Abstract
Uruguay merupakan negara pertama di dunia yang tidak patuh terhadap Single Convention on Narcotic Drugs 1961. Konvensi ini berisi tentang aturan-aturan yang melarang negara untuk memproduksi dan mengkonsumsi narkoba untuk kepentingan rekreasional. Terdapat lebih dari tujuh puluh negara yang turut mendiskusikan dan meratifikasi konvensi tersebut. Di awal pembentukan Single Convention on Narcotics Drugs 1961, Uruguay merupakan anggota yang aktif dan partisipasif dalam merumuskan ketentuan–ketentuan konvensi. Hal ini terbukti dengan menjabatnya Uruguay sebagai pimpinan dalam Ad Hoc Committee for Information to be furnished by Governments, the system of estimates and statistics, and obligations of Governments in general. Uruguay bersama beberapa negara lainnya dalam Ad Hoc Committee ini merumuskan tiga ketentuan yang harus dilakukan pemerintah dalam upaya memerangi produksi bahan baku obat – obatan terlarang. Ketentuan ini kemudian dimasukkan dalam Final Act of The United Nation Conference for The Adoption of A Single Convention on Narcotics Drugs 1961 article 4. Salah satu kewajiban yang tertera dalam pasal 4 tersebut adalah setiap negara anggota wajib memberdayakan dan melaksanakan ketentuan–ketentuan konvensi di wilayah masing – masing negara. Pada tahun 2013, Uruguay sebagai negara yang turut menginisiasi kewajiban negara untuk melaksanakan ketentuan-ketentuan tersebut, justru tidak patuh terhadap ketentuan konvensi khususnya pasal 28 mengenai ganja. Presiden Jose Mujica melalui Poder Legislativo ley no 19.172 melegalkan ganja untuk kepentingan rekreasional di tahun 2013. Keganjilan perilaku inilah yang menarik adanya penelitian mengenai alasan Uruguay tidak patuh terhadap Single Convention on Narcotic Drugs 1961 melalui pengesahan Poder Legislativo ley no 19.172 tentang pelegalan ganja untuk kepentingan rekreasional. Penelitian ini akan menganalisis alasan-alasan tersebut dengan Noncomplying Behavioral Theory milik Abram Chayes dan Antonia Handler Chayes yang merangkum tiga alasan ketidakpatuhan diantaranya ambiguity, limitation on capacity, dan the temporal dimension. Diharapkan, penelitian ini dapat menjelaskan anomali yang terjadi pada ketidakpatuhan Uruguay terhadap Single Convention on Narcotic Drugs 1961.
English Abstract
Uruguay was the first country in the world that break the Single Convention of Narcotic Drugs 1961. The Convention contains rules that prohibit countries from producing and consuming drugs for recreational purposes. There are more than seventy countries that participated and ratified the convention. At the beginning of the Single Convention of Narcotic Drugs 1961, Uruguay was an active and participative member in formulating the provisions of the Convention. This is evidenced by the inclusion of Uruguay as a leader in the Ad Hoc Committee for Information to be provided by the Government, the system of estimation and statistics, and the obligations of the Government in general. Uruguay along with several other countries in the Ad Hoc Committee formulated three provisions that the government should make in an effort. This provision is subsequently incorporated into the Final Act of the United Nations Conference for the Adoption of the Narcotic Convention on Narcotics of 1961 article 4. One of the obligations under Article 4 is that each Member State shall empower and implement the provisions of its territories. In 2013, Uruguay as a state that initiate the provisions, precisely broke the provisions of the Convention, particularly article 28 on marijuana. President Jose Mujica through Poder Legislativo ley no 19,172 legalize marijuana for recreational purposes in 2013. Uruguay’s oddity compels a research about the cause of Uruguay’s noncomplying behaviour toward Single Convention of Narcotic Drugs 1961 through the adoption of Poder Legislativo ley no 19.172 about cannabis for recreational purposes. This research will analyze these causes using Abram Chayes and Antonia Handler Chayes’s Non Complying Behavioral Theory which summarizes in three reasons, they are ambiguity, limitation on capacity, and the temporal dimensions. It is expected that this research will be able to explain the anomaly in that occurred in Uruguay's disobedience to the Single Convention of Narcotic Drugs 1961.
