Abstract
Skripsi ini dilatarbelakangi tingginya konsumsi akan Monosodium Glutamate (MSG) di Amerika Serikat. Impor MSG Amerika Serikat dari Indonesia yang sangat tinggi mengancam industri MSG dalam negeri AS, sehingga membuat industri dalam negeri AS mengajukan petisi dumping kepada Indonesia. Penelitian ini bertujuan untuk menganalisa kesesuaian indikator penentuan dumping The Tariff Act of 1930 US terhadap produk eksport Monosodium Glutamate Indonesia dengan ketentuan Article VI General Agreement on Tariffs and Trade 1994/World Trade Organization serta bagaimana implikasi yuridis yang ditimbulkan akibat adanya perbedaan tersebut. Dalam penelitian ini menggunakan penelitian hukum dengan metode pendekatan perundang-undangan (statute approach) dan pendekatan kasus (case approach). Tehnik pengambilan bahan hukum yaitu dengan metode studi kepustakaan. Adapun data bahan hukum yang digunakan akan dianalisa dengan interprestasi gramatikal serta dianalisa secara kualitatif. Hasil penelitian menyimpulkan bahwa dalam pelaksanaan peraturan dumping GATT/WTO, masih banyak indikator penentuan dumping yang berbeda antara GATT/WTO dengan Amerika Serikat, hal ini disebabkan karena belum adanya penerapan hukum yang sama dalam mengatur penentuan dumping yang menyebabkan timbulnya perbedaan hasil penentuan injury (kerugian) dalam pelaksanaan penyelidikan dumping serta perbedaan cara penyelesaian sengketa. Implikasi yuridis dalam penentuan dumping adalah pemberlakuan The Tariff Act of 1930 oleh AS diperbolehkan berfungsi sebagai tindakan perlindungan AS kepada industri produk dalam negerinya, dan pelaksanaannya tetap tunduk pada ketentuan yang ada dalam GATT/W.
English Abstract
This thesis started from the study revealing high amount of consumption of Monosodium Glutamate (MSG) in the US. Higher import of MSG to the US from Indonesia has threatened the production of MSG in the US, causing the industries concerned to propose a dumping petition to Indonesia. This research is aimed to analyse the relevance of determinant indicator of dumping provisions between The Tariff Act of 1930 US and Article VI of General Agreement on Tariffs and Trade 1994/World Trade Organization and to analyse juridical implication caused by the difference. This research employed statute and case approaches. The legal materials were obtained from library research, in which the materials were analysed by means of grammatical interpretation, followed by qualitative analysis. The research result concludes that the indicators as referred to in dumping provisions of GATT/WTO are mostly different from those of the US. It is because there has not been any equal regulation that regulates the provision over dumping, leading to an issue of determining injury that occurs in the investigation of dumping and different ways of dispute settlement. The juridical implication is that the enactment of The Tariff Act of 1930 is allowed as to protect the industries of its home market as long as the execution complies with existing provisions of GATT/WTO to provide legal certainty for international Trade law.
