Abstract
Pada skripsi ini penulis mengangkat permasalahan Pengadaan Tanah Bagi Pembangunan Perluasan Area Perlindungan Situs Cagar Budaya. Pengadaan tanah skala kecil diatur Peraturan Presiden Nomor 40 tahun 2014 jo Peraturan Presiden Nomor 71 tahun 2012 yang merupakan peraturan pelaksana dari Undang-Undang Nomor 2 tahun 2012 dan Peraturan Kepala Badan Pertanahan Nasional Nomor 5 Tahun 2012. Merujuk pada peraturan tersebut ada beberapa pilihan prosedur untuk melaksanakan pengadaan tanah skala kecil, sehingga prosedur yang bagaimanakah yang dilalui oleh BPCB selaku instansi yang memerlukan tanah pada pengadaan tanah untuk perluasan area perlindungan situs Candi Kedaton/Sumur Upas tersebut. Rumusan masalah berdasarkan hal tersebut di atas adalah (1) Bagaimana prosedur pelaksanaan pengadaan tanah untuk pembangunan skala kecil Perluasan Area Perlindungan Situs Candi Kedaton/Sumur Upas Di Kabupaten Mojokerto? (2) Apa saja kendala yang dihadapi dalam pelaksanaan pengadaan tanah untuk pembangunan skala kecil Perluasan Area Perlindungan Situs Candi Kedaton/Sumur Upas Di Kabupaten Mojokerto dan bagaimana upaya mengatasi kendala tersebut? Penelitian ini merupakan penelitian yuridis empiris dengan pendekatan yuridis sosiologis. Lokasi penelitian yang dipilih oleh penulis adalah di Kabupaten Mojokerto, dikarenakan pada lokasi tersebut merupakan tempat dimana banyak terjadinya pengadaan tanah demi pembangunan untuk kepentingan umum dalam skala kecil yang dilakukan untuk pembangunan cagar budaya. Data yang digunakan adalah data primer dan data sekunder. Teknik yang digunakan untuk mendapatkan data primer adalah Wawancara mendalam, sedangkan teknik untuk mendapatkan data sekunder adalah teknik dokumentasi. Cara untuk menganalisis data primer adalah dengan menggunakan analisis data kualitatif sedangkan cara untuk menganalisis data sekunder adalah dengan menggunakan analisis logis normatif. Dari hasil penelitian dengan menggunakan metode di atas, penulis memperoleh hasil bahwa prosedur dari pelaksanaan pengadaan tanah bagi pembangunan area perlindungan situs Candi Kedaton/Sumur Upas terdiri dari 4 tahap yaitu tahap perencanaan, persiapan, pelaksanaan dan penyerahan hasil. Pada pelaksanaan pengadaan tanah tersebut tidak sesuai dengan peraturan perundang-undangan tentang pengadaan tanah dikarenakan pembangunan bangunan atap pelindung dilaksanakan sebelum selesainya proses pengadaan tanah. Kendala-kendala yang menghambat terlaksananya pelaksanaan pengadaan tanah tersebut adalah keterbatasan dana, pelaksanaan dari pengadaan tanah tidak terealisasi seluruhnya, Letter C sebagai bukti kepemilikan tanah, SP2LP, Pertimbangan Teknis BPN dan Surat Keputusan Gubernur terlambat dikabulkan, serta turunnya kepercayaan dari masyarakat.
English Abstract
In this minor thesis the author raised the issue of procurement land for the construction of the expansion of Protection Area of Cultural Heritage Sites. Smallscale land procurement is arranged by Presidential Regulation Number 40 Period 2014 jo Presidential Regulation Number 71 Period 2012 the implementing regulations of the Legislation Number 2 Period 2012 and Regulations of The National Land Agency Chief Number 5 Period 2012. Refer to the legislation there are many choice of procedure to implementation of small scale land procurement, so which one through by BPCB as agency who need land in this land procurement. Problem formulation based on the things above are (1) How the procedure of implementation land procurement for the construction of small scale expansion of protection area of Kedaton Temple/Sumur Upas site in Mojokerto Regency? (2) What are the obstacles faced in implementation land procurement for the construction of small scale expansion of protection area of Kedaton Temple/Sumur Upas site in Mojokerto Regency and how efforts to overcome these obstacles? This study is an empirical juridical research with the juridical sociological approach. Research locations selected by the author is in Mojokerto, due to the location of a place where a lot of the land procurement for development in the public interest that is done on a small scale for the development of cultural heritage. The techniques used to obtain primary data is deep Interviewing, while techniques for getting secondary data is the engineering documentation. How to analyze the primary data is to use qualitative data analysis as a way to analyze secondary data is to use logical normative analysis. From the results of research using the method above, the author obtain result that the procedure of the implementation land procurement for the construction of small scale expansion of protection area of Kedaton Temple/Sumur Upas site consists of 4 (four) stage is planing, preparations, implementation and surrender the result without committe of land procurement. On the implementation land procurement is not in compliance with laws and regulations concerning the land procurement due to the construction of a protective roof buildings was carried out prior to the completion of the procurement process and contrary to the terms of the legal agreement that deal. The obstacle is limitedness of donation, evidence of land ownership is not certivicate yet, the letters late to come, and decrease credibility to BPCB. For the land procurement implementation next expansion area expected can well-executed by related parties in accordance with the applicable legislation.
