Abstract
Dengan kemajuan teknologi ditemukan cara fertilization in vitro dimana seseorang dapat memiliki keturunan dengan cara tidak alamiah atau tidak wajar. Fertilization in vitro juga melibatkan pihak ketiga yaitu surrogate mother, dimana sperma dan ovum dari pasangan suami isteri di masukkan kedalam rahimnya. Di Indonesia sudah banyak orang yang melakukan fertilization in vitro namun belum ada yang menjadi masalah hukum. Sedangkan di Amerika banyak masalah yang timbul akibat melakukan fertilization in vitro dengan surrogate mother, sehingga perlu melakukan perbandingan hukum untuk menemukan hukum dan bersikap kritis terhadap hukum sendiri. Penelitian ini bertujuan untuk menemukan, menganilis, dan mengkaji hukum pidana Indonesia dan bagaimana seharusnya perumusan norma ketentuan pidana mengatur tentang fertilization in vitro yang dilakukan oleh surrogate mother. Metode yang dipergunakan dalam penulisan skripsi ini adalah yuridis normatif sedangkan pendekatan yang digunakan adalah statute approach, conceptual approach, comparative approach. Berdasarkan penelitian yang telah dilakukan oleh penulis, dapat disimpulkan bahwa di Indonesia belum ada peraturan hukum mengenai Surrogate mother dalam fertilization in vitro sehingga dilakukan perbandingan hukum di negara Amerika Serikat yang sudah ada peraturan hukum mengenai Surrogate mother. Mengingat begitu banyak problema yang akan timbul dari surrogate mother,maka di Indonesia hanya dapat mengadili perbuatan Surrogate mother tergantung dari tindak pidana yang ia lakukan, bukan berdasarkan perbuatan melakukan fertilization in vitro yg dilarang dalam undang-undang kesehatan, namun tidak diseertai oleh ketentuan pidana, sedangkan seharusnya di Indonesia pengaturan hukum pidana mengenai surrogate mother dalam fertilization in vitro dibuat peraturan khusus setara undang-undang atau mengamandemen undangundang kesehatan untuk mengatur praktek surrogate mother dalam melakukan fertilization in vitro.
English Abstract
Hersen Monarchy, Criminal Law, Criminal Law Reform Indonesia 2012 Related With In Vitro Fertilization Surrogate Mother Carried Out. With the technological advancement in vitro fertilization found a way in which one can have offspring with no way natural or unnatural. In vitro fertilization involves a third party that is a surrogate mother, where the sperm and ovum from the couple entered into her womb. In Indonesia, many people who do in vitro fertilization but no one has become a matter of law. While in America a lot of problems that arise due to perform in vitro fertilization with a surrogate mother, so it needs to be done to discover the law of comparative law and was critical of the law itself. This study aims to find, analysis, and examines the Indonesian criminal law and how it should be the formulation of norms regulating the criminal provisions in vitro fertilization is carried by a surrogate mother. The method used in this paper is normative whereas the approach used is the statute approach, conceptual approach, the comparative approach. Based on research conducted by the authors, it can be concluded that in Indonesia there is no rule of law regarding surrogate mother in vitro fertilization was done on comparative law in the United States that existing laws regarding surrogate mother. Given so many problems that would arise from a surrogate mother, then in Indonesia can only prosecute acts surrogate mother hanging from the crime that he did, not by works done in vitro fertilization that are prohibited in the health care legislation, but not diseertai by penal provisions, while in Indonesia should the criminal law setting a surrogate mother in vitro fertilization made special rules equivalent laws or amend laws to regulate the practice of healthcare surrogate mother in the conduct of in vitro fertilization.
