Abstract
Penelitian ini membahas tentang efektivitas Pasal 13 Peraturan Daerah Kota Kediri Nomor 3 Tahun 2015 Tentang Pengelolaan Sampah Terkait Penanganan Sampah Rumah Tangga. Berdasarkan fakta, bahwa volume sampah rumah tangga di Kota Kediri cukup besar dan TPA Kota Kediri sudah melebihi kapasitas. Volume sampah rumah tangga di Kota Kediri cukup besar karena tidak ada keseimbangan antara peraturan, penegak hukum, sarana atau fasilitas, masyarakat dan kebudayaan dengan sistem penanganan sampah rumah tangga, yaitu pemilahan, pengumpulan, pengangkutan, pengolahan dan pemrosesan akhir sampah. Berdasarkan latar belakang tersebut, maka rumusan masalah pada penelitian ini adalah (1) Bagaimana efektivitas Pasal 13 Peraturan Daerah Kota Kediri Nomor 3 Tahun 2015 tentang Pengelolaan Sampah Terkait Penanganan Sampah Rumah Tangga? (2) Faktor-faktor apa yang menghambat pelaksanaan efektivitas Pasal 13 Peraturan Daerah Kota Kediri Nomor 3 Tahun 2015 tentang Pengelolaan Sampah Terkait Penanganan Sampah Rumah Tangga dan solusinya yang dilakukan oleh Pemerintah Kota Kediri? Penelitian ini menggunakan jenis penelitian yuridis empiris dengan metode pendekatan yuridis sosiologis. Lokasi penelitian di Dinas Kebersihan dan Pertamanan Kota Kediri serta RT.39 RW.07 Kelurahan Pakunden Kecamatan Pesantren dan RT.02 RW.01 Kelurahan Burengan Kecamatan Pesantren. Jenis dan Sumber data adalah data primer dan data sekunder. Data primer dapat diperoleh dengan melakukan wawancara langsung dengan narasumber. Data sekunder diperoleh dari studi kepustakaan, pendapat dari ahli hukum dan studi internet. Teknik analisa data adalah deskriptif analisis. Dari hasil penelitian ini dapat diketahui, bahwa Efektivitas Pasal 13 Peraturan Daerah Kota Kediri Nomor 3 Tahun 2015 Tentang Pengelolaan Sampah Terkait Penanganan Sampah Rumah Tangga belum berjalan efektif. Terdapat beberapa faktor yang menyebabkan penanganan sampah rumah tangga di Kota Kediri belum berjalan efektif, yaitu faktor penegak hukum, faktor sarana atau fasilitas yang mendukung penegakan hukum, faktor masyarakat, faktor kebudayaan.
English Abstract
This research talk about the effectiveness of article 13 regulation the area of a city Kediri number 3 in 2015 on waste management related to the handling of household waste. Based on fact, that the volume household waste in the city Kediri were quite large and Kediri TPA city has exceeded capacity. The volume household waste in the city Kediri large enough cause no balance between rules, law enforcement, services and facilities, the society and culture with a system the handling of household waste, namely sorting, the collection, transporting, processing and processing final waste. Based on this background, the problem statement in this study is (1) how the effectiveness of article 13 regulation the area of a city Kediri number 3 in 2015 on waste management related to the handling of household waste? (2) factors that which impedes the implementation of the effectiveness of article 13 regulation the area of a city Kediri number 3 in 2015 on waste management related to the handling of household waste and the solution done by a city government kediri? This research uses two methods consisting of the empirical juridical and sociological juridical approach. The research site is in the Dinas of cleanliness and park of Kediri and then RT.39 RW.07 Kelurahan Pakunden Kecamatan Pesantren and RT.02 RW.01 Kelurahan Burengan Kecamatan Pesantren. The data types and sources are primary and secondary data. Primary data could be obtained by conducting interview with informant directly, Secondary data was obtained from literature studies, opinion jurists, and internet study. The data analysis was descriptive-analysis. From this research result, it can be known that the effectiveness of article 13 regulation the area of a city Kediri number 3 in 2015 on waste management related to the handling of household waste has not been effective. There are several factors that cause waste management household in city Kediri has not been effective, namely factors law enforcement, factors services and facilities that supports law enforcement, factors the society, factors culture.
