Abstract
Pemerintah desa merupakan subsistem penyelenggaraan pemerintahan, landasan pemikiran dalam pengaturannya adalah keanekaragaman, partisipasi, otonomi asli, demokrasi dan pemberdayaanmasyarakat. Paradigma baru otonomi desa menurut Undang-Undang Nomor 6 Tahun 2014 Tentang Desa tersebut ternyata masih banyak yang memandang secara skeptis. Hukum disamping merupakan kumpulan peraturan yang bersifat normatif, juga dilihat sebagai gejala sosial yang bersentuhan langsung dengan variabel lain. Hukum didekati dari dua sudut yaitu dipelajari dan diteliti secara normatif (law in books) dan secara empiris (law in action). Tujuan penelitian ini, yaitu: (1) Mengetahui peran serta Badan Permusyawaratan Desa (BPD) Desa Gamping Kecamatan Campurdarat Kabupaten Tulungagung terkait peran legislasi dalam penyusunan Peraturan Desa; dan (2) Mengetahui faktor-faktor dan solusi efektifitas Badan Permusyawaratan Desa (BPD) Desa Gamping Kecamatan Campurdarat Kabupaten Tulungagung dalam proses penyusunan Peraturan Desa. Dari aspek metode penelitian hukum termasuk dalam jenis yuridis empiris dengan pendekatan yuridis sosiologis. Lokasi penelitian ini di Kantor BPD dan Kantor Kepala Desa Desa Gamping. Penelitian ini menggunakan data primer dan sekunderyang meliputi bahan hukum primer, sekunder dan tersier. Data digali melalui wawancara bebas tertimpin, pengamatan serta penelusurandari berbagai sarana, baik cetak maupun elektronik. Penelitian ini menggunakan populasi dan sampel. Analisis dilalakukan dengan diskriptif kualitatif dan deskriptif kualitatif. Kesimpulan Penelitian : Pertama, Peran BPD dalam Fungsi legislasi dapat dilihat pada kewenangan pimpinan badan permusyawaratan desa yaitu apabila rancangan peraturan desa dianggap masih belum diperlukan, maka rancangan itu ditolak, sedangkan pembahasan dengan pemerintah desa dituntut adanya kemitraan antara pemerintah desa dengan badan permusyawaratan desa sehingga Sehingga dibutuhkan pemahaman yang sama tentang adanya sesuatu kebutuhan yang harus ditindak lanjuti atau diatur dengan peraturan desa. Kedua, faktor-faktor mempengaruhi pelaksanaan Fungsi legislasi disimpulkan sebagai berikut: (1) Keuangan; (2) Sumber daya manusia; dan (3) Dampak pemilihan kepala desa. Ketiga, Solusi alternatif permasalahan legislasi BPD adalah: (1) Musyawarah desa guna merumuskan dana alokasi BPD berpayung hukum peraturan desa; (2) Kepala Desa mendatangkan Legal Drafter guna memfasilitasi BPD dalam bidang legislasi peraturan desa; (3) Meminimalisir selisih paham BPD dan Pemerintah Desa Gamping sehingga kedua lembaga bertemu dalam satu titik singgung konsepsi integral pembangunan desa. Saran : (a) Perlu perhatian khusus Pemerintah Daerah Kabupaten dan diadakanya pelatihan cara menyusun dan merancang Peraturan Desa bagi Pemerintah Desa dan xiv Badan Permusyawaratan Desa, agar menjadi suatu produk hukum tersebut dapat berlaku sebagaimana mestinya, baik secara yuridis, politis, maupun sosiologis; (b) Dalam proses legislasi peraturan desa agar memperhatikan aspirasi masyarakat desa, sehingga produk hukum yang dihasilkan dapat diterima dan mendapat pengakuan dari masyarakat serta pelaksanaanya berjalan efektif; dan (c) Perlunya forum yang khusus guna mengawasi kinerja BPD dan Kepala Desa untuk penyelenggaraan pemerintahan yang baik.
English Abstract
The village administrator is the subsystem of government administrator. Thinking based of its regulation is the diversity, the participation, the original autonomy, the democracy and the community empowerment. The people view about the new paradigm of village autonomy according to the law no. 6 2014 about Village remains skeptical. There are two kind of law approach; being studied and being researched in normative way (law in books) and empirical way (law in action). The objective of this study are: (1) To know the roles of BPD of Gamping Village Campurdarat Sub district Tulungagung Regency according to its legislation function in formulating the village regulations; (2) To know the factors and the solutions of the effectiveness of BPD of Gamping Village Campurdarat Sub district Tulungagung Regency in formulating the village regulations. Based on the research methodology, Law is included in the type of juridical empirical by using juridical sociological aspects. The BPD office and the village office of Gamping village was chosen as the location to conduct a study. This study was using primary and secondary data which covered the primary, secondary and tertiary of legal materials. The data was collected by doing free guided interviews, observation and investigation from various media both printed and electronic based. This study used population and sample. The analysis was done by using descriptive qualitative and descriptive quantitative. Conclusion of the study: First, the role of BPD in its legislation function can be seen through the authority of BPD’s head. If the formulations of the village regulations are considered not really necessary, the formulation will be rejected. However, a discussion with village administrators is prosecuted to build a partnership between village administrator and BPD. Therefore, it is necessary to have similar understanding about needs, which required to be followed-up or to be regulated by village regulations. Second, factors that influenced the implementation of legislation function are as follows: (1) Financial; (2) Human resources; (3) The impact of village head election. Third, the effective solution of BPD’s legislation problems are: (1) Arrange a village discussion, to formulate the BPD funding allocation by refers to the village regulations; (2) The village head invites a Legal Drafter in order to facilitate BPD in legislating the village regulation; (3) Minimizing the different comprehension between BPD and xvi Gamping village administrator so that two institutions can have one point of tangency in the village development integral conception. Suggestion : (a) Need a special attention from regency government and required to conduct a training on how to arrange and design village regulations for the village administrator and BPD, so that the regulation can be employed as its intended whether juridical, political or in its sociological aspects; (b) In legislation process, village regulations need to pay attention on the villager aspirations. Therefore, the legal products produced can be accepted and get the acknowledgement from the villager and the implementation can goes effectively; (c) Special forum is required to monitor the BPD and village head works in order to create a good administrators.
