Abstract
Pada Skripsi Ini Penulis Mengangkat Permasalahan Hukum Mengenai Penarikan Diri Negara Anggota Asean Tanpa Adanya Klausula Penarikan Diri Dalam Piagam Asean Sehingga Penulis Menggunakan Konvensi Wina 1969 Sebagai Bahan Acuan. Asean(Association Of South East Asian Nations) Merupakan Suatu Organisasi Internasional Yang Memiliki Keanggotaan Secara Regional Khusus Untuk Negara-Negara Yang Berada Di Kawasan Asia Tenggara. Negara Sebagai Subjek Utama Hukum Internasional Memiliki Kedaulatan Untuk Menentukan Tetap Atau Menarik Diri Dari Keanggotaan Suatu Organisasi Internasional. Piagam Asean Sebagai Instrumen Pokok Aseantidak Mengatur Klausula Penarikan Diri Dari Asean. Sehingga, Apabila Dalam Pelaksanaan, Ternyata Negara Anggota Asean Berkeinginan Untuk Melakukan Penarikan Diri.Konvensi Wina 1969 Tentang Hukum Perjanjian Internasional Mengatur Bahwa Penarikan Diri Secara Sepihak Dari Perjanjian Internasional Yang Tidak Secara Eksplisit Menyebutkannya. Konvensi Wina 1969 Menekankan Aspek Kesepakatan Sebagaimana Asas Pacta Sunt Servanda. Negara Sebagai Pemegang Kedaulatan Memiliki Kemampuan Untuk Menentukan Untuk Tetap Atau Menarik Diri Dari Perjanjian Internasional. Namun, Dalam Perjanjian Internasional Negara Dibatasi Oleh Kedaulatan Negara Pihak Perjanjian Yang Lain Sehingga Negara Tidak Dapat Menarik Diri Secara Sepihak Dari Perjanjian Internasional Yang Tidak Menyebutkan Secara Eksplisit Tanpa Adanya Kesepakatan Dari Semua Pihak Perjanjian. English Abstract
In this the author raised legal issues regarding Withdrawal of ASEAN Member States without a withdrawal clause in the Charter so that the author uses the 1969 Vienna Convention as a reference. ASEAN (Association of South East Asian Nations) is an international organization that has a membership of regionally specific to countries located in Southeast Asia. State as the main subject of international law has the authority to determine to stay or withdraw from membership of an international organization. Such reasons as there is a change in the preferences of interest groups in the country, or due to changes in the organization of international obligations. The case of withdrawal from membership in international organizations that attract attention is the case of Indonesia withdrawal of UN membership on January 20, 1965. This is due to the UN Charter as the basic instrument does not regulate the withdrawal clause of the United Nations. This then raises the question, whether conducted by the withdrawal of Indonesia from the United Nations membership can be done and how the status of Indonesia's membership in the United Nations concerning the absence of withdrawal provisions in the UN Charter. As it is, the ASEAN Charter as the principal instrument does not regulate the withdrawal clause of ASEAN. Thus, if in the implementation, the ASEAN member countries willing to commit withdrawal. Is withdrawal of ASEAN member countries can be done and how the legal consequences arising from the withdrawal.
