukum untuk menyelesaikannya. Namun sayangnya upaya hukum yang dilakukan adalah hukum pidana atau perdata. Padahal kedua jenis upaya hukum ini berdampak buruk terhadap Kemerdekaan Pers yang sudah menjadi Hak Asasi Manusia (HAM). Di Indonesia, kemerdekaan pers sudah dianggap penting. Sejumlah pendiri negeri ini meyakini, bahwa kemerdekaan pers bukan hanya sebagai cerminan Negara Demokrasi saja, tapi sesungguhnya adalah nafas daripada kehidupan Negara demokrasi. Hal itu diatur dalam Pasal 28 huruf F UUD 1945. Namun sayangnya kemerdekaan pers itu kerap kali berhadapan dengan sejumlah pasal-pasal pidana di KUHP dan beberapa peraturan perundang-undangan lainnya. Masih sangat memungkinkan kemerdekaan pers dipinggirkan. Padahal untuk mengatur tentang pers sudah ada UU no. 40 tahun 1999 tentang Pers. Dalam pasal 15 ayat (1) menyebutkan, bahwa dalam upaya mengembangkan kemerdekaan pers dan meningkatkan kehidupan pers nasional dibentuk Dewan Pers yang independen. Lebih jauh dalam dalam ayat (2) huruf (d) UU Pers menyebutkan, fungsi Dewan Pers salah satunya adalah memberikan pertimbangan dan mengupayakan penyelesaian pengaduan masyarakat atas kasus-kasus yang berhubungan dengan pemberitaan pers. Meskipun ada UU Pers yang menyebutkan demikian, tetapi ada saja masyarakat yang memilih jalur hukum pidana dan perdata dalam menyelesaikan pengaduan atas kasus-kasus yang berhubungan dengan pemberitaan pers. Jalur ini sebetulnya bukan tidak boleh ditempuh, akan tetapi jalur melalui UU Pers yang diharapkan, yakni melalui Dewan Pers. Ternyata dalam penelitian tesis ini, penulis menjumpai tidak sedikit tindak pidana pencemaran nama baik oleh pers dapat diselesaikan oleh Dewan Pers. Padahal, jika ditelesik terkait unsur-unsur yang dilakukan oleh pers dalam pemberitaan itu sudah termasuk dalam tindak pidana yang diatur dalam pasal 310 KUHP. Namun demikian, ada juga kasus-kasus yang ditangani Dewan Pers masih harus berlanjut hingga ke jalur perdata atau pidana. Akan tetapi sebelum kasus-kasus dimaksud masuk ke wilayah hukum lainnya, Dewan Pers akan memberikan Pernyataan Penilaian dan Rekomendasi (PPR). Bahkan, Dewan Pers juga menyiapkan kesaksian ahli pers di persidangan. Ini seiring juga dengan adanya MoU antara Dewan Pers dan Kapolri, 9 Februari 2012. Melihat fungsi Dewan Pers dalam hal ini, maka lembaga atau komisoner dimaksud harus terus mendapat dukungan dalam menjalankan tugas-tugasnya. Sebab ternyata penyelesaian hukum tidak hanya melalui pengadilan. Dewan Pers menyelesaikan sengketa pencemaran nama baik dengan para meter Kode Etik Jurnalistik (KEJ).
English Abstract
Criminal offense of defamation by the press often occur. Those who feel defamed his good name because of press coverage tended to perform legal efforts to solve them. But unfortunately it does is legal civil or criminal law. While both types of remedies is an adverse impact on Press Freedom which is into Human Rights (Human Rights). In Indonesia, the freedom of the press is considered important. A number of the founders of this country believe, that the freedom of the press not only as a reflection of the State Democracy, but in fact is the breath of life than the democratic state. It was stipulated in Article 28 of the F of the 1945 Constitution. But unfortunately the freedom of the press were often faced with a number of criminal provisions in the Penal Code and several other laws and regulations. Allow freedom of the press is still very marginalized. Though to regulate the existing press law no. 40 of 1999 on the Press. In Article 15 paragraph (1) states that, in effort to promote freedom of the press and improving the lives of the national press formed an independent Press Council. Further, in paragraph (2) subparagraph (d) of the Press Law states, one of which functions of the Press Council is giving consideration to community complaints and seek resolution of cases dealing with the press. Although there is mention of the Press Law that way, but there are people who choose the legal route to resolve criminal and civil complaints over cases related to press coverage. This pathway was not really should not be pursued, but the paths through the Press Law which is expected, through the Press Council. Apparently in this thesis research, the authors find no small criminal defamation by the press can be completed by the Press Council. Whereas, if to observed related elements are carried by the press in the news is already included in the offense provided for in Article 310 of the Criminal Code. However, there are also cases handled by the Press Council must continue until all civil or criminal path. However, before the cases referred into other jurisdictions, the Press Council will provide a Statement of Assessment and Recommendation (PPR). In fact, the Press Council is also preparing a press expert testimony in court. This is also in line with the MoU between the Press Council and the Police Chief, February 9, 2012. See the function of the Press Council in this regard, the agency or commissioner question must continue to receive support in carrying out his duties. Because it turns out not only the legal settlement through the courts. The Press Council resolve defamation disputes with the meter of the Code of Journalism (KEJ).
