Abstract
Permasalahan transportasi begitu kompleks, sehingga diperlukan penanganan sesegera mungkin dengan adanya pengawasan yang dilakukan oleh aparatur negara untuk memberikan pelayanan publik yang baik. Kondisi kendaraan yang baik hares memenuhi persyaratan teknis yang sesuai dengan peraturan perundang-undangan. Penelitian ini bertujuan untuk mengidentifikasi dan menganalisis teknis pengawasan Uji Kelayakan Bus Antar Kota Dalam Trayek yang dilakukan oleh Dinas Perhubungan Kota Malang di Kantor Unit Pelaksanaan Teknis Pengujian Kendaraan Bermotor dan di Terminal Landungsari serta mengetahui hambatan-hambatan yang terjadi dan upaya yang dilakukan oleh Dinas Perhubungan ketika melaksanakan pengawasan pengujian kelayakan. Penelitian ini merupakan penelitian yuridis empiris dengan menggunakan metode pendekatan yuridis sosiologis. Data primer dan sekunder yang diperoleh penulis dengan menggunakan metode wawancara dan observasi serta teknik studi kepustakaan. Menganalisis data yang diperoleh dengan menggunakan teknik deskriptif kualitatif dan dibuat dengan metode berpikir deduktif. Adapun hasil penelitian menunjukkan bahwa substansi peraturan perundang-undangan pengujian kendaraan bermotor umum dalam trayek secara keseluruhan telah efektif, tetapi dalam hal pengawasan masih belum maksimal yang disebabkan oleh faktor internal dan ekstemal. Juga pengawasan uji kelayakan bus antar kota dalam trayek di Terminal Landungsari belum terlaksana sehingga penerapan Pasal 50 huruf a Lembaran Penjelasan Peraturan Pemerintah Nomor 74 Tahun 2014 belum efektif, sehingga akibat hukumnya masyarakat kurang menyadari pentingnya melakukan pengujian kendaraan bermotor dan masih maraknya pencaloan di sekitar Kantor UPT Pengujian Kendaraan Bermotor Kota Malang.
English Abstract
Transportation problems are complex, so that need an immediate treatments along with supervision performed by state apparatus to provide excellent public services. The condition of feasible vehicles must fulfill the technical requirements in accordance of legislation. This research is aimed to identify and analyze the technical supervision on the Feasibility Test for Inter-City Bus undertaken by Malang Department of Transportation in the Office of Technical Motorized Vehicle Test Unit and also in Landungsari Bus Station, as well to identify obstacles that occur and the efforts made by Department of Transportation when carrying out supervision on the Feasibility Tests. This research is a juridical empiric study that used sociological juridical approach. The primary and secondary data were obtained by the author by implementing interview and observation methods, and the techniques of literary study. The author analyzed the obtained data by using qualitative descriptive technique and compiled by the method of deductive reasoning. The research results indicate that the substance of regulation on the on-route public vehicle testing in overall has been effective, but in term of supervision had no been optimal yet that caused by internal and external factors. Supervision on the feasibility Tests for inter-city bus in Landungsari Bus Station also has not done yet, so that the implementation of Article 50 letter a in the Gazette on the Explanation of Government Regulation No. 74 of 2014 has not been effective. It causes in a legal effect of this regulation is that the society are still unaware to the importance of feasibility Tests, as well the fact that there still a lot brokers who offer shortcut to pass the test, around the office of Technical Operator Unit of Vehicle Testing in Malang City.
