Abstract

Perlindungаn hukum terhаdаp kаryа ciptа gambar logo merupаkаn suаtu hаl yаng perlu diberi perhаtiаn kаrenа dewаsа ini semаkin bаnyаk pihak yаng menggunаkаn logo suatu klub sepаk bolа padahal merekа tidаk mempunyаi hаk аtаu izin tetаpi dаpаt menggаndаkаn dan/atau menggunakan logo tersebut untuk kepentingan komersial. Logo sendiri mаsuk dаlаm kаtegori kаryа seni rupа berupа gаmbаr yаng kemudiаn dijаdikаn logo oleh klub sepаk bolа. Sebаgаi sebuаh ide yаng dituаngkаn oleh si penciptа dаlаm bentuk gаmbаr sehinggа terhаdаp penciptа ataupun pemegang hak cipta gаmbаr logo tersebut hаrus mendаpаtkаn perlindungаn hukum. Berdasarkan latar belakang tersebut, maka fokus permasalahan penelitian ini adalah bagaimana pelaksanaan perlindungan hukum Pasal 9 Undang-Undang Hak Cipta Nomor 28 Tahun 2014 atas hak ekonomi yang dimiliki oleh pemegang hak cipta gambar logo barito putera dan apa saja faktor penghambat serta upaya yang dilakukan dalam pelaksanaan perlindungan hukum hak cipta atas gambar logo barito putera tersebut. Jenis penelitian ini adalah jenis penelitian yuridis empiris dengan menggunakan metode pendekatan yuridis sosiologis. Teknik memperoleh data primer melalui wawancara dan dokumentasi dan data sekunder melalui studi kepustakaan. Teknik analisa dalam penelitian ini menggunakan teknik analisa deskriptif kualitatif. Adapun hasil dari penelitian ini adalah penggandaan dan/atau penggunaan secara komersial ciptaan gambar logo Barito Putera tanpa adanya izin dari pemegang hak cipta yaitu PT. Putera Barito Berbakti merupakan suatu pelanggaran hak ekonomi pencipta atau pemegang hak cipta karena jelas bertentangan dengan Pasal 9 Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta. Hal tersebut terjadi karena masih tidak terlaksananya perlindungan hukum yang maksimal sesuai dengan pasal 9 Undang-Undang Hak Cipta nomor 28 tahun 2014 tentang Hak Cipta. Terdapat faktor penghambat pelaksanaan yang terdiri dari hambatan hukum dan non hukum. Seperti adanya hambatan maka upaya yang dilakukan juga terdiri atas upaya hukum dan non hukum.

English Abstract

The protection of the law on the images of the logo of the merchandise should not be afforded if it is necessary to use a logo of a club even when it is not necessary to permit or permit the use and / or use of the logo for commercial purposes. An idea that is created by the creator in the form so that the creator or the copyright holder of the logo must only protect the law. Based on this background, the focus of this research problem is how the implementation of legal protection Article 9 Copyright Act No. 28 of 2014 on economic rights owned by the copyright holders of barito logo logo and what are the constraining factors and efforts made in the implementation protection of copyright law over the image of the barito son's logo. This type of research is a kind of juridical empirical research using sociological juridical approach method. Techniques of obtaining primary data through interviews and documentation and secondary data through literature study. Analysis technique in this research using descriptive analysis technique qualitative. The result of this research is the copying and / or commercial use of the creation of Barito Putera logo image without permission from the copyright holder namely PT. Putra Barito Berbakti is an infringement of the economic rights of the creator or copyright holder because it is clearly contrary to Article 9 of Law Number 28 Year 2014 regarding Copyright. This is because there is still no maximum legal protection in accordance with article 9 of Copyright Act number 28 of 2014 on Copyright. There are inhibiting factors of implementation consisting of legal and non-legal barriers. As there are obstacles, the effort made also consists of legal and non-legal efforts.
