Abstract
Tulisan ini bertujuan untuk: (1) Mengetahui kepemilikan, pengelolaan, distribusi dan pemanfaatan sumber daya air di Indonesia; (2) Mengetahui kepemilikan, pengelolaan, distribusi dan pemanfaatan sumber daya air di Indonesia menurut perspektif Islam. Tulisan ini menggunakan metode studi literatur atau kajian pustaka dengan pendekatan paradigma intepretivisme. Pendekatan paradigma interpretivisme dengan cara studi literatur yang bersifat historis bertujuan untuk menjelaskan fenomena mengenai kepemilikan, pengelolaan, distribusi dan pemanfaatan sumber daya air yang ada di Indonesia ditinjau dari perspektif Islam. Temuan dalam tulisan ini, (1) Konsep kepemilikan sumber daya air di Indonesia, bahwa sumber daya air merupakan milik Tuhan Yang Maha Esa dan manusia mendapatkan hak guna pakai dan hak guna usaha. (2) Konsep pengelolaan sumber daya air di Indonesia, Pemerintah Indonesia memberikan wewenang pada Perum Jasa Tirta untuk melaksanakan pengelolaan sumber daya air untuk memenuhi kebutuhan sumber daya air bagi rumah tangga, pertanian, industri, serta rekreasi. (3) Distribusi air bersih dan irigasi di Indonesia terjadi secara temporal ruang dan waktu. Pemerintah Indonesia juga memberikan wewenang pada PDAM untuk melakukan distribusi air bersih pada masyarakat. Di beberapa kota besar di Indonesia, distribusi sumber daya air telah diserahkan pada pihak swasta. (4) Konsep pemanfaatan sumber daya air di Indonesia berdasarkan skala prioritas yaitu, pemenuhan kebutuhan air minum, irigasi pertanian dan hewan ternak, industri, rekreasi, serta lingkungan dan ekologi. (5) Konsep kepemilikan sumber daya air di Indonesia memiliki kesamaan konsep dengan konsep kepemilikan sumber daya air dalam syariat Islam. (6) Pengelolaan sumber daya air di Indonesia belum mencapai maslahat, keadilan, dan kesejahteraan bagi seluruh rakyat Indonesia. (7) Distribusi sumber daya air di Indonesia tidak sesuai dengan prinsip musyawarah dan prinsip keadilan. (8) Pemanfaatan sumber daya air yang bersifat komersial di Indonesia tidak memiliki kerangka hukum yang jelas.
English Abstract
This paper aims to: (1) Knowing the ownership, management, distribution and utilization of water resources in Indonesia, (2) Knowing the ownership, management, distribution and utilization of water resources in Indonesia according to the Islamic perspective. This paper uses methods of literature studies or literature review with intepretivisme paradigm approach. Interpretivisme paradigm approach in a way that a historical study of literature aims to explain the phenomenon of ownership, management, distribution and utilization of water resources in Indonesia viewed from an Islamic perspective. The findings in this paper, (1) The concept of ownership of water resources in Indonesia, that water resources belong to God Almighty and the people get the right to life and right to cultivate. (2) The concept of water resources management in Indonesia, the Indonesian Government to authorize the Perum Jasa Tirta to carry out the management of water resources to meet the needs of water resources for domestic, agricultural, industrial, and recreation. (3) The distribution of clean water and irrigation in Indonesia occurred in temporal space and time. The Indonesian government also authorized the taps for clean water distribution in the community. In some big cities in Indonesia, the distribution of water resources has been handed over to private. (4) The concept of utilization of water resources in Indonesia based on the priority scale, meeting the needs of drinking water, agricultural irrigation and livestock, industry, recreation, and environment and ecology. (5) The concept of ownership of water resources in Indonesia have the same concept with the concept of ownership of water resources in Islamic Law. (6) Water resources management in Indonesia has not reached the beneficiaries, justice and prosperity for all Indonesian people. (7) The distribution of water resources in Indonesia are not in accordance with the principle of justice. (8) Utilization of water resources that are commercial in Indonesia do not have a clear legal framework.
