Abstract
Dalam skripsi ini penulis meneliti tentang kewenangan United Nations (UN) atau Perserikatan Bangsa-Bangsa (PBB) sebagai salah satu oganisasi internasional yang mempunyai peran yang sangat penting dalam menjaga kedamaian dan keamanan Internasional, dalam kasus kejahatan genosida yang dialami oleh etnis Rohingya dan dilakukan oleh Pemerintah Myanmar. Pelangaran HAM yang biasa dan yang luar biasa telah dilakukan oleh Pemerintah Myanmar. Pelanggaran HAM yang dilakukan pemerintah Myanmar sudah termaksud kategori genosida. Pembunuhan, penyiksaan, pemerkosaan, pembakaran desa, kejahatan seksual, pengusiran secara paksa, dan serangkaian diskriminasi terhadap etnis Rohingya. PBB mempunyai andil yang besar dalam penanganan kasus kejahatan Genosida ini. Dari sejak awal PBB sudah membentuk pencari fakta, untuk mencari tahu dan mencari bukti-bukti tentang kekerasan yang ada di Myanmar. Sehingga dari latar belakang tersebut, penulis mengambil fokus permasalahan skripsi ini dengan dua rumusan masalah :(1) Apakah perlakuan pemerintah Myanmar terhadap etnis Rohingya dapat dikatagorikan sebagai kejahatan genosida? dan (2) Bagaimana kewenangan PBB dalam penanganan kejahatan genosida terhadap etnis Rohingya di Myanmar? Dalam penelitian ini penulis menggunakan metode yuridis normatif dan menggunakan pendekatan yang dilakukan adalah dengan pendekatan perundang-undangan (statute approach), pendekatan konsep (conceptual approach), dan pendekatan kasus (case approach). Berdasarkan penelitian yang telah penulis lakukan, bahwa benar pemerintah Myanmar telah melakukan genosida terhadap etnis Rohingya. Berdasarkan Pasal 2 Convention on the Prevention and Punishment of the Crime of Genocide, Pemerintah Myanmar telah memenuhi empat dari lima unsur genosida. Kejahatan genosida sudah diatur dalam konvensi tentang Pencegahan dan Penghukuman terhadap Kejahatan Genosida Convention on the Prevention and Punishment of the Crime of Genocide yang tahun 1948 didefinisikan sebagai suatu tindakan dengan maksud menghancurkan atau memusnahkan seluruh atau sebagian suatu kelompok bangsa, rasa, etnis, atau agama. Konvensi ini kemudian diabsorbsi oleh Statuta ICC dan kemudian dimasukkan dalam Undang-undang No. 25 Tahun 2000 tentang Pengadilan Hak Asasi Manusia. Pada bab VI dan VIII Piagam PBB dijelaskan PBB mempunyai kewenangan untuk membantu melindungi populasi dari genosida, kejahatan perang, pembersihan etnis dan kejahatan terhadap kemanusiaan. Jika pihak nasional, pihak yang berwenang jelas gagal untuk melindungi populasi mereka dari empat spesifik kejahatan kekejaman massal, maka masyarakat internasional siap mengambil tindakan kolektif melalui Dewan Keamanan (Security Council). PBB juga berperan penting dalam penanganan etnis Rohingya itu sendiri sebagai korban genosida.
English Abstract
In this thesis the author examines the authority of the United Nations (UN) as one of the international organization that has a very important role in maintaining international peace and security, in this case of genocide crimes experienced by ethnic Rohingya and commited by Government of Myanmar. Ordinary human rights violations and extraordinary human rights violations have been committed by the Government of Myanmar. Human rights violations committed by the government of Myanmar have been categorized as genocide. Murder, torture, rape, village burning, sexual crimes, forced evictions, and a series of discriminations toward ethnic Rohingyas. The United Nations has a big role in handling this criminal case of Genocide. From the very beginning the UN has established a fact-finding, to find out and look for evidence of violence in Myanmar. So from the background, the author took the focus of this thesis problem with two problems subject : (1) Whether the Myanmar government's treatment of Rohingyas can be categorized as a the crime of genocide? and (2) How is the UN's authority in the handling of genocide crimes toward Rohingyas in Myanmar? In this research the authors use the normative juridical method and the approach is done with statute approach, concept approach, and case approach. Based on the research that the author has done,it’s true that Myanmar government has committed genocide toward Rohingyas. According to Article 2 of the Convention on the Prevention and Punishment of the Crime of Genocide, the Government of Myanmar has fulfilled four of the five elements of genocide. The crime of genocide is arranged in the Convention on the Prevention and Punishment of the Genocide Crime of 1948 1948 defined as an act with the intention of ruin or destroying all or any part of a national, ethnic, or religious group. This Convention is subsequently absorbed by the ICC Statute and subsequently incorporated in Law no. 25 of 2000 on Human Rights Courts. In chapters VI and VIII of the UN Charter the UN has the authority to help protect populations from genocide, war crimes, ethnic cleansing and crimes against humanity. If the national side, the authorities clearly fail to protect their population from the four specific crimes of mass atrocities, then the international community is ready to take collective action through the Security Council. The UN also plays an important role in handling Rohingya ethnicity itself as a victim of genocide.
