Abstract
Maraknya jual beli obat-obatan di dunia maya khususnya media sosial membuat pemerintah semakin gencar melakukan pembaharuan hukum terutama dibidang perlindungan konsumen. Semakin banyaknya toko-toko online (onlineshop) yang menjual obat-obatan impor tanpa izin edar, salah satunya obat Isotretinoin adalah alasannya. Berdasarkan Pasal 8 ayat (1) Huruf (i) Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen, menerangkan bahwa pelaku usaha seharusnya mencantumkan keterangan mengenai obat yang diperjualbelikan secara jelas, namun obat ini tidak memiliki keterangan. Berdasarkan Undang-Undang Nomor 36 Tahun 2009 tentang Kesehatan juga mengatur bahwa obat yang dapat diedarkan adalah obat yang telah memiliki izin edar dan obat Isotretinoin ini belum memiliki izin. Dan berdasarkan Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik, setiap pelaku usaha yang memperjualbelikan produk secara online harus memberikan keterangan yang jelas. Oleh sebab itu, maka diharapkan terdapat pengaturan secara lebih jelas menyangkut perlindungan hukum bagi konsumen atas obat Isotretinoin yang beredar secara online.
English Abstract
Rapid transaction of medicines or drugs by online especially on social media made government intensively reforms the law in the field of consumer protection. Many online shops which selling their import drugs without permission like Isotretinoin is the reason why government works hard to give the best protection to the consumer. Based on Article Number 8 Clause (1) point (i) Law Number 8 Year 1999 about Consumer Protection, the sellers should attach detail information of drugs clearly, but unfortunately Isotretinoin has no detail information for consumer. Based on Law Number 36 Year 2009 about Health, medicines that could be distributed legally are those who already have the permission and Isotretinoin yet has no permission. Based on Law Number 11 Year 2008 about Information and Electronic Transaction, every single online seller should give clear information about their products. Thus, hopefully there will be a clear regulation about law protection to consumer from Isotretinoin online selling.
