Abstract
Investasi ilegal bertentangan dengan ketentuan hukum karena melanggar Pasal 46 Undang-Undang Perbankan, Pasal 59 Undang-Undang Perbankan Syariah, serta Pasal 378 KUHP. Sebagian besar pelaku kegiatan tersebut tidak selamanya dilakukan sebuah entitas lembaga jasa keuangan yang resmi berada di bawah kewenangan Otoritas Jasa Keuangan, baik perizinan, pengaturan maupun pengawasannya. Hal ini terjadi pada kasus First Travel, sebuah biro perjalanan umroh yang menghimpun dana sekitar Rp 550 miliar. Kasus First Travel ini ditangani oleh Otoritas Jasa Keuangan (OJK) dengan membentuk Satgas Waspada Investasi. Berdasarkan ketentuan Pasal 4, 5, 6 dan Pasal 34 UU BI beserta penjelasannya mengenai pengaturan fungsi, tujuan, dan kewenangan pengawasan OJK, disimpulkan bahwa kewenangan pengawasan OJK terbatas hanya meliputi lembaga sektor jasa keuangan baik berupa bank maupun non bank. Beranjak dari uraian latar belakang di atas, maka patut dipertanyakan kewenangan pengawasan OJK terhadap kegiatan yang dilakukan First Travel. Berdasarkan latar belakang tersebut di atas, maka permasalahan hukum yang dikemukakan dalam penelitian ini adalah bagaimana kewenangan pengawasan Otoritas Jasa Keuangan terhadap kegiatan penghimpunan dana oleh non lembaga keuangan. Untuk menjawab permasalahan di atas, penelitian hukum normatif ini menggunakan pendekatan perundang-undangan dan pendekatan kasus. Bahan hukum yang berhubungan dengan masalah yang diteliti diperoleh melalui penelusuran kepustakaan. Bahan-bahan hukum yang telah diperoleh dianalisis dengan menggunakan metode interpretasi gramatikal dan interpretasi sistematis sehingga dapat disajikan dalam penulisan yang lebih sistematis guna menjawab isu hukum yang telah dirumuskan. Berdasarkan pembahasan, maka dapat disimpulkan bahwa kewenangan pengawasan OJK terhadap kegiatan penghimpunan dana oleh non lembaga keuangan adalah OJK tidak mempunyai kewenangan, walaupun non lembaga keuangan tersebut melakukan kegiatan penghimpunan dana. Ditinjau pada ketentuan Pasal 4, 5, 6 Undang-Undang OJK dan Pasal 34 Undang-Undang Bank Indonesia beserta penjelasannya mengenai pengaturan kewenangan pengawasan OJK, dijelaskan bahwa OJK mempunyai kewenangan terbatas hanya pada lembaga keuangan baik berupa bank maupun non bank, sedangkan First Travel vii dikategorikan sebagai non lembaga keuangan berbentuk sebuah biro perjalanan ibadah haji dan umroh.
English Abstract
Illegal investment is against the legal provisions for violating Article 46 of the Banking Act, Article 59 of the Law on Islamic Banking, and Article 378 of the Criminal Code. Most of the perpetrators of such activities are not always made an entity financial services agency that is officially under the authority of the Financial Services Authority, either licensing, regulation and supervision. This happened in the case of First Travel, an umroh travel agency that raised about Rp 550 billion. The First Travel case is handled by the Financial Services Authority (OJK) by establishing the Investment Alert Task Force. Based on the provisions of Articles 4, 5, 6 and 34 of the BI Law and its explanations regarding OJK regulatory functions, objectives and authority, it is concluded that OJK supervisory authority is limited to covering only financial services institutions in the form of banks and non-banks. Moving from the description of the background above, it is questionable OJK supervision authority on activities made First Travel. Based on the above background, then the legal issues raised in this study is how the supervision authority of the Financial Services Authority to fund raising activities by non-financial institutions. To answer the above problem, this normative legal research uses approach of legislation and case approach. Legal material related to the problem studied was obtained through literature search. The legal materials that have been obtained are analyzed using grammatical interpretation method and systematic interpretation so that it can be presented in a more systematic writing to answer the legal issues that have been formulated. Based on the discussion, it can be concluded that OJK oversight authority over fund raising activities by non financial institutions is OJK does not have the authority, although non financial institutions do fund raising activities. In view of the provisions of Articles 4, 5, 6 of the OJK Law and Article 34 of the Bank Indonesia Law and its explanations on the regulation of OJK oversight authority, it is explained that OJK has limited authority only on financial institutions in the form of banks and non banks, while First Travel is categorized as a non-financial institution in the form of a travel agency of Hajj and Umrah.
