Abstract
Pada penulisan skripsi ini penulis mengangkat judul Kekosongan Hukum Pengaturan tentang Tindak Pidana Penyelundupan Manusia dengan Objek Pengungsi. Penelitian ini dilatar belakangi adanya kekosongan hukum terhadap pengaturan tindak pidana penyelundupan manusia dengan objek pengungsi di Indonesia. Kekosongan ini adalah dapat dilihat dari peran dari pelaku tindak pidana yang belum diatur di Indonesia, unsur perbuatan yang membahayakan keselamatan korban tindak pidana (pengungsi), dan pengaturan terhadap status pengungsi di Indonesia. Berdasarkan kekosongan hukum ini akan dapat dilihat urgensi dari pengaturan terhadap kekosongan hukum ini untuk memberikan unsur keadilan dan kepastian hukum terhadap pelaku dan terhadap korban dari tindak pidana penyelundupan manusia. Berdasarkan hal tersebut, penulisan ini mengambil rumusan masalah: (1) Apa urgensi pengaturan kekosongan hukum tentang tindak pidana penyelundupan manusia dengan objek pengungsi di Indonesia? (2) Bagaimanakah reduksi pengaturan penyelundupan manusia dengan objek pengungsi untuk mengisi kekosongan hukum di Indonesia? Kemudian Skripsi ini menggunakan metode penelitian Yuridis Normatif dengan menggunakan metode pendekatan perundang-undangan dan konseptual. Bahan hukum primer, sekunder dan tersier yang telah terkumpul akan dianalisa dengan metode analisa deskriptif dan mencari jawaban berdasarkan permasalahan hukum yang diangkat. Berdasarkan hasil dari penelitian dengan metode tersebut penulis memperoleh jawaban dari permasalahan dalam penelitian ini. Pertama, berdasarkan kekosongan hukum yang ada sangat penting untuk memberikan aturan yang mengatur masalah penyelundupan manusia dengan objek pengungsi untuk memberikan keadilan dan kepastian hukum terhadap pelaku dan korban dari tindak pidana. Kedua, untuk mengisi kekosongan hukum diperlukan memasukan kualifikasi unsur perbuatan materiil dan unsur pengungsi.
English Abstract
In writing this study, the writer took the title Void on Law Arrangement of the People Smuggling Criminal Offense with Refugees Object. The background of this study started on their legal void against the crime of human smuggling arrangements with the refugees object in Indonesia. This void can be seen from the criminal role that has not been set up in Indonesia, the element acts that endanger the safety of crime victims (refuge), and the regulation of refugee status in Indonesia. Based on this legal void, it will be able to see the urgency of the regulation against this legal void to provide a justice element and legal certainty to the perpetrator and the victim of the human smuggling crime. Accordingly, this research took the formulation of the problem: First, What is the urgency of setting a legal vacuum on the crime of people smuggling with the object of refugees in Indonesia? Second, How is the reduction of human smuggling arrangements with the object of refugees to fill the legal vacuum in Indonesia? Then this thesis using normative juridical research methods using the Statue approach and conceptual approach. Primary, secondary and tertiary legal materials that has been collected will be analyzed with descriptive analysis method and seek answers based on the legal issues raised. Based on the results of study, by using these methods the writer obtained the objectives of this study. First, the existing legal void is very important to provide rules which governing the issue of human smuggling with the refugees object to give justice and legal certainty to the perpetrators and crime victims. Second, filling the legal vacum is required to enter the qualifying elements of the material acts and elements refugees.
