Abstract
Pada skripsi ini, mengangkat permasalahan penggunaan data yang diperoleh dari CCTV dalam membantu penyidik mengungkap terjadinya tindak pidana. Tema ini dilatar belakangi oleh adanya CCTV yang dapat digunakan sebagai alat bukti petunjuk untuk mengungkap pelaku tindak pidana. Penggunaan CCTV sebagai alat bukti petunjuk bagi penyidik tidak sepenuhnya memiliki data yang baik, sehingga dalam hal ini penyidik memberikan syarat-syarat yang diberikan agar data yang diperoleh dari CCTV dapat digunakan dengan baik dalam mengungkap terjadinya tindak pidana. Berdasarkan hal tersebut diatas, skripsi ini mengangkat rumusan masalah: (1) Bagaimana syarat data hasil rekaman Closed Circuit Television (CCTV) yang dapat digunakan oleh penyidik dalam mengungkap terjadinya tindak pidana di Polres Malang Kota? (2) Apa kendala penyidik Polres Malang Kota dalam mengungkap terjadinya tindak pidana dengan data hasil rekaman Closed Circuit Television (CCTV)? (3) Bagaimana upaya penyidik Polres Malang Kota dalam mengatasi kendala terhadap data hasil rekaman Closed Circuit Television (CCTV)? Metode penelitian yang digunakan adalah yuridis empiris dengan metode pendekatan yuridis sosiologis. Bahan hukum primer dan sekunder, yang diperoleh dari hasil wawancara dengan responden, yaitu nara sumber yang telah peneliti tentukan berdasarkan metode purposive sampling yaitu teknik penentuan sampel dengan pertimbangan tertentu. Kemudian teknik analisis data menggunakan deskriptif kualitatif, yaitu data yang dinyatakan dalam bentuk kalimat atas uraian yang mempunyai peranan untuk menjelaskan suatu fenomena sosial yang terjadi. Dari hasil penelitian, diperoleh jawaban atas permasalahan yang ada bahwa syarat yang harus dipenuhi agar data hasil rekaman CCTV dapat digunakan dalam mengungkap terjadinya tindak pidana, yaitu data CCTV yang harus dalam keadaan "status quo", bahwa keadaan yang sekarang harus seperti keadaan yang sebelumnya atau keadaan asli. Data CCTV juga harus diperoleh dari pihak netral agar lebih dipercayai keasliannya oleh penyidik Polres Malang Kota untuk menghindari adanya pemalsuan data hasil rekaman CCTV, hal ini berkaitan dengan jarak waktu penyerahan data hasil rekaman CCTV yang tidak boleh terlalu lama karena hal ini dapat merujuk pada pelaku atau korban tindak pidana untuk melakukan editing video hasil rekaman CCTV. Syarat yang sudah diajukan tersebut ditujukan untuk menghindari terjadinya kendala bagi penyidik Polres Malang Kota berupa hasil rekaman CCTV yang telah mengalami editing, hal ini sangat mungkin terjadi mengingat banyaknya ahli olah digital yang dapat merubah isi data hasil rekaman CCTV seperti pengurangan isi hasil rekaman CCTV yang dilakukan pelaku agar dapat lepas dari tuntutan hukum atau penambahan hasil CCTV oleh korban agar dapat memberatkan tuntutan kepada pelaku tindak pidana. Kendala berikutnya berupa gambar hasil rekaman CCTV yang tidak jelas disebabkan oleh faktor dari dalam dan luar CCTV seperti kualitas kamera CCTV, letak pemasangan CCTV, dan pencahayaan yang masuk pada saat CCTV merekam kejadian. Terakhir, CCTV tidak merekam secara penuh yang disebabkan oleh putusnya sambungan listrik, pelaku merusak kamera CCTV, memori penyimpanan CCTV yang terbatas/penuh, dan pada CCTV yang memakai IP address disebabkan karena pada saat jaringan LAN/WAN mengirimkan data hasil rekaman mengalami gangguan sinyal. Kendala yang dihadapi membuat penyidik Polres Malang Kota membuat upaya yang digunakan dalam mengatasi kendala terhadap data hasil rekaman CCTV, yaitu memanggil ahli IT (information technology) yang dibutuhkan untuk membantu mengidentifikasi data hasil rekaman CCTV. Ahli IT ini dapat berasal dari dosen/mahasiwa pada universitas yang ada di Kota Malang. Apabila upaya ini masih belum menemui titik terang maka penyidik polres Malang Kota akan menyerahkan penyidikan pada subbid TI Polda Jatim sesuai dengan hierarki yang telah dijelaskan dalam Peraturan Kepala Kepolisian Negara Republik Indonesia.
English Abstract
In this thesis, raises up a problem related to the utizilization of data obtained from CCTV in assisting criminal investigator to unveil the occurence of criminal occurence. The theme is backgrounded by the utilization of CCTV as the evidence of the subject of criminal occurence. Utilization of CCTV as the evidence for the investigator is not solely providing good data, therefore in this circumstance the investigator set the requirements so that the data obtained from the CCTV can be utilized in unveiling the criminal occurence. Based on the circumstance above, this thesis is raising up problems: (1) How are the requirements of data obtained from CCTV which can be used by the investigator in unveiling the criminal occurence in Police of Malang City Resort? (2) What are the obstacles that the investigator found in unveiling the criminal occurence in Police of Malang City Resort using data obtained from Closed Circuit Television (CCTV)? (3) How is the effort of investigator of Police of Malang City Resort in overcoming obstacle towards the data obtained from Closed Circuit Television (CCTV)? Furthermore this thesis is using juridical-empirical method with juridical-sociological approach. Primary and secondary legal materials which obtained through interview with the respondent, which the speaker has been determined by the writer based on purposive sampling. Which purposive sampling is a technique in determining sample based on particular consideration. Afterwards the technique of data analysis is using descriptive qualitative method, which by this the data is stated in the form of sentence upon the analysis that explains the occuring social phenomenon. Based on the research using the methods explained above, writer has obtained the answer upon the problems that the requirement which must be fulfilled for the data obtained from CCTV can be utilized in univeiling the criminal occurence is that the data obtained from the CCTV should be in the “status quo”, which it means that recent situation should be in the same as the original situation. Data obtained form CCTV must also be coming from the neutral party for the data can be trusted for its originality by the investigator of Police of Malang City Resort to avoid the falsification of the data obtained from CCTV, this circumstance is related to the length of time of the transfer of the data obtained from CCTV that can not be too long because if so, either the subject or the object are expected to edit the video obtained from CCTV. The requirement is aimed to avoid the obstacle the investigator of Police of Malang City Resort towards the editing done to the CCTV video. In which circumstance, the editing is very likely to happen as there are numbers of digital processing expert which are able to change the data obtained from CCTV, such as subtraction of video data which mainly done by the subject of criminal occurence for they to be freed from criminal indictment, or the augmentation of the video data done by the object of criminal occurence to weigh the indictment against the subject of criminal occurence. The next obstacles is the blurry image resulted by external and internal factors of CCTV such as camera quality, CCTV location, lighting towards CCTV. Lastly, CCTV did not completely record the event caused by the electicity off, CCTV desolation, limited memory of the CCTV camera and network destruption towards the CCTV which uses IP address because of network disruption when LAN/WAN transfers the recording data. The obstacles explained initiate the investigator of Police of Malang City Resort creates the effort to avoid the obstacles in the data obtained from CCTV, such effot is to call of the Information Technology (IT) experts to identify the data obtained from CCTV. Information tchnology experts involved are coming from the lecturers/students of the university across Malang. In case that this effort do not give effect, the investigator of Police of Malang City Resort will handover the investigation to Subsection IT of Police of East Java as corresponding with hierarchy explained in Peraturan Kepala Kepolisian Negara Republik Indonesia.
