Abstract
Saat ini negara Indonesia mengenal dan menganut sistem konstitutif dalam hal pendaftaran. Perubahan dari sistem deklaratif ke sistem konstitutif (first to file) karena sistem konstitutif lebih menjamin adanya kepastian hukum daripada sistem deklaratif. Sistem deklaratif dianggap kurang menjamin kepastian hukum juga menimbulkan persoalan dan hambatan dalam dunia usaha. Masih terdapat banyak celah yang dapat dilakukan untuk melakukan pelanggaran merek. Kurangnya perlindungan hukum terhadap pelanggaran merek terutama terhadap merek terkenal well-known marks sangat diperlukan. Apalagi terdapat sistem first to file dimana pendaftar pertama yang mendapat hak dari merek yang didaftarkan dan tanpa adanya pengaturan yang jelas mengenai merek terkenal ini sulit untuk menentukan merek yang telah didaftar apakah termasuk dalam kategori merek terkenal (well-known marks) atau tidak. Sehingga hal ini dapat menjadi alasan orang lain yang melakukan pendaftaran dengan itikad tidak baik yaitu ingin membonceng merek terkenal agar mendapat reputasi bagus terhadap merek yang didaftarkannya
English Abstract
m declarative to constitutive system (first to file) is triggered by the fact that the latter system guarantees the existence of legal certainty in comparison to the former. The lack of consideration of legal certainty in declarative system also impedes enterprises, while in reality chances where marks can be infringed are widely available. Based on this emerging issue, the legal protection is highly required regarding the case in well-known marks. As the name suggests, first to file prioritises the first person that registers marks of their items but without any clear regulation regarding the well-known marks, resulting in difficulty to determine whether the registered items are included in items of well-known marks. This is mostly seen as a chance for some irresponsible people to have their items registered under the famous marks
