Abstract
Pada skripsi ini, penulis mengangkat permasalahan Kehidupan bermasyarakat merupakan tempat bagi anak-anak, dimana mereka bersosialisasi serta membentuk kepribadian, moral, dan karakter selain di keluarga. Dalam ketentuan pasal 15 Undang-undang Nomor 44 Tahun 2008 Tentang Pornografi dimaksudkan untuk mencegah sedini mungkin pengaruh pornografi terhadap anak yang mengakibatkan tindak pidana persetubuhan pasal 81 Undang-undang Nomor 23 tahun 2003, serta menegaskan kembali terkait dengan perlindungan terhadap anak oleh masyarakat yang ditentukan dalam Undang-Undang. Berdasarkan hal tersebut diatas, karya tulis ini mengangkat rumusan masalah: (1) Bagaimana implementasi pasal 15 Undang-undang Nomor 44 tahun 2008 tentang Pornografi di masyarakat di Kediri? (2)Bagaimana peran serta masyarakat dalam mencegah tindak pidana persetubuhan pasal 81 Undang-undang nomor 23 tahun 2002 tentang perlindungan anak yang dilakukan oleh anak akibat dari pornografi? Kemudian penulisan karya tulis ini menggunakan jenis penelitian yuridis empiris dengan metode pendekatan yuridis sosiologis. Pengambilan data primer maupun sekunder, sumber hukum primer maupun sekunder akan dianalis menggunakan teknik analisis data dengan metode deskriptif analisis Hasil penelitian dengan metode di atas yakni, penulis memperoleh jawaban atas permasalahan yang ada bahwa hukum diciptakan dengan tujuan tertentu, begitu pula dengan undang-undang diciptakan dengan tujuan untuk memberikan kepastian hukum, kemanfaatan, dan keadilan. Peraturan perundang-undangan dapat dilaksanakan dengan baik apabila memenuhi 3 unsur yang saling berkaitan yakni subtansi, struktur, dan budaya. Implementasi pasal 15 Undang-undang Nomor 44 tahun 2008 tentang Pornografi di masyarakat di Kediri belum terlaksana dengan baik. Sedangkan peran serta masyarakat dalam mencegah tindak pidana persetubuhan pasal 81 Undang-undang nomor 23 tahun 2002 tentang perlindungan anak yang dilakukan oleh anak akibat dari pornografi yakni dapat dilakukan secara preventif sebagai upaya pencegahan dan represif sebagai tindak lanjut untuk menanggulangi apabila perkara sudah terjadi. Jadi Anak merupakan generasi penerus bangsa. Ditangan anak masa depan bangsa ini digantungkan. Masalah persetubuhan oleh anak perlu mendapat perhatian dari berbagai pihak terkait seperti orang tua, guru, pemerintah, serta masyarakat sekitar.
English Abstract
In this paper, writer raised the problem of the life of a community is a great place for children, where they socialize and forming the personality of the character, morals, and in addition in the family. The provisions of article 15 Act No. 44 of 2008 About Pornography is intended to prevent the influence of pornography as early as possible against the criminal acts that resulted in the sex.com article 81 Act No. 23 of 2003, as well as reaffirm related to protection of children by the community specified in the Act. Based on the above , this paper raised the formulation of the problem : (1)How does the implementation of article 15 of Law No. 44 of 2008 about Pornography in society in Kediri ? (2)How the role of the society in preventing crime promiscuity section 81 Act No. 23 of 2002 on child protection made by children as a result of pornography? Then this paper writed using a type of research juridical empiric, with the methods approach juridical sociologic. Primary and secondary data, primary and secondary sources of law will be dianalis using techniques of data analysis with descriptive analysis method. The results of research that is, with a method of above writer obtain answers to the existing problems that the law, created by a particular purpose so it is with the act of created with a view to give legal certainty, expedience, and justice. The legislation can be executed well if meet 3 element, namely subtansi, structure, and culture. The implementation of article 15 act no 44 of 2008 on pornography in society in kediri have not run well. Whereas Community participation in preventing the crime promiscuity section 81 Act No. 23 of 2002 on child protection made by children as a result of pornography which can be done in a preventive and repressive as prevention efforts as a follow-up to cope when things have already happened. So Children is the next generation. In the hands of children is the future of this nation are hung. Problem of promiscuity by children need to get attention from various stakeholders such as parents, teachers, Government, as well as the surrounding communities.
