Abstract
Pada skripsi ini, penulis mengangkat permasalahan hukum mengenai Pembagian Tanggung Jawab Pemerintah dan Pelaksana Penempatan Tenaga Kerja Indonesia Swasta Dalam Upaya Peningkatan Perlindungan Hukum Terhadap TKI. Pemilihan judul tersebut dilatarbelakangi oleh permasalahan hukum terhadap adanya kekaburan hukum mengenai pembagian tanggung jawab antara pemerintah dengan PPTKIS untuk melindungi TKI dalam Undang-Undang Nomor 39 Tahun 2004 tentang Penempatan dan Perlindungan TKI. Berdasarkan hal tersebut, karya tulis ini mengangkat rumusan masalah : Apa tanggung jawab pemerintah dan Pelaksana Penempatan Tenaga Kerja Indonesia Swasta (PPTKIS) dalam upaya peningkatan perlindungan hukum terhadap TKI?. Penulisan karya tulis ini merupakan penelitian yuridis normatif dengan menggunakan metode pendekatan perundang-undangan (Statute Approach) dan pendekatan konseptual (Conceptual Approach). Bahan hukum primer, sekunder, dan tersier yang diperoleh penulis dianalisis menggunakan teknik analisis interpretasi sistematis. Menurut para ahli, tanggung jawab timbul karena adanya peranan, baik berupa hak, kewajiban atau kekuasaan, sehingga tanggung jawab diartikan sebagai suatu kewajiban untuk melakukan sesuatu, sedangkan kewajiban merupakan segala sesuatu yang harus dilakukan. Pada masa pra penempatan terdapat 3 perlindungan administratif dan 4 perlindungan teknis, pada masa penempatan terdapat 6 bentuk perlindungan, dan pada masa purna penempatan terdapat 6 bentuk perlindungan. Tidak semua bentuk perlindungan tersebut menjadi tanggung jawab salah satu pihak pelaksana yaitu pemerintah atau Pelaksana Penempatan Tenaga Kerja Indonesia Swasta (PPTKIS), namun dalam setiap tahap ada beberapa yang menjadi tanggung jawab pemerintah, ada yang menjadi tanggung jawab PPTKIS dan adapula yang menjadi tanggung jawab pemerintah maupun PPTKIS.
English Abstract
In this thesis, the writer brought up the law issue of the Division of Responsibility between The Government and The Indonesian Private Employment Agencies In Order to Increase The Law Protection of Migrant Workers. The reason behind the choosing of the title is back grounded by the problem of the vagueness of the dividing of the responsibility between the government and PPTKIS to protect Indonesian migrant workers (TKI) in law number 39 of 2004 about the Placement and Protection of TKI. Based on that situation, this thesis brought up the research problem: what is the government responsibility and The Indonesian Private Employment Agencies (PPTKIS) In Order to Increase The Law Protection of Indonesian Migrant Workers The Indonesian Private Employment Agencies In Order to Increase The Law Protection of Indonesian Migrant Workers?. This research is a normative juridical research that uses Statute Approach and Conceptual Approach. Primary, secondary, and tertiary law materials that have been gained by the writer are analyzed using systematic interpretation analysis technique. According to the experts, responsibility appears because of role, whether in the form of right, obligation, or dominance, so responsibility is seen as an obligation to do something, whereas obligation is everything that has to be done. During pre-placement, there are 3 administrative protections and 4 technical protections, during the placement period there are 6 forms of protections, and during after-placement there are 6 forms of protections. Not all of those protections are the responsibility of one of the institutes which are the government or The Indonesian Private Employment Agencies (PPTKIS), but in each step there are several protections that become the responsibility of the government, there are several protections that become the responsibility of PPTKIS, and there are also several protections that become the responsibility of both the government and PPTKIS.
