Abstract
Penulisan ini membahas tentang sinkronisasi antara Pasal 36 ayat (2) Peraturan Presiden Nomor 12 Tahun 2013 tentang Jaminan Kesehatan terhadap Pasal 23 ayat (1) Undang-undang Nomor 40 Tahun 2004 tentang Sistem Jaminan Sosial Nasional. Dilatarbelakangi dengan adanya perbedaan dari segi bekerjanya aturan hukum di dalam kedua pasal tersebut, Pasal 36 ayat (2) Peraturan Presiden Nomor 12 Tahun 2013 tentang Jaminan Kesehatan bersifat memaksa karena fasilitas kesehatan milik pemerintah dan pemerintah daerah diwajibkan untuk bekerjasama dengan BPJS Kesehatan, sementara dalam Pasal 23 ayat (1) Undang-undang Nomor 40 Tahun 2004 tentang Sistem Jaminan Sosial Nasional, pasal tersebut bersifat mengatur karena fasilitas kesehatan milik pemerintah atau swasta dapat bekerjasama dengan BPJS atau dapat tidak bekerjasama dengan BPJS. Permasalahan tersebut penulis kaji dengan menggunakan jenis penelitian yuridis-normatif dengan menggunakan metode interpretasi secara sistematis. Dari hasil penelitian dapat diketahui bahwa antara Pasal 36 ayat (2) Peraturan Presiden Nomor 12 Tahun 2013 tentang Jaminan Kesehatan dengan Pasal 23 ayat (1) Undang-undang Nomor 40 Tahun 2004 tentang Sistem Jaminan Sosial Nasional tidak sinkron. Dikarenakan pertentangan norma yang terdapat dalam kedua pasal tersebut dan berdasarkan teori pertentangan antara norma hukum, asas lex superior derogat legi inferiori menyatakan bahwa peraturan perundang-undangan yang tingkatnya lebih rendah tidak boleh bertentangan dengan yang lebih tinggi yang mengatur hal yang sama. Apabila sampai terjadi konflik, maka peraturan perundang-undangan yang lebih tinggi akan melumpuhkan peraturan perundang-undangan yang lebih rendah.
English Abstract
This writing is about synchronization between Article 36 paragraph (2) of Presidential Regulation No. 12 Year 2013 on Health Insurance to Article 23 paragraph (1) of Law No. 40 Year 2004 on National Social Security System. Motivated by the differences in terms of the operation of the rule of law in the two articles, Article 36 paragraph (2) of Presidential Regulation No. 12 Year 2013 on Health Insurance coercive because government health facilities and local governments are required to cooperate with Health BPJS, while in Section 23 paragraph (1) of Law No. 40 Year 2004 on National Social Security System, the article is set up for health facilities owned by the government or private sector can cooperate with BPJS or may not cooperate with BPJS. The authors examine the problems with using this type of juridical - normative research using a systematic method of interpretation. From the results of this research is that the Article 36 paragraph (2) of Presidential Regulation No. 12 Year 2013 on Health Insurance with Article 23 paragraph (1) of Law No. 40 Year 2004 on National Social Security System is out of sync. Due to the conflict of norms contained in the second chapter and is based on the theory of conflict between the rule of law, the principle of lex superior derogat legi inferiori stated that the legislation of a lower grade must not conflict with a higher governing the same thing. If until a conflict, then the legislation will cripple the higher laws lower.
