Abstract
Penulis mengangkat permasalahan tentang efektifitas pasal 2 Permendag RI No. 46/2009 mengenai pemberian Surat Izin Usaha Perdagangan (SIUP) bagi Usaha Mikro, Kecil, dan Menengah (UMKM) di Kota Batu. Pilihan tema tersebut dilatarbelakangi banyaknya UMKM yang belum memiliki SIUP namun telah melakukan kegiatan perdagangan. Yang menyebabkan belum efektifnya pasal tersebut. Berdasarkan hal diatas, karya tulis ini mengangkat rumusan masalah: (1) Bagaimana efektifitas Pasal 2 Peraturan Menteri Perdagangan Republik Indonesia Nomor: 46/M-DAG/PER/9/2009 Tentang Perubahan Atas Peraturan Menteri Perdagangan Republik Indonesia Nomor: 36/M-DAG/PER/9/2007 Tentang Penerbitan Surat Usaha Perdagangan terhadap pemberian SIUP kepada UMKM di Kota Batu? (2) Apa saja hambatan yang terjadi dan upaya untuk mengatasi hambatan dalam mengurangi jumlah UMKM yang belum memiliki SIUP di Kota Batu? Kemudian penulisan karya tulis ini menggunakan metode Yuridis Empiris dengan metode pendekatan Yuridis Sosiologis. Kota Batu dipilih sebagai lokasi penelitian berdasarkan alasan jumlah UMKM yang terus berkembang secara signifikan dari tahun ke tahun. Data primer dan sekunder yang diperoleh Penulis akan diolah dengan teknik deskriptif kualitatif. Populasi dan sampel diperoleh dari masyarakat di Kota Batu. Dari hasil penelitian dengan metode diatas, penulis memperoleh jawaban atas permasalahan yang ada bahwa Pasal 2 Permendag 46/2009 belum efektif pelaksanaannya di Kota Batu, secara substansi hukum, struktur hukum, dan kultur hukum. Selain itu, PLUT-KUMKM dan BPM mengalami beberapa hambatan seperti keinginan UMKM untuk memiliki SIUP masih rendah, persyaratan permohonan SIUP sulit dipenuhi, praktik calo, instansi tidak memiliki wewenang untuk memaksa UMKM memiliki SIUP, terbatasnya sumber daya manusia pada instansi, dan dana yang terbatas untuk menjalankan program. Namun kedua instansi telah melakukan upaya-upaya untuk mengatasi hambatan tersebut.
English Abstract
The author raised the issue about the effectiveness of Article 2 Permendag No. 46/2009 on the provision of business licenses (SIUP) for micro, small, and medium-sized businesses in Batu city .The choice of theme supported many businesses are not having SIUP but has made trading activities. Causing the article to be ineffective. Based on things above, the work of this writing this raised the formulation problem: (1) How the effectiveness of Article 2 Permendag RI No.: 46/M-DAG/PER/9/2009 About Changes Of Permendag RI No.: 36/M-DAG/PER/9/2007 about Publishing Of Surat Izin Usaha Perdagangan regarding the grant of SIUP on Micro, Small, and Middle Business in Batu city? (2) What obstacles which happened and efforts to overcome obstacles in reducing the number of UMKM not yet having SIUP in Batu city? Then the writing of this work is using the juridical empirical approach method of juridical sociological. Batu city was selected as the location of research based on reason the number of businesses who continue to grow significantly from year to year. The primary and secondary obtained writer to be processed with qualitative descriptive technique. Sample the population and obtained from the community in Batu city. With the methods up from the research, writer elicit a response on the existing problems that Article 2 Permendag 46/2009 had not been effective its implementation in Batu city, from the substance legal , legal structure , and the culture of law. In addition, PLUT-KUMKM and BPM are experiencing some barriers such as UMKM’s desire to have SIUP is still low, the requirement application of SIUP difficult practices are met, calo, agencies did not have the authority to force the UMKM to have SIUP, the limited human resources in the institutions, and limited funds to run the program. But both agencies have done efforts to overcome these obstacles.
