Abstract
Kata Kunci : Eksistensi lembaga adat Rimbo Ulu dalam menyelesaikan konflik di Kecamatan Rimbo Ulu Kabupaten Tebo Jambi serta peran Polri dalam penerapan hukum adat yang dilaksanakan oleh lembaga adat dalam menyelesaikan konflik di Kecamatan Rimbo Ulu Kabupaten Tebo Jambi. Dalam hal ini Metode Penelitian yang digunakan penulis adalah penelitian hukum “Yuridis Empiris”, melakukan penelitian di Lembaga Adat Rimbo Ulu Kabupaten Tebo Provinsi Jambi. Berdasarkan Hasil Penelitian mengenai eksistensi lembaga adat Rimbo Ulu dalam menyelesaikan konflik di Kecamatan Rimbo Ulu Kabupaten Tebo Jambi, bahwa upaya penanganan terhadap konflik yang melibatkan warga Desa Sungai Pandan, Lubuk Landai, Tanah Priuk maupun Desa Suka Maju, salah satunya dilakukan melalui hokum adat. Disinilah peran lembaga adat Rimbo Ulu sebagai organisasi sosial kemasyarakatan yang terdapat di Kecamatan Rimbo Ulu, Kabupaten Tebo Jambi. Keberadaan lembaga adat ini sangatlah penting, mengingat masyarakat di daerah tersebut hingga saat ini masih menjunjung tinggi adat istiadat dan kebiasaan-kebiasaan yang diturunkan oleh leluhur mereka dalam kehidupan sehari-hari. Disini para tokoh-tokoh adat menjadi mediator dan negosiator, dalam memberikan keputusan berupa sanksi adat kepada pelaku yang dianggap melanggar norma-norma adat. Sanksi yang dikenakan dapat berupa denda adat (berhubungan dengan materi), yang berfungsi sebagai ganti rugi terhadap korban atau dari akibat yang ditimbulkan atas perbuatan yang telah dilakukan oleh pelaku. Adapun besarnya jumlah ganti kerugian sangat tergantung dari perkara adat yang dilanggarnya atau kerugian yang timbul dari hasil perbuatan pelaku tersebut. Kuatnya pengaruh lembaga adat tersebut dalam kehidupan masyarakat Rimbo Ulu, sudah sepatutnya menjadi bahan pertimbangan bagi Polsek Rimbo Ulu untuk melakukan tindakan diskresi, agar tercipta situasi kondusif yang diharapkan oleh semua masyarakat, yang tujuannya adalah mengembalikan nilai-nilai atau norma-norma yang melekat di masyarakat adat. Peran Polri dalam penerapan hukum adat yang dilaksanakan oleh lembaga adat dalam menyelesaikan konflik di Kecamatan Rimbo Ulu Kabupaten Tebo Jambi, bahwa Peran Polri dalam penerapan hukum adat yang dilaksanakan oleh lembaga adat dalam menyelesaikan konflik di Kecamatan Rimbo Ulu Kabupaten Tebo Jambi tersebut yang terjadi pada tanggal 30 September 2008, adalah termasuk dalam upaya preventif . Upaya tersebut bertujuan untuk mencegah dan mengantisipasi konflik sosial terjadi semakin meluas, sehingga dapat menimbulkan korban jiwa lebih banyak lagi (baik luka-luka maupun meninggal dunia) serta kerugian materi lainnya seperti banyaknya rumah yang dirusak dan dibakar massa, serta isinya dijarah. Adapun peran yang dilakukan Polsek Rimbo Ulu dalam menyelesaikan konflik antara warga suku Jawa dengan suku Jambi, melalui penerapan hukum adat adalah sebagai berikut : Mendorong Penyelesaian Konflik Melalui Peran Lembaga Adat; Memfasilitasi Pelaksanaan Sidang Adat; dan Mengawasi Pelaksanaan Sidang Adat. Oleh karena itu, dapat disimpulkan bahwa penyelesaian konflik sosial antar desa di wilayah hukum Polsek Rimbo Ulu diselesaikan dengan hukum adat. Peran Kapolsek dalam mengambil keputusan untuk menyerahkan penyelesaian konflik sosial kepada lembaga adat merupakan bentuk diskresi kepolisian dengan memperhatikan berbagai pertimbangan terkait dasar hukum yang jelas serta dibutuhkan juga hati nurani yang jernih.
English Abstract

In this case study method used by the author is the study of law "Empirical Juridical", doing research at the Institute of Indigenous Rimbo Ulu Tebo Jambi Province. Based on the research results concerning the existence of traditional institutions Rimbo Ulu in resolving conflicts in the District of Ulu Tebo Rimbo Jambi, that efforts to address the conflict that involves the villagers of Sungai Pandan, Lubuk Ramps, anchoring and Village Land Suka Maju, one of which is done through customary law. This is where the role of traditional institutions Rimbo Ulu as a social organization that are in District Rimbo Ulu, Tebo Jambi. The existence of traditional institutions is very important, considering the people in the area are still uphold the customs and habits passed down by their ancestors in daily life. Here the traditional leaders as a mediator and negotiator, to give a decision in the form of traditional sanctions to offenders in violation of customary norms. Sanctions can be imposed customary fine (related material), which serves as a compensation to the victim or of the consequences for the actions that have been performed by the actors. The magnitude of the amount of compensation depends on the violation of indigenous cases or loss arising from the actions of the perpetrator. The strong influence of the traditional institutions in public life Rimbo Ulu, has been duly taken into consideration for the police to take action Rimbo Ulu discretion, in order to create a conducive situation expected by all the people, whose goal is to restore the values and norms inherent in society customary Police role in the application of customary law carried out by traditional institutions in resolving conflicts in Sub Rimbo Ulu Tebo Jambi, that the role of the police in the application of customary law carried out by traditional institutions in resolving conflicts in the District of Ulu Rimbo Jambi Tebo, which occurred on the 30 th September 2008, is included in the preventive efforts. It can be concluded that the settlement of social conflicts between villages in the jurisdiction of the Police Rimbo Ulu solved by customary law. The role of the police chief in the decision to submit the completion of the traditional institutions of social conflict is a form of police discretion with regard to various considerations related to a clear legal basis and also needed a clear conscience.
