Abstract
Terjadinya perkembangan ekonomi akan berkaitan dengan perdagangan serta diikuti perkembangan terhadap kebutuhan mengenai pemberian fasilitas kredit.Pada dasarnya pemberian kredit tidak terlepas dari penyerahan suatu jaminan oleh calon debitur kepada kreditur. Jaminan benda bergerak dapat dibebani dengan fidusia. Kredit dengan jaminan fidusia akan menimbulkan permasalahan saat kredit macet pada pelaksanaan eksekusi objek jaminan fidusia. Berdasarkan latar belakang diatas, maka permasalahan hukum yang timbul saat eksekusi objek jaminan fidusia dilaksanakan, seperti yang dikemukakan dalam penelitian digadaikan, dipindah tangankan, objek bukan milik debitur dan pemilik lepas tanggung jawab. PT. BPR Sentral Arta Asia Lumajang mengalami permasalahan yaitu pelaksanaan perlindungan hukum dalam rangka eksekusi objek jaminan fidusia. Untuk menjawab permasalahan di atas, penulis menggunakan metode penelitian yuridis empiris penulis menelaah kaidah-kaidah hukum yang terjadi di masyarakat. Penulis akan mencari data secara langsung di lapangan untuk memperoleh data sesuai dengan permasalahan yang terjadi. Serta menggunakan bahan pustaka berupa data primer dan sekunder untuk mendukung penelitian ini. Maka dapat disimpulkan tidak terlaksananya perlindungan hukum terkait pelaksanaan eksekusi objek jaminan fidusia disebabkan itikad buruk debitur dalam menyelesaikan kewajibannya dan kurang memahami klausula dalam Undang- Undang Nomor 42 Tahun 1999 tentang Jaminan Fidusia dan Akta Jaminan Fidusia.
English Abstract
The occurrence of economic development will be called by trade as well. Basically there is no credit from employment by debtor candidate to creditor. Moving objects can be loaded with fiduciary. Credit with fiduciary will cause problems when the credit is stuck on the implementation of fiduciary object execution. Based on the above background, then the legal issues arising during the execution of fiduciary guarantee objects implemented, as proposed in mortgaged research, transferable hands, objects not belonging to the debtor and the owner off the responsibility. PT. BPR Sentral Arta Asia Lumajang encountered problems of implementing legal protection in the execution of fiduciary guarantee objects. To answer the above problems, the author uses research methods empirical juridical writer examines the rules of law that occur in society. The author will search the data directly in the field to obtain data in accordance with the problems that occur. And using library materials in the form of primary and secondary data to support this research. Then it can be concluded that the implementation of the legal protection related to the execution of fiduciary guarantee object execution is due to the debtor's bad faith in settling its obligation and lack of understanding clause in Law Number 42 Year 1999 regarding Fiduciary Guarantee and Fiduciary Guaranty Act.
