Abstract
Pada skripsi ini dilatar belakangi oleh adanya perubahan desain konstruksi bangunan yang diajukan oleh PT Petrokimia Gresik selaku penyedia jasa terhadap PT Hutama Karya (Persero) pada saat pelaksanaan kontrak konstruksi proyek Engineering Procurement Construction (EPC) pengembangan pelabuhan. Perubahan desain konstruksi tersebut dilakukan karena desain yang dituangkan dalam pembangunan secara riil tidak sesuai dengan kehendak pihak PT Petrokimia Gresik. Perubahan desain konstruksi bangunan tersebut mengakibatkan PT Hutama Karya mengajukan klaim penambahan biaya dan waktu kepada PT Petrokimia Gresik. Akan tetapi PT Petrokimia Gresik menolak klaim tersebut karena perubahan desain konstruksi bangunan tersebut adalah resiko PT Hutama Karya yang tidak seharusnya mendapatkan tambahan biaya dan waktu. Penelitian ini adalah penelitian hukum empiris dengan pendekatan yuridis sosiologis. Lokasi penelitian yang diakukan dalam penelitian ini adalah di PT Hutama Karya (Persero) kantor wilayah VII Kota Surabaya dan PT Petrokimia Gresik, serta Jurusan teknik sipil Fakultas Teknik Universitas BRawijaya Malang, dengan teknik purposive sample yang akan digunakan adalah salah satu anggota penyelesai sengketa PT Hutama Karya (Persero) dan PT Petrokimia Gresik, serta salah satu dosen teknik sipil Universitas Brawijaya. Data primer, sekunder, dan tersier yang diperoleh akan dianalisi dengan metode deskriptif kualitatif. Dari hasil penelitian dengan metode tersebut penulis memperoleh jawaban atas permasalahan yang ada bahwa faktor-faktor penghambat penyelesaian sengketa antara PT Hutama Karya (Persero) dengan PT Petrokimia Gresik dalam perbedaan interpretasi klausul kontrak tentang perubahan desain konstruksi bangunan sulitnya menentukan suatu perubahan desain konstruksi adalah resiko PT Hutama Karya (persero) atau resiko PT Petrokimia Gresik selaku pengguna jasa. Upaya yang dilakukan oleh PT Hutama Karya (Persero) dengan PT Petrokimia Gresika dalam proses penyelesaian sengketa dengan membentuk dan menggunakan tim peneliti ahli konstruksi bangunan dari akademisi Teknik Sipil Institut Teknologi Bandung dan Institut Teknologi Sepuluh Nopember Surabaya yang bersifat independen. Penulis memberikan saran bahwa industri jasa konstruksi dan pengguna jasa konstruksi hendaklah dalam melakukan penyusunan kontrak dan kelengkapannya secara lebih cermat, teliti, dan tekun serta menyelesaikan sengketa dalam perbedaan interpretasi pada klausul kontrak konstruksi sesuai dengan aturan yang berlaku
English Abstract
In this thesis, exposed their lack of opportunities by Change of the design construction proposed by PT Petrokimia Gresik as service providers against PT Hutama Karya (Persero) at the time of execution of the contract construction project Engineering Procurement Construction (EPC) the development of the port. Change in the design of building construction made because of the design construction of poured in real terms does not comply with the will of PT Petrokimia Gresik. The change in the design of building construction resulted in PT Hutama Karya claim adding cost and time to PT Petrokimia Gresik. But, PT Petrokimia Gresik denied the claim because the change of design construction is the risk PT Hutama Karya were not supposed to get additional cost and time. This research is empirical legal research with the juridical sociology approach. The location of the research in this study is in PT Hutama Karya (Persero) region VII Office city of Surabaya and PT Petrokimia Gresik, as well as the Department of Civil Engineering, Faculty of Engineering University of Brawijaya Malang, purposive sample with techniques that will be used is the one member of the dispute resolver PT Hutama Karya (Persero) and PT Petrokimia Gresik, as well as one of the professors of Civil Engineering University of Brawijaya. Data primary, secondary, and tertiary obtained be analysis with a method of descriptive qualitative. From the results of research with the above methods, the author answers to existing problems that factor inhibitor dispute settlement between PT Hutama Karya (Persero) and PT Petrokimia Gresik in differences of interpretation of clauses contract regarding change of the design construction difficulty to determine a change in the design of building construction is the risk of PT Hutama Karya (persero) or PT Petrokimia Gresik as the owners of services. The efforts made PT Hutama Karya (Persero) and PT Petrokimia Gresik in the process of dispute settlement with form and use the research team construction experts from academics of civil engineering, Institut Teknologi Bandung and Institut Teknologi Sepuluh Nopember Surabaya who are independent. The authors advise that Industry construction service and service the owners construction let in drafting contracts and its furnishings are more careful, thorough, and diligent as well as resolve disputes in a difference of interpretation on contract clauses construction in accordance with the applicable rules.
