Abstract
Penelitian ini bertujuan untuk menganalisis serta menjelaskan pengaturan atas perubahan informasi domisili pada KTP-el yang telah diatur dalam UU No. 24 Tahun 2013 Tentang Administrasi Kependudukan, khususnya pada Pasal 64 Ayat (8) bahwa perubahan atau penggantian informasi atau elemen data seperti domisili wajib dilaporkan pada pihak instansi kependudukan terkait. Melihat masa berlaku dari KTP-el adalah seumur hidup, maka pentingnya diatur jangka waktu perubahan atau penggantian informasi domisili. Yang dalam hal ini tidak dijelaskan secara jelas pada Pasal 64 Ayat (8) UU Administrasi Kependudukan tersebut, mengingat tingginya mobilitas atau perpindahan penduduk antar daerah.. Rumusan Masalah yang diangkat dalam penelitian ini ialah yang pertama, Bagaimana konsep batasan pelaporan perubahan domisisli pada KTP Elektronik (KTP-el). Kedua, Apa akibat hukumnya apabila pemegang KTP Elektronik (KTP-el) tidak melakukan pelaporan terkait perubahan domisili. Jenis penelitian yang digunakan dalam skripsi ini ialah yuridis normatif atau penelitian hukum doktrinal. Dengan pendekatan perundang-undangan dan pendekatan konseptual. Jenis bahan hukum yang digunakan ialah bahan hukum primer, yaitu peraturan perundang-undangan yang terkait Hasil dari penelitian ini setelah melakukan analisis metode yang telah dijelaskan, bahwa untuk mewujudkan kepastian hukum dalam pelaksanaan Pasal 64 ayat (8) Undang-Undang Administrasi Kependudukan perlu adanya konsep batasan dan mengulas akibat hukum apabila tidak terlaksanakannya Peraturan tersebut demi memudahkan masyarakat dalam memahami proses perubahan domisili pada KTP-el
English Abstract
This study aims to analyze and explain the regulation of the change of domicile information on KTP-el which has been regulated in Law no. 24 Year 2013 on Population Administration, in particular in Article 64 Paragraph (8) that changes or replacements of information or data elements such as domicile shall be reported to the relevant resident agency. Seeing the validity period of KTP-el is lifetime, then the importance of regulating the period of change or replacement of domicile information. Which in this case is not explained clearly in Article 64 Paragraph (8) of the Population Administration Law, considering the high mobility or the movement of population between regions .. The formulation of the issues raised in this study is the first, How the concept of reporting limitation limits on domisisli KTP Elektronik (KTP-el). Second, what is the effect of the law if the holder of Electronic Identity Card (KTP-el) does not do reporting related to the change of domicile. The type of research used in this thesis is normative juridical or doctrinal law research. With the approach of legislation and conceptual approach. The type of legal material used is the primary legal material, namely the relevant legislation The result of this research after performing the analysis of the method has been explained, that to realize the legal certainty in the implementation of Article 64 paragraph (8) of the Population Administration Act it is necessary to have a boundary concept and review the legal consequences if the implementation of the Regulation is not implemented in order to facilitate the community in understanding the change process domicile on KTP-el
