Abstract
Pada skripsi ini penulis membahas tentang Tinjauan Yuridis Terhadap Undang-Undang Administrasi Kependudukan Pasca DiKeluarkan Putusan Mahkamah Konstitusi Nomor 97/PUU–XIV/2016. Yang pada saat ini dalam hal yang melatar belakangi penulis skripsi ini adalah permasalah yang timbul karena dengan adanya putusan MK tersebut terdampak pada pengkosongan kolom Agama untuk Penghayat Kepercayaan yang ada pada Prosedur Administrasi Kependudukan seperti keterangan pada KK, KTP, Akta kelahiran dan Akta perkawinan. Berdasarkan hal ini, penulis mengangkat rumusan masalah yaitu, Bagaimanakah Prosedur Administrasi Kependudukan pada bagian kolom Agama dalam KK dan KTP Pasca dikeluarkan Putusan Mahkamah Konstitusi Nomor 97/PUU–XIV/2016.? Serta Bagaimana Implikasi Hukum Terhadap UndangUndang Administrasi Kependudukan dan peraturan turunannya Pasca dikeluarkan Putusan Mahkamah Konstitusi Nomor 97/PUU–XIV/2016.? Untuk menjawab permasalahan diatas ini, maka penelitian hukum ini menggunakan jenis penelitian hukum yuridis normatif yaitu suatu penelitian yang menganalisis permasalahan hukum serta mengidentifikasi hukum suatu peraturan perundangan yang berlaku. Serta menggunakan metode pendekatan perundangundangan (statute approach) dan pendekatan kasus (case approach). karena pendekatan yang diperoleh mendasarkan pada bahan penelitian yang diteliti mengunakan buku-buku ahli hukum, jurnal hukum, risalah sidang serta undangundang yang terkait. Dimana dengan jenis penelitian yang diambil dalam penelitian ini adalah Bahan hukum primer terdiri atas peraturan perundang-undangan, catatan-catatan resmi atau risalah dalam proses pembuatan suatu aturan perundang-undangan dan putusan hakim serta bahan hukum sekunder ini juga peneliti dapat menggunakan bahan berupa artikel, skripsi, internet, literatur dan undang-undang yang berkaitan dengan penelitian ini. Penulis juga menggunakan Teknik analisis untuk mengadakan sistematisasi terhadap bahan-bahan hukum tertulis. Sistematisasi berarti membuat klasifikasi terhadap bahan-bahan hukum tertulis tersebut untuk mempermudah pekerjaan analisis dan konstruksi akan dianalisa melalui tiga tahapan yaitu, pengumpulan bahan hukum , mengolah data dari bahan hukum , dan interpretasi menggunakan metode interpretasi gramatikal. Hasil dari penelitian ini adalah Mеlalui putusan ini mеnеgaskan bahwa dalam administrasi.kеpеndudukan sеlain mеncantumkan kolom agama juga harus sеcara sama mеmbеrikan ruang bagi pеnghayat kеpеrcayaan. Sеgala pеngaturan soal pеncantuman kolom agama dalam KTP dan KK mеsti mеngacu pada Putusan MK Nomor 97/PUU–XIV/2016, mеskipun bеlum ada pеrubahan kеbijakan dalam Pеraturan Pеmеrintah, Pеraturan Prеsidеn, bahkan Pеraturan Mеntеri Dalam Nеgеr
English Abstract
In this thesis the author discusses the Juridical Review of the Population Administration Act Post-Issuance of the Constitutional Court Decision Number 97/PUU-XIV/2016. At the moment in the background of the writer of this thesis is the problem arising because of the decision of the Constitutional Court affected by the emptying of the Religion column for Believers in the Population Administration Procedure, such as information on KK, KTP, birth certificate and marriage certificate. Based on this, the author raises the formulation of the problem, namely, How is the Population Administration Procedure in the Religion column in the KK and Post-KTP issued a Constitutional Court Decision Number 97/PUUXIV/2016.? And What are the Legal Implications of the Population Administration Law and its derivative regulations Post-issued Constitutional Court Decision Number 97/PUU-XIV/2016.? To answer the above problems, this legal research uses a type of normative legal research which is a study that analyzes legal issues and identifies the laws of applicable laws. As well as using the statute approach and case approach. because the approach obtained based on the research material studied uses books of legal experts, legal journals, minutes of the trial and related laws. Where with the type of research taken in this study is the primary legal material consisting of legislation, official records or treatises in the process of making a law and the judge's decision as well as secondary legal materials, the researcher can use the material in the form of articles, thesis, internet, literature and laws relating to this research. The author also uses analytical techniques to systematize written legal materials. Systematization means to classify the written legal materials to facilitate the analysis and construction work will be analyzed through three stages, namely, gathering legal material, processing data from legal materials, and interpreting using grammatical interpretation methods. The result of this research is that through this decision, it is stated that in the administration, the other positions include a religious column and must also be the same room for believers. All regulations concerning the inclusion of the religious column in the KTP and the KK must refer to the Constitutional Court Decision Number 97/PUU-XIV/2016, although there have been no changes in the policies in the Government's Order, Pre-existing Layouts, and even in the Depression
