Abstract
Penelitian ini dilakukan atas dasar banyaknya potensi wisata yang dimiliki oleh daerah Kabupaten Mojokerto. Pengembangan sektor pariwisata merupakan salah satu upaya yang dapat meningkatkan pendapatan asli daerah (PAD) di Kabupaten Mojokerto. Namun sektor pariwisata masih memiliki beberapa kendala sehingga diperlukan adanya strategi pengembangan pariwisata oleh pemerintah daerah terhadap pendapatan asli daerah (PAD). Bagaimana kondisi pariwisata di Kabupaten Mojokerto, bagaimana strategi pengembangan sektor pariwisata dalam meningkatkan pendapatan asli daerah yang dilakukan oleh Dinas Pemuda, Olahraga, Kebudayaan dan Pariwisata Kabupaten Mojokerto, dan faktor apa saja yang mendukung dan menghambat dalam pengembangan sektor pariwisata di Kabupaten Mojokerto. Untuk mengetahui strategi pengembangan pariwisata oleh pemerintah daerah terhadap pendapatan asli daerah (PAD) maka dalam penelitian ini, peneliti menggunakan jenis metode penelitian kualitatif dengan pendekatan deskriptif. Dan metode analisis yang digunakan adalah melalui metode interaktif Miles dan Huberman. Dalam metode analisis ini terdapat tiga tahapan penelitian yaitu reduksi data, penyajian data dan penarikan kesimpulan/verifikasi. Berdasarkan hasil penelitian ditemukan bahwa terdapat tiga strategi yang dilakukan olehDinas Pemuda, Olahraga, Kebudayaan dan Pariwisata Kabupaten Mojokerto dalam pengembangan pariwisata di daerah terhadap pendapatan asli daerah (PAD) antaralain, pengembangan obyek wisata, promosi wisata, dan pembinaan usaha pariwisata. Untuk menjalankan startegi-strategi tersebut langkah-langkah yang ditempuh oleh Dinas Pemuda, Olahraga, Kebudayaan dan Pariwisata Kabupaten Mojokerto. Namun di dalam penerapan strategi tersebut terdapat factor pendukung dan penghambat yang muncul baik secara internal maupun eksternal. Faktor pendukung internalnya adalah fungsi, visi dan misi serta ketersediaan anggaran pada Dinas Pemuda, Olahraga, Kebudayaan dan Pariwisata sedangkan factor pendukung eksternalnya adalah kondisi geografis di Kabupaten Mojokerto. Untuk factor penghambat internal yang muncul adalah kurangnya tenaga ahli yang dimiliki oleh Dinas Pemuda, Olahraga, Kebudayaan dan Pariwisata, serta belum adanya peraturan daerah yang mengatur tentang strategi pengembangan pariwisata daerah dalam meningkatkan pendapatan asli daerah (PAD) yang menyebabkan kurang terjaminnya kualitas keberhasilannya. Sedangkan factor penghambat eksternalnya adalah mengenai kepemilikan lahan dengan yang lain yang membuat tidak cepatnya terjadinya pengembangan. Oleh karena itu diperlukan adanya kerjasama dalam melakukan pengembangan pariwisata di daerah dengan pihak yang terkait. Dengan adanya kerjasama dalam menyediakan sarana dan prasarana ini dapat menunjang datangnya wisatawan maupun pengunjung, sehingga dapat meningkatkan pendapatan asli daerah (PAD)
English Abstract
In this thesis, Researcher studying the problems about legal protection for the winner of the auction execution of mortgage to mastery the object auction. The choice of theme based on the issues mastery object auction and the cancellation of the auction based on the decision of the District Court. Therefore, this thesis discuss to : (1) How the legal protection for the auction winner execution of the mastery object auction which regulated in Indonesian positive law and auction treatise? (2) What the basic consideration of judges in the decision Kediri District Court Number 61/Pdt.G/2012/PN.Kdr about cancellation of the auction execution was suitable with Indone The research was conducted on the basis of the number of tourist potential possessed by Mojokerto Regency. The development of the tourism sector is one way to increase revenue ( PAD ) in Mojokerto Regency. However, the tourism sector still has some constraints that required the presence of regional tourism development strategy to increase revenue. What is the condition in Mojokerto tourism, how the tourism sector development strategy in increasing local revenues made by the Department of Youth , Sports , Culture and Tourism Mojokerto, and what are the factors that support and hinder the development of the tourism sector in Mojokerto regency. To find local tourism development strategy to increase local revenues in this study, researchers used a type of qualitative research methods with a descriptive approach. And the method of analysis used is through an interactive method Miles and Huberman . In this analysis method , there are three stages of research, namely data reduction, data display and conclusion drawing/verification. Based on the results of the study found that there are three strategies undertaken by the Department of Youth , Sports , Culture and Tourism Mojokerto in the development of tourism in the region to increase revenue ( PAD ), among others, the development of tourism ; tourism promotion, and development of business tourism. To execute the strategy - a strategy that measures taken by the Department of Youth, Sports, Culture and Tourism Mojokerto. However, in the implementation of these strategies are enabling and inhibiting factors that arise both internally and externally. Factor is the internal support functions, vision and mission as well as the availability of the budget at the Department of Youth , Sports, Culture and Tourism, while supporting external factor is the geographical conditions in Mojokerto regency. For internal inhibiting factors that emerged was the lack of expertise possessed by the Department of Youth, Sports, Culture and Tourism, as well as the lack of regulations governing the area of tourism development strategy in the region fatherly increase revenue which leads to less quality assurance of success. While the external limiting factor is the ownership of the land to the other makes no occurrence of rapid development. Therefore, it is necessary to carry out cooperation in tourism development in the area with the relevant parties. With the co-operation in providing the infrastructure to support the arrival of tourists and visitors, thus increasing revenue ( PAD ). sian positive law? Result of the thesis show that legal protection for the auction winner is given by Vendu Reglement that became the main legal of Indonesia auction, HIR, and the PMK 106/PMK.06/2013 About The Changes Of The PMK 93/PMK.06/2010 and the PMK 93/PMK.06/2010 About The Instruction Of Auction. While the auction treatise doesnt provide legal protection to the auction winner. Preventive legal protection given by the Vendu Reglement and the PMK 106/PMK.06/2013 About The Changes Of The PMK 93/PMK.06/2010 and the PMK 93/PMK.06/2010 About The Instruction Of Auction. Repressive legal protection given by the HIR about emptying of the auction object. Basic considerations in the decission of the judge Number 61/Pdt.G/2012/PN.Kdr not in accordance with the Indonesian positive law. Cancellation of the auction execution by the court ruling can cause the implementation of the preferen rights that giving by the law to the creditor mortgage holders through the auction execution be not have legal certainty. Therefor necessary changes in norms of Vendu Reglement and technical regulations of auction.
