Abstract
Pada skripsi ini, penulis mengangkat permasalahan faktor penyebab tindak pidana kekerasan fisik yang dilakukan oleh suami terhadap istri. Pilihan tema ini dilatar belakangi oleh banyaknya kasus kekerasan dalam rumah tangga khususnya kekerasan fisik yang dilakukan oleh suami kepada istri. Adanya undang-undang tentang penghapusan kekerasan dalam rumah tangga tidak serta merta kemudian menurunkan angka kekerasan fisik. Sehingga diperlukan penelitian untuk mengetahui hal yang menyebabkan kekerasan fisik yang dilakukan suami terhadap istri serta upaya yang harus dilakukan untuk menanggulanginya. Berdasarkan hal tersebut diatas, skripsi ini mengangkat rumusan masalah : (1) Apa faktor penyebab terjadinya tindak pidana kekerasan fisik yang dilakukan oleh suami terhadap istri? (2) Bagaimana upaya yang dilakukan oleh pihak kepolisian Unit Pelayanan Perempuan dan Anak Polres Sidoarjo dalam tindak pidana kekerasan fisik yang dilakukan oleh suami terhadap istri ? Kemudian skripsi ini menggunakan metode yuridis empiris dengan metode pendekatan yuridis kriminologis, sumber data primer dan sekunder yang diperoleh penulis akan dianalisis dengan menggunakan teknik deskriptif analitis yaitu mengolah/menganalisa hasil wawancara dikaitkan dengan teori-teori didalam literatur hingga didapatkan kesimpulan yang sesuai dengan rumusan masalah. Dari hasil penelitian, diperoleh jawaban atas permasalahan yang ada, bahwa beberapa faktor yang menyebabkan terjadinya tindak pidana kekerasan fisik yang dilakukan oleh suami terhadap istri, baik faktor yang berasal dari internal, yaitu dari dalam diri pelaku dan faktor yang berasal dari eksternal, yaitu dari faktor luar yang kemudian mempengaruhi pelaku untuk melakukan kekerasan fisik terhadap istrinya. Kemudian upaya yang dilakukan oleh pihak kepolisian Unit Pelayanan Perempuan dan Anak Polres Sidoarjo dalam tindak pidana kekerasan fisik yang dilakukan oleh suami terhadap istri ada dua upaya, yaitu upaya preventif guna mencegah terjadinya tindak pidana kekerasan fisik yang dilakukan oleh suami terhadap istri dan upaya represif yakni penanganan ketika tindak pidana kekerasan fisik yang dilakukan oleh suami terhadap istri sudah terjadi. Dari hasil pembahasan diatas, penulis merekomendasikan kepada pemerintah untuk mensosialisasikan Undang-Undang Penghapusan Kekerasan Dalam Rumah Tangga dan memberikan tempat perlindungan bagi korban, kepada masyarakat untuk turut pro aktif dalam mencegah dan menanggulangi kekerasan dalam rumah tangga di lingkungan sekitar, serta kepada kepolisian untuk mengoptimalkan peran Babinkamtibmas dan membangun kerjasama dengan lembaga perlindungan perempuan guna menangani kasus kekerasan fisik dalam rumah tangga.
English Abstract
In this paper, the authors raised the issue of the factors causing the crime of physical violence committed by a husband against his wife. The background of this theme options by the number of cases of domestic violence, especially physical violence committed by the husband to the wife. The existence of legislation on the elimination of domestic violence are not necessarily then reduce the number of physical violence. So that the necessary research to determine the causes of physical violence committed husband to wife and efforts should be done to mitigate them. Based on the above, this paper raised the formulation of the problem: (1) What are the causes of the crime of physical violence committed by a husband against his wife? (2) How is the effort made by the police units for women and children in the Sidoarjo Police criminal acts of physical violence committed by husbands against wives ? Then this paper using the method of juridical empirical juridical approach criminological, sources of primary and secondary data obtained by the author will be analyzed by using analytic descriptive processing / analyzing the interview results associated with the theories in literature until it was concluded that in accordance with the formulation of the problem. From the research results, obtained the answers to the problems, that some of the factors that lead to criminal acts of physical violence committed by a husband against his wife, both factors derived from the internal, from inside actors and factors that come from external sources, ie from factor beyond that then affect the perpetrator to commit physical violence against his wife. Then the efforts made by the police units for women and children Police Sidoarjo in criminal acts of physical violence committed by a husband against his wife have two attempts, namely preventive measures to prevent the crime of physical violence committed by a husband against his wife and repressive efforts namely handling when the criminal acts of physical violence committed by husbands against wives has occurred. From the discussion above, the authors recommend to the government to socialize the Law on the Elimination of Domestic Violence and provide shelter for the victims, to the people to participate pro-active in preventing and combating domestic violence in the neighborhood, as well as to the police to optimize the role Babinkamtibmas and develop cooperation with the protection of womens organizations in order to handle cases of physical violence in the domestic.
