Abstract
Telekomunikasi adalah setiap pancaran, pengiriman dan atau penerimaan dari setiap informasi dalam bentuk tanda-tanda, isyarat, tulisan, gambar, suara dan bunyi melalui system kawat, optik, radio atau sistem elektromagnetik lainnya. Salah satu media dari telekomunikasi adalah dengan menggunakan spektrum frekuensi radio. Spektrum frekuensi radio adalah sumber daya alam yang terbatas yang diatur oleh negara. Penggunaan spektrum frekuensi radio telah diatur dalam Undang-Undang nomor 36 tahun 1999 tentang Telekomunikasi. Dalam penggunaan spektrum frekuensi radio, setiap pengguna dikenakan biaya sebagai kompensasi penggunaan spektrum frekuensi radio atau disebut Biaya Hak Penggunaan (BHP) spektrum frekuensi radio seperti yang tercantum pada Pasal 26 ayat (1) dalam Undang-Undang Telekomunikasi. Dalam penggunaan spektrum frekuensi radio terdapat lembaga atau institusi yang berfungsi debagai pengawas dan pengendalian spektrum frekuensi radio yaitu Balai Monitor Frekuensi Radio Samarinda yang berada di bawah Kementerian Komunikasi dan Informatika. Keberadaan Balai Monitor Frekuensi Radio Samarinda berada di tiap-tiap provinsi diseluruh Indonesia. Dalam pelaksanaan tugas dan tanggungjawabnya, Balai Monitor Frekuensi Radio Samarinda tidak memiliki kewenangan terhadap para pengguna spektrum frekuensi radio yang melakukan penunggakan pembayaran Biaya Hak Penggunaan (BHP) spektrum frekuensi radio. Balai Monitor Frekuensi Radio Samarinda tidak dapat melakukan penagihan terhadap penunggak Biaya Hak Penggunaan (BHP) karena tidak terdapat payung hukum yang melakukan tindakan tersebut. Dalam asas umum pemerintahan yang baik dan dalam rangka menjunjung reformasi birokrasi, seharusnya Balai Monitor Frekuensi Radio Samarinda selaku Unit Pelaksana Teknis di daerah seharusnya diberikan kewenangan terhadap para penunggak Biaya Hak Penggunaan (BHP) spektrum frekuensi radio untuk dapat dilakukan upaya hukum. Diperlukan suatu konsep hukum yang jelas dalam melakukan penagihan terhadap penunggak Biaya Hak Penggunaan (BHP) spektrum frekuensi radio yaitu dengan memberikan peraturan yang jelas terhadap Balai Monitor Frekuensi Radio Samarinda atau merubah struktur organisasi Balai Monitor Frekuensi Radio Samarinda untuk diperluas sehingga ada bagian tersendiri terhadap penunggak Biaya Hak Penggunaan (BHP) spektrum frekuensi radio agar tidak terjadi kerugian negara yang lebih besar.
English Abstract
Telecommunication is any emission, delivery and acceptance of any information or in the form of signs, signals, writing, images, sounds and sounds through a system of wire, radio, optical or other electromagnetic system.One of the media of telecommunications is to use the radio frequency spectrum. In the use of the radio frequency spectrum is the institution or institutions which serve a supervisory and control as the spectrum of radio frequencies, namely Radio frequency Monitor Samarinda Hall which is under the Ministry of communications and Informatics. The existence of Radio frequency Monitor Samarinda Hall in each province throughout Indonesia. In the execution of tasks and the responsibility, to Monitor the Radio frequencies of SamarindaHall does not have the authority to those users of the radio frequency spectrum that does delayed Cost payments usage rights (BHP) radio frequency spectrum. Radio frequency Monitor Samarinda Hall cant do against delayed the cost of billing usage rights (BHP) because there was no umbrella law is doing the action. In the General principles of good administration and in order to uphold the reform of the bureaucracy, should Monitor the Radio frequencies of Samarinda Hall as the implementing Technical Unit in the area should be granted authority to the delayed the cost of usage rights (BHP) to radio frequency spectrum can be made legal efforts. Required a law of concept that clearly in do debt from the companies to cost the right use (BHP) a spectrum frequency radio is by giving rules that clear against Radio frequency Monitor Samarinda Hall or change the organizational structure Radio frequency Monitor Samarinda Hall to enlarged so that there is a part of its own against companies to cost the right use ( BHP ) a spectrum frequency radio to avoid nations loss bigger.
