Abstract
Dalam penulisan skripsi ini, penulis mengangkat tentang implementasi Pasal 8 Ayat 1 Huruf E Undang-Undang Nomor 8 Tahun 1999 Tentang Perlindungan Konsumen terkait pelaku usaha kerupuk pasir yang tidak jujur dalam pelabelan komposisi bahan pembuat produk pangan. Pilihan tema tersebut dilatar belakangi oleh pelaku usaha kerupuk pasir yang memalsukan labelnya agar produknya laku di pasaran, hal ini dapat merugikan konsumen secara luas karena bahan yang terkandung dalam kerupuk pasir dapat berbahaya bagi kesehatan tubuh apabila dikonsumsi secara terus menerus. Skripsi ini mengangkat rumusan masalah: (1) Bagaimana implementasi Pasal 8 Ayat 1 Huruf E Undang-Undang Nomor 8 Tahun 1999 Tentang Perlindungan Konsumen terkait pelaku usaha kerupuk pasir yang tidak jujur dalam pelabelan komposisi bahan pembuat produk pangan di Kota Malang? (2) Apa faktor penghambat yang dihadapi oleh Dinas Kesehatan Kota Malang dalam melaksanakan Pasal 8 Ayat 1 Huruf E Undang-Undang Nomor 8 Tahun 1999 Tentang Perlindungan Konsumen terkait pelaku usaha yang tidak jujur dalam pelabelan komposisi bahan pembuat produk pangan di Kota Malang? (3) Apa upaya yang dilakukan oleh Dinas Kesehatan Kota Malang untuk melaksanakan Pasal 8 Ayat 1 Huruf E Undang-Undang Nomor 8 Tahun 1999 Tentang Perlindungan Konsumen terkait pelaku usaha yang tidak jujur dalam pelabelan komposisi bahan pembuat produk pangan di Kota Malang? Penulisan skripsi ini merupakan penelitian hukum empiris dengan metode pendekatan yuridis sosiologis. Lokasi penelitian di Dinas Kesehatan Kota Malang. Populasi yang digunakan adalah seluruh pegawai Dinas Kesehatan Kota Malang dan sampelnya adalah Dyah Setyatie Kepala Seksi Makanan dan Minuman Dinas Kesehatan Kota Malang, Oky Setyawan Staf Seksi Makanan dan Minuman Dinas Kesehatan Kota Malang, pelaku usaha kerupuk pasir, dan konsumen terkait. Data primer dan sekunder yang diperoleh penulis akan dianalisis dengan teknik deskriptif kualitatif. Berdasarkan hasil penelitian, implementasi Pasal 8 Ayat 1 Huruf E Undang- Undang Nomor 8 Tahun 1999 Tentang Perlindungan Konsumen terkait pelaku usaha kerupuk pasir yang tidak jujur dalam pelabelan komposisi bahan pembuat produk pangan masih kurang efektif karena masih terdapat kelonggaran bagi pelaku usaha yang melakukan pelanggaran. Faktor penghambat dibagi menjadi dua yaitu faktor internal dan faktor eksternal. Upaya yang dilakukan Dinas Kesehatan Kota Malang adalah melakukan penyuluhan kepada pelaku usaha & masyarakat, penyebaran pamflet kepada masyarakat, dan pengawasan serta koordinasi dengan Disperindag dan puskesmas di Kota Malang.
English Abstract
In writing this thesis, the writer raised about the implementation of Article 8, Paragraph 1 Letter E of Law No. 8 of 1999 on Consumer Protection related to business actors of pasir cracker fraudulent in labeling the composition of materials for food products. The theme selection was motivated by business actors of pasir cracker who falsified their labels so that their products are sold in the market, it could harm consumers widely because of the material contained in the crackers can be hazardous to health if consumed continuously. This thesis raised the formulation of the problem: (1) How is the implementation of Article 8, Paragraph 1 Letter E of Law No. 8 of 1999 on Consumer Protection related to business actors of pasir cracker fraudulent in labeling the composition of materials for food products in Malang? (2) What is the obstacles faced by the Health Service of Malang in implementing Article 8, Paragraph 1 Letter E of Law No. 8 of 1999 on Consumer Protection related to business actors fraudulent in labeling the composition of materials for food products in Malang? (3) What efforts done by Malang City Health Department to implement Article 8, Paragraph 1 Letter E of Law No. 8 of 1999 on Consumer Protection related to business actors fraudulent in labeling the composition of materials for food products in Malang? The writing of this thesis was empirical legal research with a sociological juridical approach. The location of the research was done in Health Department Malang City. The population were all employees of Malang City Health Department and the sample were Dyah Setyatie Section Head of Food and Beverage Malang City Health Department, Oky Setiawan Staff Section of Food and Beverage Health Agency of Malang, business actors of pasir cracker, and consumers concerned. Primary and secondary data obtained by the writer will be analyzed with descriptive qualitative technique. Based on the research results, the implementation of Article 8, Paragraph 1 Letter E of Law No. 8 of 1999 on Consumer Protection related to business actors of pasir cracker fraudulent in labeling the composition of materials for food products are less effective because there is still leeway for business actors to commit violations. Inhibiting factors are divided into two: internal factors and external factors. Efforts made by Malang City Health Department were outreach to the business actor and society, dissemination of pamphlets in public, supervision, and coordination with Disperindag Malang City and health center in Malang.
