Abstract

Pada tahun 2012, pencari suaka yang datang ke Australia dengan menggunakan kapal memiliki jumlah tertinggi tingkat kedatangannya. Pemerintahan Julia Gillard kemudian mencari cara untuk dapat menghentikan laju manusia perahu ini untuk terus datang ke wilayah Australia. Pemerintah kemudian mengeluarkan kebijakan untuk menggunakan kembali kebijakan yang sering disebut dengan kebijakan Pacific Solution yang pernah dilakukan pada masa pemerintahan perdana menteri John Howard. Penggunaan kembali kebijakan Pacific Solution bertentangan dengan Australia sebagai salah satu negara yang meratifikasi Konvensi Pengungsi 1951 karena dengan menggunakan pusat detensi yang ditempatkan di luar Australia. Penelitian ini bertujuan untuk dapat menganalisis bagaimana proses penggunaan kembali kebijakan Pacific Solution yang dilakukan oleh perdana Julia Gillard. Menurut Poliheuristic Theory yang ditulis oleh Alex Mintz, untuk dapat melihat suatu kebijakan diputuskan oleh pembuat kebijakan ini akan melalui dua tahapan, dimana tahapan pertama berisi penentuan alternatif kebijakan, noncompensatory rule dimension based, dan avoid political loss. Lalu kemudian tahapan kedua berisi perhitungan rasionalitas dari sisa alternatif kebijakan yang ada dan yang terakhir aktor pembuat kebijakan menentukan kebijakan mana yang akan digunakan.

English Abstract

In 2012, asylum seekers coming to Australia by boat have the highest number of arrivals. Julia Gillard's government then find ways to stop boat people to continue come to Australia. The government then issued a policy to reuse of Pacific Solution policy, which is this policy ever done during the reign of prime minister John Howard. The reuse of Pacific Solution's policies contradicts with the fact Australia as one of the countries that ratified the 1951 Refugee Convention because with using this policy Australia locate the boat people to offshore detention center. This research aims to analyze how the process of reuse of Pacific Solution policy conducted by the prime Julia Gillard. According to Poliheuristic Theory written by Alex Mintz, to be able to see a policy decided by the policy makers will go through two stages, where the first stage contains the determination of policy alternatives, noncompensatory rule dimension based, and avoid political loss. Then the second stage contains the calculation of the rationality of the remaining policy alternatives that exist and the last done is the policy-making actors determine which policy to use.
