Abstract
Pada skripsi iini penulis mengangkat permasalahan perlindungan konsumen jasa sistem pembayaran mengenai perlindungan hukum bagi nasabah dalam perjanjian penerbitan kartu kredit. Karena dalam jasa sistem pembayaran dan penerbitan kartu kredit pihak bank dalam memberikan perlindungan nasabah berdasarkan Undang – Undang Perlindungan Konsumendan Peraturan Bank Indonesia No. 16/PBI/2014 atau bank memberikan perlindungan dengan proses tersendiri. Berdasarkan hal tersebut diatas, karya tulis ini bertujuan untuk: 1) Mengidentifikasi, mendeskripsikan dan menganalisis Penerapan PBI No. 16/PBI/2014 oleh pihak bank dalam memberikan perlidungan konsumen jasa sistem pembayaran mengenai perlindungan hukum bagi nasabah dalam perjanjian penerbitan kartu kredit di Kantor Wilayah Jakarta 2 PT. Bank Rakyat Indonesia (Persero). 2) Mengidentifikasi, mendeskripsikan dan menganilisis faktor penghambat dan upaya penyelesaian sengketa dalam Penerapan PBI No. 16/PBI/2014 tentang Perlindungan Konsumen Jasa Sistem Pembayaran Mengenai Perlindungan Hukum Bagi Nasabah Dalam Perjanjian Penerbitan Kartu Kredit. Penelitian ini menggunakan metode yuridis empiris dengan metode pendekatan yuridis sosiologis. Dari hasil penelitian dengan metode yuridis empiris penulis dapat memperole jawaban dari rumusan masalah yaitu penerapan perlindungan konsumen jasa sistem pembayaran mengenai perlindungan hukum bagi nasabah dalam perjanjian penerbitan kartu kredit di Kantor Wilayah Jakarta 2 PT. Bank Rakyat Indonesia (Persero) berdasarkan penerapan Peraturan Bank Indonesia No. 16/PBI/2014. Perihal judul sebagian besar Kantor Wilayah Jakarta 2 Bank Rakyat Indonesia telah melaksanakan dengan maksimal. v Faktor pendukung Penerapan PBI No. 16/PBI/2014 oleh pihak bank dalam memberikan perlindungan kosnumen jasa sistem pembayaran mengenai perlindungan hukum bagi nasabah dalam perjanjian penerbitan kartu kredit meliputi kerja keras dari pimpinan dan staff serta karakter nasabah yang kooperatif dalam memahami perjanjian penerbitan kartu kredit. Faktor penghambat Penerapan PBI No. 16/PBI/2014 oleh pihak bank dalam memberikan perlindungan konsumen jasa sistem pembayaran yaitu faktor yang mengacu pada Peraturan Bank Indonesia sehingga Undang – Undang Perbankan hanya mengatur perlindungan nasabah.
English Abstract
In this paperwork, the writer raises the issues on Payment System Consumer Protection with regard to Legal Protection for Customers in the Credit Card Issuance Agreement. In the payment system services and issuance of credit bank, banks provides customer protection under the Consumer Protection Law and Bank Indonesia Regulation No. 16/PBI/2014 or protection in a separate process. Based on the above, this paperwork is intended to: 1) identify, describe and analyze the Implementation of Bank Indonesia Regulation No. 16/PBI/2014 oleh by the bank in providing payment system consumer protection with regard to Legal Protection for customers in the credit card issuance agreement at Jakarta Regional Office 2 PT. Bank Rakyat Indonesia (Persero). 2) identify, describe and analyze the hindering factors and efforts in resolving dispute arising in the Implementation of Bank Indonesia Regulation No. 16/PBI/2014 on Payment System Consumer Protection with regard to Legal Protection for Customers in the Credit Card Issuance Agreement. This research applied the juridical-empirical method and juridical-sociological approach method. Based on the research outcome with juridical empirical method, the researcher has was able to identify the solution to research issues that is the implementation of PAYMENT SYSTEM CONSUMER PROTECTION WITH REGARD TO LEGAL PROTECTION FOR CUSTOMERS IN THE CREDIT CARD ISSUANCE AGREEMENT at Jakarta Regional Office 2 PT. Bank Rakyat Indonesia ( Persro) in line with the implementation of Bank Indonesia Regulation No. 16/PBI/2014. Most of Jakarta Regional Offices 2 of Bank Rakyat Indonesia have maximized their efforts associated with this current issue. The supporting factors in the implementation of bank indonesia regulation no. 16/pbi/2014 by the bank in providing payment system consumer protection with regard to legal protection for customers in the credit card issuance agreement involve the hard work by the managers including their staff and cooperative characters of customers in understanding the credit card issuance agreement. The hindering factor in the implementation of Bank Indonesia Regulation No. 16/PBI/2014 by the bank in providing payment service consumer protection is those concerned with Bank Indonesia Regulation, as a consequence Banking Law deals only with the customer protection.
