Abstract

Indonesia merupakan negara yang memiliki potensi Hak Kekayaan Intelektual (HKI) yang sangat besar, khususnya yang berkaitan dengan Indikasi Geografis. Banyak produk-produk Indikasi Geografis yang terdapat di Indonesia, salah satunya yaitu Apel Batu. Akan tetapi hingga saat ini Apel Batu belum terdaftar sebagai produk Indikasi Geografis. Apabila hal ini dibiarkan tidak menutup kemungkinan suatu saat dapat terjadi sengketa berkaitan dengan klaim sepihak atau pembohongan publik. Indikasi Geografis memberikan kepastian hukum bagi Apel Batu. Pendaftaran menjadi syarat utama agar Apel Batu memperoleh perlindungan hukum. Tujuan dari penelitian untuk mengetahui, mendeskripsikan dan menganalisa terkait hambatan serta upaya yang dilakukan dalam mewujudkan Indikasi Geografis terhadap Apel Batu. Jenis penelitian yang dilakukan yaitu menggunakan jenis yuridis empiris. Penelitian ini menggunakan pendekatan yuridis sosiologis.

English Abstract

Indonesia is a country that has the potential of intellectual property rights (HKI) very great especially with regard to geographical indications. Many products geographical indications which are found in Indonesia one of them is Apel Batu. However until now Apel Batu has not been registered as a product of the geographical indications. If it is to be left as not preclude the possibility that some point will be disputes relating to claim unilateral or public lying. Geographical indications give legal certainty for Apel Batu. The registration becomes a requirement so that an Apel Batu obtain legal protection. The purpose of the research to find out described and analyzes related obstacles as well as the efforts made in manifesting geographical indications against Apel Batu. The kind of research carried out is to use the type of juridical the empiric. This study used the sociological juridical.
