Abstract
Di kota Batu terdapat banyak Porn Mini yang didirikan oleh masyarakat kota. Bath_ Tetapi, pada kenyataamiya kegiatan usaha Porn Mini tersebut belum memiliki usaha dan belum ada penindakan dari pemerintah baik dari dinar perdagangan kota Batu, PT Pertamina dan BPH Migas untuk menyelesaikan permasalahan tersebut. Sehingga pengaturan tentang perdagangan Migas pada pasal 7 kurang efisien. Dan Tatar belakang diatas, maka peneliti mengangkat rumusan masalah yaitu Bagaimana efektivitas Pasal 7 UU Migas terkait kegiatan usaha Pom Mini dalam penyelenggaraan perdagangan Migas di Indonesia dan Bagaimana upaya PT Pertamina dalam penyelesaian sengketa kegiatan usaha Porn Mini di kota Batu? Penelitian ini menggunakan jenis penelitian yuridis Empiris dengan menggunakan metode pendekatan penelitian berupa pendekatan Yuridis Sosiologis. Lokasi penelitian yang diambil yaitu kota Batu. Data diperoleh melalui tanya-jawab atau wawancara dengan para narasumber yang berwenang yakni pemilik usaha Porn Mini di kota Batu serta pihak PT. Pertamina. Dalam penelitian ini penulis melakukan wawancara dengan (enam) orang dari masing-masing pemilik usaha Pom Mini yang tersebar diberbagai wilayah di kota Batu baik wilayah utara, barat, tengah, timer dan selatan. Dan juga mewawancari I orang pegawai yang mewakili pihak PT. Pertamina regional Malang sebagai kepala bidang penjualan clan pemasaran produk. Berdasarkan basil penelitian dan pembahasan atas permasalahan yang diajukan dalam penelitian ini, dapat disimpulkan bahwa pasal 7 UU Migas terkait status kegiatan usaha pom mini di kota Batu masih beium efektif karena belum ada pengawasan yang maksimal terhadap pendistribusian BBM ke wilayah kota Batu dan belum ada aturan hokum dalam izin pendirian kegiatan usaha Porn Mini. Upaya penyelesaiaan sengketa antara PT Pertamina dan Pelaku Usaha Pam Mini dalam Pendirian Pam Mini di Kota Batu ada dua cara, yakni melalui upaya preventif dan upaya represif. Seharusnya pemerintah memperketat pengawasan dan regulasi dalam hal teknis pelaksanaan pendistribusian BBM ke seluruh wilayah terutama di wilayah Kota Batu dan melakukan sosialisasi lebih menyeluruh dan mendetail terkait dengan perdagangan Migas dar pendistribusian BBM ke masyarakat sehingga tidak terjadi lagi kasus-kasus yang serupa.
English Abstract
In Batu city there are many Mini Porn founded by Batu city society. However, in reality the business activities of Pom Mini have not owned a business and there has been no legal action from the government from Batu City's trade office, PT Pertamina and BPH Migas to solve the problem. So the regulation on oil and gas trade in Article 7 is less efficient. From the above background, the researchers raised the issue of how the effectiveness of Article 7 Oil and Gas Law related to business activities Porn Mini in the implementation of oil and gas trade in Indonesia and How is the effort of PT Pertamina in the settlement of disputes Porn Mini business activities in the city of Batu? This study uses the type of juridical empirical research using research approach method of the Sociological Juridical approach. The location of the research is Batu city. Data obtained through question or answer or interviews with the authorized resource persons ie business owners Porn Mini in the city of Batu and the PT. Pertamina. In this study the authors conducted interviews with 6 (six) people from each business owner Porn Mini scattered in various areas in the city of Batu good north, west, central, east and south. And also interviewed I. employee representing the PT. Pertamina regional Malang as head of sales and marketing of product. Based on the results of research and discussion on the problems raised in this study, it can be concluded that Article 7 of the Oil and Gas Law related to the status of mini-pom activities in the city of Batu is still not effective because there is no maximum supervision of the distribution of fuel to the city of Batu and there is no legal rule in the permit for establishment of Porn Mini business activities. Efforts to resolve the dispute between PT Pertamina and Pom Mini Business Actors in Porn Mini Establishment in Batu City there are two ways, namely through preventive efforts and repressive efforts. The government should tighten the supervision and regulation in terms of technical implementation of the distribution of fuel to the entire region, especially in the Bath City region and conduct more comprehensive and detailed socialization related to oil and gas trade an distribution of fuel to the community so that no similar cases occur again.
