Abstract
Indonesia memiliki beberapa pengaturan hukum pengangkatan anak yang berlaku saat ini. Terdapat ketentuan syarat harus seagama antara calon orang tua angkat dengan calon anak angkat dalam pengaturan tentang pengangkatan anak. Tahun 2017 ada seorang Polwan yang tidak bisa mengadopsi bayi karena terganjal syarat harus seagama dengan calon anak angkat pada PP No. 54 Tahun 2007 tentang Pelaksanaan Pengangkatan Anak. Tahun 2015 seorang anak bernama Engeline yang diangkat sejak berumur 3 hari dan menganut agama sama seperti agama ibu angkatnya, dianiaya oleh orang tua angkatnya tersebut. Melihat dari peristiwa ini, syarat harus seagama telah dipenuhi tetapi dalam hal tujuan dari pengangkatan anak pun belum terwujud. Tujuan pengangkatan anak dalam penelitian ini adalah tujuan pengangkatan anak yang tercantum pada pasal 2 PP No. 54 Tahun 2007 yakni kepentingan terbaik bagi si calon anak angkat. Berdasarkan latar belakang tersebut di atas, maka permasalahan hukum yang dikemukakan dalam penelitian ini adalah kesesuaian Pasal 3 ayat (1) PP No. 54 Tahun 2007 mengenai syarat harus seagamanya orang tua angkat dan anak angkat dengan tujuan pengaturan pengangkatan anak yang tercantum dalam Pasal 2 PP No. 54 Tahun 2007. Untuk menjawab permasalahan di atas, penelitian hukum ini menggunakan pendekatan undang-undang dan pendekatan konseptual. Bahan hukum yang berhubungan dengan masalah yang diteliti diperoleh melalui penelusuran kepustakaan. Bahan-bahan hukum yang telah diperoleh dianalisis dengan menggunakan metode interpretasi sistematis dan interpretasi gramatikal agar mencegah terjadinya multi tafsir dalam menjawab isu hukum yang telah dirumuskan. Berdasarkan pembahasan, maka dapat disimpulkan bahwa terdapat kepentingan yang sesuai dan tidak sesuai terkait diterapkannya syarat harus seagama antara orang tua angkat dan anak angkat dalam Pasal 3 ayat (1) PP No.54 Tahun 2007 apabila diukur dengan parameter perlindungan anak. Perlindungan anak terkait pendidikan perlu disesuaikan syarat “harus seagama” nya dengan materi pendidikan yang diberikan. Sekolah yang terdapat pendidikan agama memang harus dilaksanakan syarat “harus seagama” antara pendidik dan anak didik, tetapi untuk pendidikan ilmu pengetahuan lain selain pendidikan tentang agama tidak sesuai jika syarat harus seagama ini diterapkan. Untuk pendidikan moral yang memerlukan peran orang tua untuk mendidik anak dari kecil dan vi diajarkan tentang agama, dalam hal ini ketentuan syarat “harus seagama” telah sesuai. Terkait perlindungan terhadap kesehatan, hak sosial, perlindungan khusus, perlindungan atas sandang, pemukiman, dan hukum tidak sesuai jika terdapat syarat “harus seagama”. Karena dalam hal pelayanan kesehatan yang diutamakan adalah kesembuhan dari pasien termasuk anak angkat tanpa membeda-bedakan dari suku, ras, maupun agama pasien. Demikian juga dalam hal perlindungan hak sosial, perlindungan khusus, perlindungan atas sandang, pemukiman, dan hukum.
English Abstract
Indonesia has several legal arrangements for adoption regarding an adopted child of the same religion as the foster parent. Year 2017 there is a Policewoman who can’t adopt baby because hampered condition have to same religion as the foster parents in Government Regulation Number 54 Year 2007. Year 2015 a child named Engeline was appointed from the age of 3 days and adheres to same religion just like her foster parent, she was persecuted by her foster parent. Requirement of the same religion has been fulfilled but the main purpose of the adoption has not yet materialized. The purpose of adopting a child in this study as a part of the regulation of child adoption provided in Article 2 of Government Regulation Number 54 of 2007 which is the best interest for the prospective adopted child. Based on the mentioned background, the issue discussed in this research is related to the relevance of Article 3 Paragraph (1) of Government Regulation Number 54 Year 2007 regarding an adopted child of the same religion as the foster parents’ as part of the regulation of child adoption provided in Article 2 of Government Regulation Number 54 of 2007. To answer the problem, this research employed statute and conceptual approach. Legal material related to the problem studied was obtained through literature search. The legal materials that have been obtained are analyzed using systematic interpretation method and grammatical interpretation in order to prevent multi interpretation in response to legal issues that have been formulated. The result revealed that this issue could be seen as either relevant or not relevant to some extent when aspects of child protection are taken into account. Regarding the children education, it is essential that the concept of the same religion be adjusted to the education the child receives. Religious education on wherever schools is relevant if a concept of the "same religion" between educators and students, but for other science education will not be relevant when there is still a concept of the same religion. Moral education that requires the role of parents to educate children from childhood and be taught about religion is relevant when there is still a concept of the same religion. Child protection in terms of health, social rights, special protection, protection of their clothing, housing, and law will not be relevant when there is still a concept of the same religion. Health services will prioritize the patient’s recovery including the adopted child without discriminating the patient. Therefore, child protection in terms of social rights, special protection, protection of their clothing, housing, and law.
