Abstract

Keberadaan demokrasi lokal merupakan bentuk entitas sekaligus simbol daerah, tentu secara konstitusional, posisi demokrasi lokal yang terdapat di daerah tidak dapat ditangguhkan dan tidak berlaku surut. Dan dalam hal ini menjadi tantangan untuk meningkatkan kualitas demokrasi lokal melalui pemimpin daerah yang terpilih berdasarkan kondisi pemilihan calon tunggal. Dimana tujuan mendasar dari pemilihan kepala daerah itu sendiri adalah untuk membentuk platform perkembangan bagi demokrasi lokal. Namun proses demokratisasi kedaulatan rakyat tersebut mengalami gangguan dikarenakan terdapat kondisi yang bertentangan dengan norma hukum yang telah diatur didalam Undang-Undang. Sehingga menimbulkan permasalahan berupa kondisi pelaksanaan pemilihan kepala daerah hanya dengan hanya pasangan calon tunggal. Melalui Putusan MK No. 100/PUU-XIII/2015, Mahkamah Konstitusi mengizinkan bagi setiap daerah yang hanya terdapat satu pasangan calon untuk tetap melaksanakan pemilihan kepala daerah. Konsep demokrasi pemilihan calon tunggal secara nyata berpotensi menyebabkan kemunduran demokrasi. Mengingat konsepsi pasangan calon tunggal secara politik merupakan jalan pintas terhadap proses pemilihan demokratis. Secara hukum dengan kondisi pengaturan seperti saat ini, praktis memiliki potensi permasalahan hukum dalam proses implementasinya. Apabila kondisi demikiann terjadi maka hal ini dapat menghambat perkembangan demokrasi di tingkat lokal. Oleh karena itu, Pertentangan diantara norma secara langsung menciptakan sebuah bentuk dampak berupa implikasi pasangan calon tunggal terhadap perkembangan demokrasi lokal.

English Abstract

The existence of local democracy is a form of entities and a symbol of the region, of the constitutional position of local democracy of the region can not be suspended and is not retroactive. And in this case becomes a challenge to improve the quality of local democracy through local leaders who are elected by single candidate selection condition. Where the fundamental purpose of the local election itself is to establish a platform for the development of local democracy. But the democratization process of the people's sovereignty impaired because there are conditions that are contrary to legal norms that have been regulated under the Act. Which cause many problems such as the condition of the implementation of the local elections only with just a single candidate pair. Through the Constitutional Court No. 100 / PUU-XIII / 2015, the Constitutional Court allowed for each region there is only one pair of candidates to continue to implement the local elections. The concept of the democratic election of a single candidate is the real potential to cause deterioration of democracy. Given the conception of a single political candidate pair is a shortcut to the process of democratic elections. By law by setting conditions such as current, practical potential legal issues in the implementation process. If demikiann condition occurs then this can hamper the development of democracy at the local level. Therefore, the contradiction between the norms of directly creating a form of impact in the form of a single candidate pair implications on the development of local democracy.
