Abstract
Penulisan skripsi ini membahas tentang fungsi legislasi Dewan Perwakilan Daerah menuju sistem ketatanegaraan demokratis. Hal ini dilatar belakangi fungsi legislasi DPD dalam original intent pembentukan dalam amandemen ketiga UUD 1945 adalah untuk menjembatani aspirasi daerah dalam kebijakan di pusat, serta untuk melengkapi keberadaan DPR sebagai lembaga legislatif dalam pembentukan Undang-Undang. Namun hal ini masih belum bisa terwujud karena dominasi DPR terlalu besar dalam proses legislasi. Dalam UU 22/2003 serta perubahannya UU 27/2009 mendudukan DPD sebagai lembaga yang lemah yaitu sub-ordinate DPR. Sementara dalam UU 10/2004 serta UU 12/2011 mengatur mekanisme legislasi yang melemahkan DPD. Disisi lain dengan dominasi kekuasaan DPR kinerja DPR tidak sesuai harapan, seperti target UU yang dihasilkan per tahun mengalami penurunan. Padahal hadirnya DPD diharapkan menjadi patner dalam legislasi. Akhirnya pada lahir putusan MK No 92/PUU-X/2012 yang mengembalikan kewenangan DPD dalam mengajukan, ikut membahas RUU dan menyusun Prolegnas. Oleh karena itu perlu diformulasikan secara tepat. Masalah dalam penelitian ini adalah Pertama, bagaimanakah pengaturan fungsi legislasi DPD dari UUD 1945 sampai Putusan Mahkamah Konstitusi Nomor 92/PUU-X/2012. Kedua, Bagaimanakah Fungsi Legislasi DPD menuju sistem ketatanegaraan demokratis. Penulisan skripsi ini yaitu yuridis normatif dengan metode pendekatan perundang-undangan (Statue Approach) dan Pendekatan konseptual (Conceptual Approach). teknik penelusuran bahan hukum dilakukan dengan studi dokumen atau penelitian kepustakaan (Library research).Teknik analisis menggunakan deskriptifanalitis menentukan isi dan makna aturan hukum. Pengaturan legislasi DPD dari UUD 1945 sampai Putusan MK adalah Pertama, Dalam UUD 1945 fungsi legislasi DPD merupakan fungsi legislasi yang terbatas. Kedua, Dalam UU 22/2003 pengaturan mengenai kedudukan DPD lebih terdegradasi, Sementara UU 10/2004 mengatur tentang perencanaan pembentukan Undang-Undang diatur tidak terlalu rinci, lebih banyak diatur dengan Perpres. UU 27/2009 tentang MPR, DPR, DPD dan DPRD terjadi beberapa perluasan, seperti RUU beserta penjelasan, keterangan /naskah akademik. UU 12/2011 tentang Pembentukan Peraturan Perundang-Undangan juga membawa perubahan yang tersusun secara sistematis. Namun, terkait legislasi, pengaturan DPD dalam masih terdapat banyak sekali kelemahan dalam pengejawantahan pasal 22D UUD 1945. Ketiga, Amar Putusan MK No. 92/PUU-X/2012 memperluas legislasi DPD dalam mengajukan, ikut membahas dan Prolegnas serta menggeser paradigma mengenai kedudukan dan model pembahasan RUU. Fungsi Legislasi Dewan Perwakilan Daerah Menuju Sistem Ketatanegaraan Demokratis dilakukan dengan Pertama, formulasi penguatan internal DPD, berupa penguatan kapasitas, strategi hubungan dengan konstituen dan Daerah, dan eksternal berupa hubungan dengan DPR dalam legislasi. Kedua, harmonisasi dan sinkronisasi peraturan perundang-undangan terkait legislasi. Ketiga, dengan Formulasi Legilasi Model Tripartit antara DPR, Presiden dan DPD. Yaitu (1) terkait subyek DPD dalam setiap tahapan pembentukan Undang-Undang dan komposisi dalam setiap tahapan legislasi, kecuali pengundangan dan pengesahan. (2) terkait dengan mekanisme keikutsertaan DPD dalam proses legislasi. Baik dalam mekanisme perencanaan, mekanisme penyusunan, mekanisme pengajuan RUU dari DPR, Presiden maupun DPD, mekanisme pembahasan bersama dengan DPR dan Presiden. (3) terkait formulasi waktu, sebagai kepastian dalam pembentukan Peraturan Perundang-Undangan.
English Abstract
This thesis discusses the legislative function reformulation of Regional Council towards a democratic constitutional system. It is the background of the legislative function of DPD in the original intent of the formation of the third amendment of the 1945 Constitution is to bridge the regional aspirations in the policy at the center, as well as to complement the House of Representatives as a legislative body in the formation of the Act. But it still can not be realized because of the dominance of the House is too big in the legislative process. In Act 22/2003 and its amendment of Law 27/2009 seats the DPD as a weak institution that is a sub-ordinate Parliament. While in Law 10/2004 and Law 12/2011 regulating mechanism that weakens the legislation DPD. Though the presence of DPD is expected to be a partner in the legislation. Finally, the decision of the Court No. 92 born / PUU-X / 2012 which restores the authority of DPD in the filed, to discuss the bill and prepare Prolegnas. Therefore, it needs to be formulated precisely. The problem in this study is the first, how the regulation of the legislative function of the DPD in Constitution until the Constitutional Court Decision No. 92 / PUU-X / 2012. Secondly, How about the Legislation function of Regional Representative towards a democratic constitutional system. This thesis use Statue Approach and the conceptual approach. Search techniques of legal materials or documents studies conducted by the research literature (Library Research) . analysis techniques using descriptive-analytical to determine the content and meaning of the rule of law. The regulation of DPD in the 1945 legislation to the Constitutional Court ruling are, First, in the 1945 legislative function DPD is a legislative function are limited. Secondly, In Law 22/2003 regarding the position of the DPD is degraded, while Law 10/2004 regulates the establishment of planning law is set not too detailed, more governed by regulation. Law 27/2009 on the MPR, DPR, DPD and DPRD been some expansion, such as the bill along with an explanation, a description / academic paper. Law 12/2011 on the Establishment Regulation Legislation also brought changes systematically arranged. However, relevant legislation, regulation DPD in there are many weaknesses in the embodiment of section 22D of the 1945 Constitution Third, Constitutional Court Decision Number 92 / PUU-X / 2012 expand the DPD in submitting, participating in the discussion and Prolegnas and shift the paradigm on the positions and the model bill.
