Abstract
Pada skripsi ini, penulis mengangkat permasalahan terkait penerbitan akta kelahiran yang tidak tercantum nama ayahnya. Pemilihan tema tersebut dilatar belakangi oleh adanya permasalahan yang sering terjadi di kalangan masyarakat. Didalam akta kelahiran yang tidak memuat nama ayahnya tersebut sangat berdampak pada tumbuh kembang anak ketika mengetahui akta kelahiran tersebut tidak mencantumkan nama ayahnya. Berdasarkan hal-hal tersebut diatas, maka karya tulis ini mengangkat rumusan masalah : (1) Apa alasan Dinas Kependudukan dan Pencatatan Sipil Kabupaten Nganjuk tidak mencantumkan nama ayah dalam penerbitan akta kelahiran? (2) Bagaimana presepsi orang tua (ayah dan ibu) jika akta kelahiran tidak mencantumkan nama ayah dalam penerbitan akta kelahiran? Penulisan karya ilmiah ini menggunakan metode yuridis empiris dengan metode pendekatan yuridis sosiologis yaitu pendekatan terhadap hukum sebagai suatu norma atau kaidah, dan pendekatan terhadap masyarakat dengan arti melihat realita didalam masyarakat. Bahan hukum primer dan sekunder yang diperoleh penulis akan dianalisi dengan menggunakan teknik deskripsi kualitatif yakni metode analisis data yang menggambarkan atau mendeskripsikan data yang diperoleh melalui wawancara yang kemudian menganalisis kata-kata hasil wawancara dari subyek penelitian, serta merujuk pada perundang-undangan, pendapat para ahli jurnal, skripsi dan penelusuran melalui internet yang dijadikan rujukan dalam menyelesaikan permasalahan hukum yang menjadi objek kajian. Dari hasil penelitian dengan metode di atas, penulis memperoleh jawaban atas permasalahan yang ada bahwa terkait dengan penerbitan akta kelahiran yang tidak mencantumkan nama ayahnya tersebut didasari pada akta perkawinan, sebab akta pernikahan tersebut adalah suatu rujukan awal terkait tentang keabsahan anak tersebut yang dihasilkan dari perkawinan atau sebagai bentuk pengakuan Negara terkait perkawinan tersebut yang mana telah diamanahkan dalam Peraturan Bupati Nganjuk Nomor 25 Tahun 2012 Tentang Persyaratan dan Tata Cara Pendaftaran Penduduk dan Pencatatan Sipil Di Kabupaten Nganjuk Pasal 28 ayat (2) . Anak yang dihasilkan dari perkawinan yang mana tidak dapat menunjukan akta perkawinan tersebut hanya mempunyai hubungan keperdataan dengan ibunya saja sepanjang tidak dapat membuktikan bahwa laki-laki tersebut yang dianggap ayahnya mempunyai hubungan darah dengan anak tersebut.
English Abstract
In this minithesis, the writer raised issues related to the issuance of birth certificates which are not listed his or her fathers name. Selection of the theme background by the problems that often occur in the community. In the birth certificate that does not contain the name of their father greatly affect the development of the children when they find out that birth certificate does not include the name of his father. Based on the above, then this minithesis raised the formulation of the problem: (1) What is the reason the Department of Population and Civil Registration Nganjuk not include the name of the father in the issuance of birth certificates? (2) How does the perception of parents (father and mother) if the birth certificate does not list the fathers name in the issuance of birth certificates? This scientific minithesis using empirical juridical with sociological juridical approach is an approach to the law as a norm or rule, and the approach to the community with a sense of seeing reality in society. Primary and secondary legal materials were obtained by the writer will be analyzed using qualitative description of the techniques of data analysis method that describes the data obtained through interviews were then analyzed the words of the interviews of the subjects of research, as well as referring to the legislation, the opinion of experts journals, minithesis and search through the internet is used as a reference in solving the legal problems that become the object of study. From the results of research by the above method, the writer obtain answers to existing problems that related to the issuance of the birth certificate that does not include the fathers name is based on the marriage certificate, the marriage certificate because it is an initial referral related about the validity of the child resulting from the marriage or as a form of recognition of the State related to the marriage which has been mandated in Nganjuk decree No. 25 of 2012 on the Terms and Procedures for Registration of Population and Civil Registration Nganjuk In Article 28 paragraph (2). Children resulting from the marriage which can not show the marriage certificate only has a civil relationship with his mother alone can not prove that all these men who are considered to have a blood relationship with the father of the child.
