Abstract
Pada skripsi ini, penulis mengangkat permasalahan upaya pencegahan penyalahgunaan wewenang teknik penyamaran dalam mengungkap tindak pidana narkotika. Pilihan tema ini dilatar belakangi oleh adanya beberapa kasus pidana yang menjerat anggota kepolisian yang memiliki kewenangan untuk melaksanakan teknik penyamaran dalam mengungkap tindak pidana narkotika. Adanya kewenangan khusus yang diberikan oleh Undang-Undang Narkotika terhadap penyidik kepolisian justru pada perkembangannya sering disalahgunakan. Sehingga kemudian diperlukan upaya pencegahan agar dimasa yang akan datang dapat meminimalisir terjadinya kasus pidana narkotika yang menjerat anggota kepolisian. Berdasarkan hal tersebut diatas, skripsi ini mengangkat rumusan masalah : (1) Apa saja kendala yang dihadapi Satuan Reserse Narkoba Polres Sidoarjo dalam melaksanakan upaya pencegahan penyalahgunaan wewenang teknik penyamaran untuk mengungkap tindak pidana narkotika? (2) Bagaimana upaya untuk mencegah penyalahgunaan wewenang teknik penyamaran dalam mengungkap tindak pidana narkotika di Satuan Reserse Narkoba Polres Sidoarjo? Kemudian skripsi ini menggunakan metode yuridis empiris dengan metode pendekatan yuridis sosiologis, sumber data primer dan sekunder yang diperoleh penulis akan dianalisis dengan menggunakan teknik deskriptif analitis yaitu mengolah/menganalisa hasil wawancara dikaitkan dengan teori-teori didalam literature hingga didapatkan kesimpulan yang sesuai dengan rumusan masalah. Dari hasil penelitian, diperoleh jawaban atas permasalahan yang ada, bahwa beberapa kendala yang dihadapi Satreskoba Polres Sidoarjo dalam melaksanakan upaya pencegahan penyalahgunaan wewenang teknik penyamaran, yakni karena adanya kendala internal dan eksternal. Kendala internal ini muncul berasal dari dalam diri tiap petugas yang melaksanakan tugas penyamaran, sedangkan kendala eksternal ini muncul berasal dari luar diri petugas yang melaksanakan tugas penyamaran. Kemudian upaya untuk mencegah penyalahgunaan wewenang teknik penyamaran dalam mengungkap tindak pidana narkotika dilakukan dengan mengunakan upaya-upaya preventif dan represif. Upaya pencegahan preventif ini dilakukan dengan melakukan tindakan yang bersifat pembinaan, pendidikan, pengarahan dan ancaman sanksi. Sedangkan upaya pencegahan represif ini dilakukan dengan melakukan penerapan sanksi pidana, sanksi disiplin maupun sanksi kode etik profesi Polri.
English Abstract
In this paper, the authors raised the issue of efforts abuse prevention authority of disguise technique in reveals crime of narcotics. The choice of this theme based on some criminal case that ensnared some members of the police who have the authority to carrying out disguise techniques in reveals crime of narcotics. The existence of a special authority given by the narcotics law to police investigators often abused precisely in its development. So then the necessary efforts to prevent so hat in the future can minimize the occurrence of narcotics criminal cases that ensnare members of the police. Based on these thing, this paper raised the formulation of the problem: (1) What are the constrainst that faced by Police Drugs Investigation Unit Sidoarjo in carrying out efforts abuse prevention authority of disguise techniques to reveals crime of narcotics? (2) How to effort abuse prevention authority of disguises techniques in reveals crime of narcotics in Police Drugs Investigation Sidoarjo Unit? Then this paper is using the method of empirical juridical with method sociological juridical approach, the primary source and secondary data that obtained by the author will be analyzed by using analytic descriptive that is processing/analyzing the interview results associated with the theories in literature until it was concluded that in accordance with the formulation of the problem. From the research results, obtained the answers for the problems that exists, that some of the constraints that faced by Satreskoba Sidoarjo Police in carrying out efforts abuse prevention authority of disguise techniques, spesifically because of internal and external constraints. This internal constraints come up from the insiede its self each officer that carrying out undercover work, while the external constraints have come up from beyond the self of officers who carrying out undercover work. Then the efforts abuse prevention authority of disguise techniques in reveals crime of narcotics carried out with the use of preventive measures and repressive measures. Preventive effort is done by act that are coaching, education, instruction and the threat of sanctions.
